All non-owners will be given be given a wrist band, and depending on the time of year and the age of the non-owner, they may be charged a fee. (Wristbands for non-owners have two colors – one for those subject to a fee and another for those not subject to a fee).

 During peak season, ALL renters, with the exception of property owners, MUST wear wrist bands AT ALL TIMES WHILE ON PROPERTY.

 Fees: March 1st-Semana Santa (Holy Week): $35/per person, for ages 14-30.

Replacement Wrist Bands: $50/per person.

The owners of Aquarius Condominiums welcome you to our building! While staying here, we ask that you follow a few requests that will make everyone’s stay more enjoyable and keep the property looking good year after year.

1. Parking ~ is limited to 1 vehicle per unit inside the gate. Please park any additional vehicles outside the gate in public parking spaces. Vehicles must be licensed, operable and registered to the occupants. Unauthorized vehicles will be towed at the owners’ expense.

2. Occupancy ~ Our condo maximum capacity is NO MORE than 4 guests. There must be at least one adult 30 years of age or older, registered, present and residing in the unit through the duration of the tenancy. ONLY registered guests may utilize the complex amenities.

3. Noise ~ Loud noise of any sort; music, loud talking, boom boxes, etc. in the common areas, hallways, balconies porches, pool and parking lot is not allowed.

4. Balconies ~ No objects (cigarette butts, food for gulls, soda cans, beer cans etc.) are to be thrown from a balcony or corridors at any time for any reason. Nothing should be hanging in the railings. ** Management charges a $500.00 cleaning fee if your front balcony in front of your unit is soiled and/or littered. ** Please clean your area, sweep up sand, dirt, trash, etc.

5. Garbage and Tidiness ~ Garbage should all be disposed of by an adult in the large dumpsters on the sides of the building. Please DO NOT dispose of cigarette butts, cans, candy wrappers, trash on the ground. We work hard to make certain the property looks good when you check in. Please help us keep it that way by picking up any litter before you leave.

6. Pets ~ Pets are not allowed in our building.

7. Pool ~ Please wash ALL sand from your body BEFORE entering our pool. The pool equipment cannot handle sand from the beach and causes damage and equipment failure. Showers are located in the back of the pool yard. Also no water balloons are allowed in pool area.

8. BBQ ~ BBQ pits of any kind are Prohibited. Use ot the common BBQ pits is allowed.

9. Once booked, we will send a custom Rental Agreement for you to complete and send back to us. Without this agreement we will not be able to host you.

Our condo is located in the center of the island at walking distance to the Entertainment Center where you find plenty of restaurants, shops and bars. Our local supermarket The "Blue Marlin" is about 6 blocks away. We are only one block from the Stripes Gas Station which by the way has great breakfast tacos!!

Aquarius 505 - Rental Agreement

TERMS & CONDITIONS
RENTAL LEASE: This Rental Agreement for Aquarius #505, located at 2000 Gulf Blvd., South Padre Island, Texas 78597 (Property) is entered into on behalf of Kent and Heidi McInnes (Owner) and ____________ (Guest). The Guest is fully responsible for all occupants and their conduct on the Property and their compliance with the Rental Agreement, Rental Policies and Aquarius Condominiums Rules and Regulations.

NOTE: Guest must be 30 years of age or older to enter into this agreement.

RESPONSIBILITY: Guest acknowledges and accepts that he/she is responsible for the Property while the rental agreement is in effect and will make all good efforts to maintain the Property in a reasonable condition. The Guest acknowledges that any damage or changes to the Property will be reported to the Owner as soon as possible. If a problem on the unit is reported to us, we will contact you but, in some emergencies, maintenance might need to go in without notice. If local emergency crews and/or police are called, the owner/manager/representative will enter the premises without advanced notice to facilitate their work. You will be notified via Airbnb email and/or by phone if any of these happen.

CLEANING: No daily/weekly house cleaning is included in the rental agreement. However, arrangements can be made for a house cleaner during the course of the rental at the Guest’s expense. Contact 956-761-1746 for scheduling. In the case of a mandatory hurricane evacuation, the Guest is responsible for removing all items from the refrigerator before leaving the island.

HURRICANE PROCEDURE: In case of mandatory evacuation from the island, all guests must vacate the premises as required by local police.

PARKING: One car per condo can park inside the gate. The remaining vehicles have to park outside of the gate. At check in, one parking pass will be provided by the front desk. This parking pass has to be displayed on the dashboard of the car at all times. Do not risk being towed.

MANAGEMENT AND MAINTENANCE PERSONNEL: Aquarius Management and Maintenance Personnel are there ONLY to attend to the common areas and enforce the complex rules. Please do not call them for issues inside your unit. Please contact the Owners or their Representative directly.

RENTAL POLICIES: Guest has read and understands all of the Rental Policies for the Property. Guest understands that those policies will be fully enforced by Owner and Building’s Management. The Rules and Regulations and By-Laws of the building supersede any other policy.

CONDO/ISLAND LIVING: South Padre Island is a barrier reef connected to the mainland by a bridge. Often we experience unavoidable water service and electricity cut offs. The same happens in our building. When it happens and while it is not in our hands we ask our guests to be patient until service is restored. Sometimes our building goes under maintenance, cleaning, etc. This is also a must do situation and we appreciate your understanding if it happens while you are on vacation.

INDEMNIFICATION: Guest agrees to and does hereby indemnify and hold harmless Aquarius Condominiums, the Owner of Aquarius #505, and his representatives and assigns, from any and all claims, liability, and injury to person or persons upon the Property from any cause whatsoever. This full indemnification includes and is not limited to any and all suits, injury, costs, losses, action, court cost, attorney fees, penalties and damages of any kind, however caused (except for willful gross negligence) and any expenses arising from or related thereto; from the Guest’s rental, use and enjoyment of the Property during the term of the contract.

DURATION: This lease will commence on __/__/____ and shall continue until __/__/____ (“departure date”). The duration of this agreement shall not continue past the departure date specified in this agreement and the Guest agrees to vacate the property on the departure date and to leave the property in the same condition as at the commencement of the Rental Agreement. The Aquarius premises must be vacated at the time of checkout set forth in the Rental Policies.
