MT Sebastian
Property: Sub-Penthouse Point D (holiday property)

Please read your Holiday Rental Agreement carefully before you begin your stay. Any monies received by MT Sebastian for occupancy of a holiday property, indicates the acceptance of the terms of our holiday Rental Agreement in full. All policies are strictly enforced. It is the responsibility of all guests and members of their party to be familiar with all policies pertaining to this rental.


• Check-in time 2pm QLD time, unless otherwise agreed, please do not arrive prior to 2pm
• Check-out time 10am QLD time, unless otherwise agreed, please do not depart later than 10am. Extra fees and charges may be applied for unauthorized late check outs.
• No Smoking anywhere inside or outside on public space around the property
• No Pets Allowed anywhere inside or on the property
• Maximum Occupancy 6 persons (excluding infants under 12 months of age), unless otherwise agreed
• Security Deposit - $1000
Accommodation Terms
You and your guests agree to keep the property clean, to leave the property in the same condition as you found it when you arrived, and to behave in a manner at all times while at the property which does not break any law or offend neighbours.

You also commit not to use the property for any illegal or commercial purpose, including but not limited to sub-lease the property or otherwise allowing anyone or more people to stay above the maximum permitted or if not previously agreed with the owner.

You are responsible for any breakage or damage costs (or related costs) in or to the property - along with any extra cleaning/admin costs that may result - which are caused by you or any members of your party.

The owner can refuse to allow you into the property or ask you to leave if they reasonably believe you or any member of your party (or any other person you have invited to the property) are behaving illegally or inappropriately or that any damage is likely to be caused, has been caused or is being caused as a result of your behaviour of you or any members of your party or any person you have invited to the property.

You must not hold events (such as parties, celebrations or meetings) at the property without the advance written consent of MT Sebastian. If you do any of these things, MT Sebastian can refuse to hand over the property to you or can repossess it. We will treat this as cancelling the booking. In these situations you will not receive a refund of any money you have paid for your booking and the owner will not be legally responsible to you as a result of this situation and the owner is under no obligation to find any alternative accommodation for you.

You must allow the owner or their representative (including tradespeople), with reasonable notice, access to the property at any reasonable time during your stay (except in an emergency or if a problem needs sorting out quickly and you cannot be contacted in time. In these situations, the owner can enter the property at any time without giving you prior notice).
Guest Requirements
The person making the reservation must be the same as the person responsible for ensuring house rules are adhered to. This person is considered to be the Guest. All other persons involved with the booking are considered to be the Guest's invitees, and all discussion regarding reservation, cancellation, and damage policies will be discussed with the Guest, not the Guest's invitees. The Guest understands that MT Sebastian rent to responsible adults over the age of 18 only.

Damage Policy

As a condition to the rental of Point D, MT Sebastian reserve the right to deduct funds from the security deposit bond for any and all Guest/Invitee-caused losses and damages sustained to the Holiday Property throughout the duration of their period of occupancy. In the event of any Guest/Invitee-caused loss or damage to the Holiday Property, including, but not limited to, undue cleaning, eviction, service calls, service charges, fines/assessments, repairs or replacements, plus all applicable GST, MT Sebastian is hereby granted the right to deduct from or refuse to refund the security deposit, see below;

All properties will require a refundable security deposit. If a security deposit has been paid, no portion may be applied to additional rental time or fees or other charges accrued by the Guest/Invitees. The entire deposit will be refunded if:

(1) no damage was done to the property other than reasonable wear and tear,
(2) all keys and garage openers are accounted
(3) no items were missing,
(4) all doors and windows, including garage doors were closed and secured upon departure,
(5) all air conditioning units are turned off
(6) the property is left in a neat and tidy manner to allow our cleaner to commence work to prepare the property for our next guests
(7) all check out procedures were followed
(8) all Rental Agreement policies were followed
(9) no miscellaneous charges were incurred, i.e. no extra guests, pets, additional cleaning fees, additional guests not pre-approved or other charges

Upon request, an itemized statement outlining all associated costs will be sent via regular or electronic mail to the address submitted by the Guest at such time as the reservation was booked. By written or electronic endorsement of this Agreement, the Guest hereby agrees to pay for all such charges, as defined above and on the proceeding pages.
House Rules
• Quiet time outside the unit between 8pm until 8am. Please be respectful of our neighbours
• No parties, bucks, hens or other gatherings or events
• Maximum occupancy at all times is six guests (plus one infant under 12 months of age), unless otherwise approved by the owner. Additional guest charge is $50 per person per night.
• Only those guests registered at the time of booking are permitted to stay on the property. This includes gathering in the shared outdoor space.
• We reserve the right to contact your booking platform to terminate your booking if the above rules are broken, no refunds will be offered if this is the case
• Do not flush anything other than toilet paper; no feminine products or other bio degradable materials should be flushed. Please use the bins provided.
• Pets: there are no pets allowed in the unit or on the property. If pets are found to have stayed you will be responsible for the costs of deep cleaning the unit including all soft furnishings and linens
• On check in take a look around the unit. If there are concerns or issues contact us immediately. No refunds or considerations are given unless we are notified of problems during your stay.
• On check out please ensure you take your rubbish out and place dirty plates etc into the dishwasher with the dishwasher switched on.
• Please leave the apartment neat and tidy so our cleaner can come through. Our cleaner will handle all standard cleaning and linen.
Any excess cleaning is charged at a rate of $35 per hour (pro rata)
• On departure please ensure you place the keys on the bench so our cleaner can come through.
• NO SMOKING: there is to be no smoking in the unit, or on the common property during occupancy. Guest will be responsible for any damage to the property caused by cigarettes and/or cigarette smoke which will include charges for deep cleaning of unit, linens and soft furnishings
• Parking is limited to one car only in the undercover locked garage.
• A later check-out may be available, please let me know if this would help you. We can only accommodate if there are no guests arriving that day. At other times a rate of $35 per hour may be applied.
• Please note, once your booking has been accepted, all guest communications will be via the airbnb platform
• Please rinse off all sand and dry off before entering Point D apartment complex
• Do not leave wet or damp towels or clothing on any indoor/outdoor furniture or bedding
• Please refrain from moving around or changing furniture in the apartment
• Please note that this is a privately owned home. In the event of any major equipment malfunction we will endeavour to rectify within normal business hours. There will not be any refunds or adjustments. Please let us know via the airbnb platform of any issues ASAP.
Emergencies/Maintenance
MT Sebastian does not guarantee against mechanical or electrical failure of air conditioning, fans, lights, televisions, kitchen appliances, WiFi or other equipment. The guest agrees to report any inoperative items to MT Sebastian via the Airbnb platform promptly, and MT Sebastian agrees to make every effort to have maintenance done quickly and efficiently. Should a repair person conclude that equipment is in working order, or that failure was due to the actions of the Guest, then the charge for the service call will be billed to Guest and Guest agrees to pay the charge. No refund or rent deduction will be made due to failure of such equipment.

Right to Enter
If necessary, MT Sebastian or their designated vendors may enter the property in order to inspect or make necessary or requested repairs. MT Sebastian will provide Guest at least 2 hours’ minimum notice before entering the Property, and will only enter during reasonable hours except in the case of emergency.
Cancellations
We operate without exception a strict cancellation policy. You are strongly advised to take out your own travel insurances to cover the duration of your stay. Please read and understand the cancellation policy on Airbnb. If you do not purchase your own travel insurance you understand that you have read our policy and have chosen not to purchase your own travel insurances for yourself and your guests.

Owner MT Sebastian Cancellation Policy: In the unlikely event that the Property becomes unavailable for any part of the tenancy for reasons beyond the control of MT Sebastian, including but not limited to the sale of the holiday property, MT Sebastian may cancel this Agreement and refund in full to the Guest all payments made. MT Sebastian will try to assist in procuring similar alternative accommodation should this situation arise. Guest agrees that any claims against MT Sebastian arising out of performance or non-performance under this agreement shall be limited to a full refund of all consideration previously tendered by Guest.
MT Sebastian does not provide insurance coverage for the guests property or shall be responsible for the loss of guests property whether by fire, theft, acts of God or otherwise. MT Sebastian strongly recommends the guest take out adequate travel insurance cover.
Minimum Stay
This property requires a minimum stay of 7 nights. If a booking is taken for less than 7 days, the guest will be charged the nightly rate, which applies at the time of the booking.

Other Fees
A cleaning fee of $250 applies to all bookings.

Occupancy
A list of the first and last names of ALL persons occupying the property is required at the time of booking.
Written Exceptions
Any exceptions to the abovementioned policies must be written approved by the owner in advance.
Parking
Parking is limited to 1 vehicle. Vehicles are to be parked in the allocated garage only, numbered 12.

Departure Time
Departure time is 10am QLD time.Your prompt departure is appreciated so we can prepare the unit for any incoming guests. If you have not arranged for a late check out, you may be charged $35 for each hour beyond the check out time that you are still on property, at a minimum of one hour. If the unit has not been vacated by 4 pm, a fee equal to 1/2 of the daily rental rate may be assessed.

Power or Weather-related Cancellation

MT Sebastian does NOT issue refunds due to acts of nature such as: weather, road conditions, hurricanes, airline cancellations, power outages etc, however, Travel Protection Insurance may provide some protection against these instances.

Construction
MT Sebastian are not responsible for any construction noise beyond the Property. Guest accepts that MT Sebastian has no control over the hours of work or noise level of any construction beyond the Property. Audible construction noise shall not void or negate this Agreement, nor shall it serve as a basis for claim for refund, price reduction, or other form of compensation.
Change Dates Policy

There is no guarantee of approval of changes to your reservation once confirmed, although we will do our utmost to accommodate any amendments to your booking, subject to availability.

Private Property:

Guest acknowledges that the accommodation is a privately-owned home as
opposed to a hotel. As such, hotel-like amenities such as daily cleaning and servicing and guest services will not be provided.

Environment
Guest(s) hereby acknowledge that Queensland/NSW are exposed to such environmental hazards including but not limited to Tidal Wave/Tsunami, Cyclone and Flooding. We recommend Holiday travel insurance for any unforeseen circumstances. Because we are in the Tropics, you may encounter geckos, mosquitos, cockroaches and other pests. Our properties are treated regularly for pest control maintenance; however, pests are a normal part of life in the tropics. MT Sebastian does not issue refunds due to the presence of pests in the Property.

Property Usage Charge

Guest understands and agrees that the Rental Charges are determined based on Guest’s planned Arrival and Departure dates, and that MT Sebastian incurs significant costs based on the number of days that Guest actually occupies and uses the Property. Guest further understands and agrees that in the event that they occupy the Property for more days than specified, based on the Arrival Date and Departure Date, that Guest will pay an additional Property Usage Charge, and Guest authorizes Agent/Owner to deduct from or refuse refund of the security deposit bond.

Security
The guest acknowledges that MT Sebastian does not provide a security system or any security for the guest. The guest hereby releases MT Sebastian from any loss, claim or damage or injury resulting from lack or failure of security.
