Deze Betalingsvoorwaarden voor Europese Gebruikers ('Betalingsvoorwaarden') zijn een bindende juridische overeenkomst tussen jou en Airbnb Payments, die de (hieronder gedefinieerde) Betalingsdiensten regelen via of in verband met het Airbnb-platform. Als in deze Betalingsvoorwaarden 'Airbnb Payments', 'we', 'ons', of 'onze' staat, verwijst dat naar:
Deze Betalingsvoorwaarden en de documenten, het beleid en de normen waarnaar hierin wordt verwezen, zijn een bindende juridische overeenkomst tussen jou en Airbnb Payments, en regelen de (hieronder gedefinieerde) Betalingsdiensten die worden uitgevoerd via of in verband met het Airbnb-platform.
De documenten waarnaar in deze Betalingsvoorwaarden wordt verwezen, omvatten maar zijn niet beperkt tot ons of onze:
Voor het gemak hebben we hierboven verschillende voorwaarden en beleidsregels vermeld waarnaar in deze Betalingsvoorwaarden wordt verwezen. Het is belangrijk om te weten dat er andere aanvullende beleidsregels en voorwaarden van toepassing zijn op jouw gebruik van het Airbnb-platform. Deze zijn opgenomen door middel van verwijzing en maken deel uit van de bindende juridische overeenkomst tussen jou en Airbnb. De link vind je op onze pagina met Aanvullende juridische voorwaarden.
Onze voorwaarden en ons beleid zijn georganiseerd op basis van de onderwerpen waarop ze betrekking hebben. Zo vind je makkelijk de voorwaarden die of het beleid dat relevant is voor jouw vraag of situatie.
Airbnb Payments biedt betalingsdiensten aan Leden die Accommodaties, Ervaringen of andere Host Services publiceren, aanbieden en boeken, inclusief services in verband met Airbnb.org en andere huidige en toekomstige services die via het Airbnb-platform worden aangeboden. Deze betalingsdiensten zijn bedoeld voor Hosts en kunnen (indien beschikbaar) het volgende omvatten (samen 'Betalingsdiensten'):
Airbnb Payments biedt alleen gereguleerde Betalingsdiensten aan Hosts aan als tussenpersoon voor het innen van betalingen voor beperkte doeleinden, door geld van Gasten die Host Services aankopen, namens de Host te accepteren en te verwerken.
Om van de Betalingsdiensten gebruik te kunnen maken, moet je ten minste 18 jaar oud zijn, een Airbnb-account met een goede reputatie hebben in overeenstemming met de Gebruiksvoorwaarden van Airbnb ('Voorwaarden'), jouw betalings- en persoonsgegevens correct en volledig houden en ons op verzoek identiteitsgegevens en andere gegevens verstrekken.
Als je je land van verblijf wijzigt, worden het Airbnb-bedrijf waarmee je een contract aangaat en de toepasselijke versie van de Betalingsvoorwaarden bepaald door dat land vanaf de datum waarop je verhuist. Door de Betaaldiensten te blijven gebruiken na jouw wijziging van land van verblijf, ga je akkoord met die wijziging van de contracterende partij en voorwaarden. Het Airbnb Payments-bedrijf waarmee je een contract hebt, blijft hetzelfde voor alle boekingen die vóór de wijziging van jouw woonplaats zijn gemaakt.
De Voorwaarden zijn afzonderlijk van toepassing op je gebruik van het Airbnb-platform. Als je een niet-gedefinieerde term in deze Betalingsvoorwaarden ziet, heeft deze dezelfde betekenis als in de Voorwaarden.
Door de Betalingsdiensten te gebruiken, ga je akkoord met deze Betalingsvoorwaarden. Airbnb Payments kan jouw toegang tot of gebruik van de Betalingsdiensten of de functies ervan tijdelijk beperken of opschorten om onderhoud uit te voeren dat de goede werking van de Betalingsdiensten garandeert.
De Betalingsdiensten kunnen links bevatten naar externe websites of bronnen ('Services van derden'). Services van derden zijn onderworpen aan andere servicegebruiksvoorwaarden en een ander privacybeleid, en Leden moeten die lezen. Airbnb Payments is niet verantwoordelijk voor het gebruik van Services van derden. Links naar Services van derden betekenen niet dat Airbnb Payments die Services van derden aanbeveelt.
Airbnb Payments kan functies aanzetten waarmee je andere Leden of derden toestemming kunt geven om bepaalde acties uit te voeren die invloed hebben op jouw account op Airbnb. Je kunt een derde partij machtigen om jouw account op Airbnb te gebruiken als de functie voor jouw account op Airbnb aanstaat. Je gaat ermee akkoord dat iedereen die jij machtigt om jouw account op Airbnb te gebruiken, namens jou de Betalingsdiensten mag gebruiken en dat jij verantwoordelijk bent voor betalingen die deze personen uitvoeren.
Je machtigt Airbnb Payments, rechtstreeks of via derden, om informatie op te vragen die wij nodig achten om jouw identiteit en de door jou verstrekte informatie te verifiëren en, indien van toepassing, om de identiteit van de vertegenwoordiger(s) en uiteindelijk belanghebbende(n) te verifiëren. Dit kan gebeuren door (i) jou en, indien van toepassing, jouw vertegenwoordiger(s) en uiteindelijk belanghebbende(n) te screenen via databases van derden of andere bronnen, (ii) rapporten op te vragen bij serviceproviders, (iii) jou en, indien van toepassing, jouw vertegenwoordiger(s) en uiteindelijk belanghebbende(n) om een vorm van overheidsidentificatie te vragen (bijv. rijbewijs of paspoort), om jouw naam, geboorteplaats en -datum, jouw adres, nationaliteit en/of andere informatie te controleren die wij volgens de toepasselijke wetgeving nodig achten; of (iv) jou te vragen dat je stappen onderneemt om het eigendom van jouw e-mailadres, Betaalmethode(n) of Uitbetalingsmethode(n) te bevestigen. Airbnb Payments behoudt zich het recht voor om de toegang tot de Betalingsdiensten te beëindigen, op te schorten of te beperken als we deze informatie niet kunnen verkrijgen of verifiëren.
Jouw toegang tot of gebruik van bepaalde Betalingsdiensten kan afhankelijk zijn van of vereisen dat je akkoord gaat met aanvullende voorwaarden. Als deze Betalingsvoorwaarden afwijken van de voorwaarden van een specifieke Betalingsdienst, hebben deze laatste voorrang met betrekking tot jouw gebruik van of toegang tot die Betalingsdienst, tenzij anders aangegeven.
Wanneer je een Betaalmethode aan jouw account op Airbnb toevoegt, word je gevraagd om factureringsgegevens, zoals de naam, het factureringsadres en het financiële instrument, te verstrekken aan Airbnb Payments of de externe betalingsverwerker(s). Je machtigt Airbnb Payments en die betalingsverwerker(s) om de gegevens van jouw Betaalmethode te verzamelen en op te slaan in overeenstemming met het Privacybeleid van Airbnb.
Wanneer je een Betaalmethode toevoegt of gebruikt, kan Airbnb Payments de Betaalmethode verifiëren door (i) een of twee kleine bedragen over te maken naar jouw Betaalmethode via een betalingsdienstaanbieder en je te vragen die bedragen te bevestigen, of (ii) je te vragen een rekeningoverzicht te uploaden. We kunnen, en behouden ons het recht voor om, deze bedragen terug te laten boeken via jouw Betaalmethode. Wanneer je bij de betaling een betaalmethode toevoegt, slaan we die betaalmethode automatisch op en voegen we die toe aan jouw account op Airbnb, zodat deze voor een toekomstige transactie kan worden gebruikt. Je mag de Betaalmethode die aan een boeking is gekoppeld, niet verwijderen tijdens de periode vanaf de datum van jouw boeking tot veertien (14) dagen na je vertrekdatum, en ook niet tijdens een mogelijke extra periode om een openstaand Schaderapport in verband met een boeking af te handelen.
Je staat Airbnb Payments toe om, direct of indirect, alle kosten en andere verschuldigde bedragen (inclusief toepasselijke belastingen) in verband met jouw account op Airbnb via jouw Betaalmethode (of meerdere Betaalmethodes), in rekening te brengen, waaronder ook Schaderapportbedragen in overeenstemming met de Voorwaarden en met Artikelen 5 en 6.
Als de gegevens van jouw Betaalmethode veranderen (bijv. account- of kaartnummer, routingnummer, vervaldatum of CVV- of CVC-nummer) als gevolg van een nieuwe uitgifte of anderszins, kunnen we die informatie verkrijgen van onze partners voor financiële dienstverlening of van jouw bank, en jouw Betaalmethode automatisch bijwerken in ons bestand.
Airbnb Payments brengt over het algemeen de verschuldigde Totaalprijs in rekening nadat de Host jouw boekingsaanvraag heeft geaccepteerd. Als je echter met een Push-betaalmethode (zoals Sofort) betaalt, brengt Airbnb Payments de verschuldigde Totaalprijs in rekening op het moment van jouw boekingsaanvraag of nadat de Host jouw boekingsaanvraag heeft geaccepteerd. Airbnb kan alternatieve opties aanbieden voor de timing en manier van betalen. Eventuele extra kosten voor het gebruik van die alternatieve betalingsopties staan op het Airbnb-platform en zijn inbegrepen in de Totaalprijs. Je gaat ermee akkoord om die kosten te betalen door de betalingsoptie te selecteren. Aanvullende voorwaarden kunnen van toepassing zijn op het gebruik van een alternatieve betalingsoptie. Als Airbnb Payments niet in staat is om de verschuldigde Totaalprijs te innen, zoals gepland, int Airbnb Payments de verschuldigde Totaalprijs op een later moment, in overeenstemming met Artikel 5.3. Zodra de betaling voor jouw aangevraagde boeking is voltooid, ontvang je een bevestigingsmail.
De beschikbare valuta's voor betalingen kunnen om regelgevende of operationele redenen beperkt zijn op basis van factoren zoals de door jou geselecteerde Betaalmethode, het land waar je woont en/of de contracterende entiteit(en) van Airbnb Payments. Beperkingen worden via het Airbnb-platform gemeld en je wordt gevraagd om een andere valuta of Betaalmethode te selecteren als je voorkeursvaluta niet beschikbaar is.
Als de contracterende entiteit van Airbnb Payments zich in een ander land bevindt dan de aanbieder van jouw Betaalmethode of als de door jou geselecteerde valuta afwijkt van de factureringsvaluta van jouw Betaalmethode, wordt jouw betaling mogelijk verwerkt buiten het land waar je woont. Daarom kan de aanbieder van jouw Betaalmethode bepaalde kosten opleggen en kan het bedrag op het overzicht van jouw Betaalmethode afwijken van het bedrag dat je bij de betaling ziet. Als je bijvoorbeeld boekt met een in de VS uitgegeven kaart, maar euro als valuta selecteert, kan jouw betaling buiten de VS worden verwerkt en kunnen banken en creditcardmaatschappijen internationale transactiekosten en wisselkosten rekenen. Als je ervoor kiest om te betalen met een valuta die afwijkt van de factureringsvaluta van jouw Betaalmethode, kan jouw bank of creditcardmaatschappij het bedrag van de betaling omrekenen naar de factureringsvaluta die aan jouw Betaalmethode is gekoppeld, op basis van een wisselkoers en kosten die uitsluitend door jouw bank worden bepaald. Airbnb Payments is niet verantwoordelijk voor die kosten. Neem contact op met de aanbieder van jouw Betaalmethode als je vragen hebt over deze kosten of de opgelegde wisselkoers.
Als een aangevraagde boeking wordt afgewezen omdat de host deze niet heeft geaccepteerd, jij de aanvraag annuleert voordat de host de boeking heeft geaccepteerd of als Airbnb de boeking annuleert, worden alle bedragen die door Airbnb Payments zijn geïnd en aan jou verschuldigd zijn op grond van de voorwaarden die zijn beschreven in Artikel 5.5, aan jou wordt terugbetaald en een eventuele voorafgaande reservering op jouw Betaalmethode vrijgegeven (indien van toepassing) in overeenstemming met Artikel 5.5.2.
Airbnb Payments behoudt zich het recht voor om betalingen te weigeren of te beperken als we van mening zijn dat die (i) het risicobeheerbeleid of de procedures van Airbnb Payments kunnen schenden, (ii) deze Betalingsvoorwaarden of de Voorwaarden kunnen schenden, (iii) niet-geautoriseerd, frauduleus of illegaal zijn, of (iv) jou, Airbnb, Airbnb Payments of anderen blootstellen aan risico's die onaanvaardbaar zijn voor Airbnb Payments.
Betaalmethoden kunnen het gebruik van externe betalingsdienstaanbieders met zich meebrengen. Deze betalingsdienstaanbieders kunnen extra kosten in rekening brengen wanneer ze betalingen verwerken in verband met de Betalingsdiensten. Airbnb Payments is niet verantwoordelijk voor die kosten en wijst alle aansprakelijkheid daarvoor af. Aanvullende gebruiksvoorwaarden kunnen van toepassing zijn op jouw Betaalmethode. Controleer die voordat je de Betaalmethode gebruikt.
Airbnb Payments is niet verantwoordelijk voor verlies als gevolg van verkeerde door jou verstrekte betaalmethodegegevens. Airbnb Payments biedt geen gereguleerde Betaaldiensten.
2.11.1.1
Airbnb kan Gasten de mogelijkheid bieden om een deel van de Totaalprijs op het moment van de boeking te betalen en de rest vóór de aankomst ('Een deel nu en de rest later'). De beschikbaarheid van deze optie is afhankelijk van de Advertentie en/of Betaalmethode. Er worden geen extra kosten in rekening gebracht voor Een deel nu en de rest later.
2.11.1.2
Als je kiest voor Een deel nu en de rest later, stelt het Airbnb-platform je tijdens de betaalprocedure op de hoogte van het bedrag, de valuta en het tijdstip van elke verschuldigde betaling. Airbnb-tegoeden, tegoedbonnen of cadeaubonnen worden verrekend voordat het bedrag van elke betaling wordt berekend. Op de uiterste betaaldatum brengt Airbnb Payments automatisch het bedrag in rekening via de Betaalmethode die je bij de boeking hebt gebruikt.
2.11.1.3
Als je een wijziging aanbrengt in een boeking met Een deel nu en de rest later, stelt Airbnb je op de hoogte van het herziene betalingsschema (voor zover van toepassing) en brengt Airbnb Payments op de herziene betaaldatums automatisch het bedrag in rekening via de Betaalmethode die je hebt gebruikt om te boeken. Als de wijziging jouw Totaalprijs verhoogt, kan je worden gevraagd om op het moment van de wijziging een extra gedeeltelijke betaling van de nieuwe Totaalprijs uit te voeren.
2.11.1.4
Als je Een deel nu en de rest later kiest, stem je ermee in dat je niet via een andere Betaalmethode of volgens een ander betaalschema voor de boeking kunt betalen.
2.11.1.5
Als Airbnb Payments niet in staat is om jouw betaling te innen, stelt Airbnb Payments je daarvan op de hoogte. Je moet dan binnen 72 uur na de kennisgeving via een andere Betaalmethode betalen. Als je de betaling niet voltooit, machtig je Airbnb om de boeking namens jou te annuleren. Als de boeking wordt geannuleerd, word je terugbetaald op basis van de annuleringsvoorwaarden van de Host.
2.11.2.1
Voor bepaalde boekingen (zoals voor boekingen van achtentwintig (28) nachten of langer) kan Airbnb Payments een gast vragen om terugkerende, oplopende betalingen te doen voor de verschuldigde Totaalprijs ('Terugkerende betalingen'). Meer informatie over Terugkerende betalingen (waaronder het bedrag en de frequentie daarvan) wordt beschikbaar gemaakt via het Airbnb-platform, als dit van toepassing is op een boeking.
2.11.2.2
Als Terugkerende betalingen van toepassing zijn op een bevestigde boeking, machtigt de gast Airbnb Payments om de verschuldigde Totaalprijs te innen.
2.11.2.3
Gasten kunnen een Terugkerende betaling stopzetten door Airbnb Payments ten minste drie (3) werkdagen voor de geplande betaaldatum mondeling of schriftelijk daarvan op de hoogte te stellen. Airbnb Payments kan je vragen om een mondelinge kennisgeving binnen veertien (14) dagen schriftelijk te bevestigen. Als je dit niet binnen die veertien (14) dagen doet, is Airbnb Payments niet verplicht om jouw verzoek in te willigen. Heb je nog vragen over jouw Terugkerende betalingen? Gasten kunnen soms een Accommodatieboeking betalen op krediet of via andere afbetalingsopties voor gespreide betalingen ('Koop nu, betaal later'). Deze Betaalmethoden worden aangeboden door Klarna Bank AB (of een gelieerde entiteit), niet door Airbnb, en Klarna wordt jouw schuldeiser voor de betaling. Hiervoor gelden aanvullende gebruiksvoorwaarden die bij de betaling worden vermeld. Afhankelijk van de Betaalmethode ontstaat hierdoor ook een aparte relatie tussen jou als kredietnemer en Klarna als kredietverstrekker. Lees alle toepasselijke aanvullende voorwaarden door voordat je deze Betaalmethoden gebruikt.
Airbnb Payments int over het algemeen de Totaalprijs van een boeking op het moment dat de boekingsaanvraag van de Gast door de Host wordt geaccepteerd, tenzij anders vermeld.
Om een Uitbetaling te ontvangen, moet je een geldige Uitbetalingsmethode aan jouw Airbnb-account gekoppeld hebben. Wanneer je een Uitbetalingsmethode aan jouw Airbnb-account toevoegt, wordt je mogelijk gevraagd om aanvullende informatie, zoals jouw naam, legitimatiebewijs, fiscaal identificatienummer, factureringsadres en de gegevens van het financiële instrument te verstrekken aan Airbnb Payments of de externe betalingsverwerker(s). Afhankelijk van de geselecteerde Uitbetalingsmethode kan aanvullende informatie nodig zijn, zoals: woonadres, naam op de rekening, rekeningtype, routingnummer, rekeningnummer, e-mailadres, uitbetalingsvaluta, identificatienummer en rekeninggegevens die aan een bepaalde betalingsverwerker zijn gekoppeld. Het verstrekken van de gevraagde informatie is vereist, anders is een Uitbetalingsmethode niet geldig. De informatie die Airbnb Payments nodig heeft voor een geldige Uitbetalingsmethode kan veranderen en Airbnb Payments kan op elk moment om aanvullende informatie vragen. Als je die informatie niet geeft, kan dat ertoe leiden dat Airbnb Payments een Uitbetaling tijdelijk inhoudt, opschort of annuleert totdat de informatie is verstrekt en, indien nodig, is gevalideerd.
Je machtigt Airbnb Payments om de gegevens van jouw Uitbetalingsmethode te verzamelen en op te slaan in overeenstemming met het Privacybeleid van Airbnb. Airbnb Payments kan jouw gegevens ook delen met overheidsinstanties als dat wettelijk verplicht is.
Onder voorbehoud van en afhankelijk van de succesvolle ontvangst van de bijbehorende betalingen van de Gast, maakt Airbnb Payments Uitbetalingen over naar de door jou geselecteerde Uitbetalingsmethode: (i) voor Accommodaties, vóór het einde van de werkdag na de geplande aankomstdatum van de Gast; (ii) voor Ervaringen, vóór het einde van de werkdag na het begin van de Ervaring; en (iii) voor alle andere Host Services, op het tijdstip dat is aangegeven via het Airbnb-platform. Voor boekingen van achtentwintig (28) nachten of langer geeft Airbnb Payments over het algemeen de eerste uitbetaling vrij vóór het einde van de werkdag na de geplande aankomstdatum van de Gast. Toekomstige uitbetalingen gebeuren maandelijks na de eerste uitbetaling zolang de boeking duurt.
Airbnb Payments kan je een ander Uitbetalingstijdstip of een andere trigger bieden voor betaling via het Airbnb-platform. De tijd die het kost om Uitbetalingen te ontvangen zodra deze zijn vrijgegeven door Airbnb Payments kan afhangen van de door jou geselecteerde Uitbetalingsmethode.
Jouw Uitbetaling voor een boeking bestaat uit de Totaalprijs verminderd met de toepasselijke kosten, zoals de Airbnb-servicekosten, de toepasselijke belastingen en alle bedragen die je toewijst aan een co‑host, de eigenaar(s) van een Accommodatie, een VvE en/of hun vertegenwoordiger (zoals een vastgoedbeheerder). Bij annulering van een bevestigde boeking betaalt Airbnb Payments het bedrag dat aan je verschuldigd is (indien van toepassing), zoals bepaald in de Voorwaarden en de toepasselijke annuleringsvoorwaarden.
Airbnb Payments kan een Uitbetaling tijdelijk inhouden, opschorten of annuleren om onwettige activiteiten of fraude te voorkomen en voor risicobeoordeling, beveiliging of de voltooiing van een onderzoek, of als we niet in staat zijn om je identiteit of, indien van toepassing, de identiteit van jouw vertegenwoordiger(s) of uiteindelijk belanghebbende(n) te verifiëren, of om de gevraagde informatie te krijgen of te verifiëren. Bovendien kan Airbnb Payments een Uitbetaling die we volgens de Voorwaarden aan jou verschuldigd zijn, tijdelijk inhouden, opschorten of uitstellen als gevolg van een groot aantal annuleringen of wijzigingen van boekingen als gevolg van een geval van Overmacht (zoals hieronder gedefinieerd).
Airbnb Payments maakt jouw Uitbetalingen over in de valuta die van toepassing is op de door jou geselecteerde Uitbetalingsmethode. De beschikbare valuta's kunnen om regelgevende of operationele redenen beperkt zijn op basis van factoren zoals de door jou geselecteerde Uitbetalingsmethode, het land waar je woont en/of de contracterende entiteit(en) van Airbnb. Dergelijke beperkingen worden via het Airbnb-platform gecommuniceerd en je wordt gevraagd om een andere valuta of Uitbetalingsmethode te selecteren. Betalingsdienstaanbieders kunnen transactie- of wisselkosten of andere kosten in rekening brengen op basis van de valuta of Uitbetalingsmethode die je selecteert. Airbnb Payments is niet verantwoordelijk voor die kosten en wijst alle aansprakelijkheid daarvoor af.
Airbnb Payments kan om wegens nalevings- of operationele redenen het bedrag van een Uitbetaling beperken. Als een aan jou verschuldigd bedrag boven die grens ligt, kan Airbnb Payments een reeks Uitbetalingen doen (mogelijk over meerdere dagen) om jouw volledige Uitbetalingsbedrag te voldoen.
Uitbetalingsmethoden kunnen samengaan met het gebruik van externe betalingsdienstaanbieders. Deze betalingsdienstaanbieders kunnen extra kosten in rekening brengen wanneer ze Uitbetalingen verwerken in verband met de Betalingsdiensten (inclusief het inhouden van kosten op het Uitbetalingsbedrag). Airbnb Payments is niet verantwoordelijk voor die kosten en wijst alle aansprakelijkheid daarvoor af. Aanvullende gebruiksvoorwaarden van dergelijke externe betalingsdienstaanbieders kunnen van toepassing zijn op jouw Uitbetalingsmethode. Lees ze voordat je jouw uitbetalingsmethode gebruikt.
In overeenstemming met Artikel 17 of 18 is Airbnb Payments niet verantwoordelijk voor schade die je oploopt als gevolg van door jou verstrekte onjuiste informatie over je Uitbetalingsmethode.
Als je Host Services samen met een of meerdere andere Hosts aanbiedt als deel van een team, bedrijf of andere organisatie ('Host Team'), kan Airbnb deze Hosts de mogelijkheid bieden om de totale Uitbetaling voor Hosts voor een boeking onder de leden van het Host Team te verdelen. Airbnb Payments voert deze betalingen uit in opdracht van een of meer leden van het Host Team. Hosts zijn verantwoordelijk voor de juistheid van hun instructies.
Als een gast in Duitsland ervoor kiest om een boeking te betalen met de Klarna-optie 'Koop nu, betaal later' (niet de optie Betalen in drie termijnen), zijn deze aanvullende voorwaarden voor Hosts van toepassing.
Elke Host, inclusief elk lid van het Host Team, benoemt hierbij Airbnb Payments als tussenpersoon voor het innen van betalingen voor de Host, alleen voor het beperkte doel om betalingen van Gasten die Host Services afnemen, te accepteren en te verwerken namens de Host.
Elke Host en elk lid van het Host Team, stemt ermee in dat betaling door een Gast via Airbnb Payments wordt beschouwd als een rechtstreekse betaling aan de Host, en de Host moet de Host Service die door de Gast is geboekt op de overeengekomen manier leveren alsof de Host de betaling rechtstreeks van de gast kreeg. Elke Host gaat ermee akkoord dat Airbnb Payments de Gast kan terugbetalen in overeenstemming met de Voorwaarden. Elke Host begrijpt dat de verplichting van Airbnb Payments om de Host te betalen afhankelijk is van de ontvangst van de bijbehorende betalingen van de Gast. Airbnb Payments garandeert betalingen aan Host(s) alleen voor bedragen die door Airbnb Payments van Gasten zijn ontvangen, met inachtneming van aan en in overeenstemming met deze Betalingsvoorwaarden. Bij het accepteren van de benoeming van Airbnb Payments als tussenpersoon voor het innen van de betalingen voor de Host, zijn de verantwoordelijkheden van Airbnb Payments beperkt tot de inhoud van Artikel 4.2. Airbnb Payments is niet verantwoordelijk en aansprakelijk voor de handelingen en nalatigheden van de Host. In overeenstemming met Artikel 11 blijft Airbnb Payments aansprakelijk voor alle handelingen die door eigen nalatigheid zijn veroorzaakt en voor schendingen van jouw rechten als consument onder de toepasselijke wetgeving.
Elke Gast erkent en gaat ermee akkoord dat Airbnb Payments, hoewel zij geen partij is bij de overeenkomst tussen jou en de Host(s), waaronder elk lid van het Host Team, optreedt als tussenpersoon van de Host voor het innen van betalingen voor het beperkte doel om betalingen van jou te accepteren namens de Host(s). Na betaling door een Gast aan Airbnb Payments vervalt de betalingsverplichting van de gast aan de Host(s) voor het overeengekomen bedrag en is Airbnb Payments ervoor verantwoordelijk om de door Airbnb Payments ontvangen bedragen aan de Host(s) over te maken, zoals beschreven in deze Betalingsvoorwaarden. In het geval dat Airbnb Payments deze bedragen niet overmaakt, kan de Host alleen Airbnb Payments aansprakelijk stellen en niet de Gast.
Airbnb Payments kan kosten in rekening brengen voor het gebruik van bepaalde Betalingsdiensten en die kosten staan in de Voorwaarden of worden bekendgemaakt via het Airbnb-platform.
Je machtigt Airbnb Payments om bedragen die verschuldigd zijn op grond van deze Betalingsvoorwaarden en/of de Voorwaarden van je te innen via (i) de Betaalmethode die aan de relevante boeking is gekoppeld, of een andere Betaalmethode die je in jouw Airbnb-account hebt geautoriseerd (tenzij je eerder die machtiging hebt ingetrokken), of (ii) door het bedrag in te houden op een toekomstige Uitbetaling. Je machtigt Airbnb Payments specifiek om het volgende van je te innen:
Als je na een boeking een bedrag verschuldigd bent, zoals kosten voor Een deel nu en de rest later of voor Terugkerende betalingen, Boekingswijzigingen, Betalingen in het Resolutiecentrum of Schaderapporten ('Extra Bedragen'), machtig je en geef je Airbnb Payments een mandaat om betalingen voor dergelijke Extra bedragen te innen via de betaalmethode die aan de relevante boeking is gekoppeld, zonder verdere actie van jouw kant. Airbnb Payments brengt je schriftelijk op de hoogte voordat er extra bedragen in rekening worden gebracht via deze betaalmethode.
Als je Betaalmethode die aan de relevante boeking is gekoppeld verlopen is, ongeldig is of als het bedrag om welke reden dan ook niet op in rekening kan worden gebracht (zoals onvoldoende saldo), blijf je verantwoordelijk voor alle niet-geïnde bedragen en kan Airbnb Payments het bedrag opnieuw in rekening brengen via de Betaalmethode die aan je boeking is gekoppeld of alle andere betaalmethodes gebruiken die aan je account van Airbnb zijn gekoppeld, indien beschikbaar, om die Extra Bedragen te innen. Elk bedrag dat om welke reden dan ook niet wordt geïnd, zal worden onderworpen aan alle rechtsmiddelen die beschikbaar zijn, met inbegrip van, maar niet beperkt tot, doorverwijzing naar een incassobureau of het instellen van rechtsmiddelen ov vorderingen tegen jou.
Als Airbnb redelijkerwijs van mening is dat jij als Host hebt deelgenomen aan frauduleuze activiteiten, zoals oplichting met te veel betaalde bedragen, boekingsfraude of andere fraude, en Airbnb Payments al begonnen is met de Uitbetaling van het verblijf aan jou, kan Airbnb Payments dit bedrag van je terugkrijgen door het bedrag te verminderen, te verrekenen of af te schrijven van toekomstige Uitbetalingen die aan jou verschuldigd zijn.
Naast verschuldigde bedragen zoals hierboven beschreven, kunnen er, als er bedragen zijn die je ons verschuldigd bent maar onbetaald zijn of als er terugvorderingen zijn die verband houden met je Betaalmethode, kosten in rekening worden gebracht die verband houden met het innen van deze bedragen en terugvorderingen door Airbnb Payments. Deze vergoedingen of kosten kunnen incassokosten, administratiekosten of andere kosten van derden omvatten.
Als Airbnb Payments niet in staat is om bedragen te innen die je volgens de Voorwaarden en deze Betalingsvoorwaarden verschuldigd bent als Gast of als Host, kan Airbnb Payments pogingen ondernemen om dergelijke bedragen van je terug te vorderen.
Airbnb Payments beschouwt verschuldigde bedragen als achterstallig als: (a) voor geautoriseerde kosten honderdtwintig (120) dagen zijn verstreken nadat Airbnb Payments voor het eerst probeerde om het bedrag via de betaalmethode voor gasten te innen of nadat de bijbehorende diensten zijn geleverd, afhankelijk van wat later is, en (b) voor inhoudingen op de toekomstige Uitbetalingen van een Host, tweehonderdzeventig (270) dagen zijn verstreken nadat de aanpassing is doorgevoerd op het Airbnb-account van de Host of nadat de bijbehorende diensten zijn geleverd, afhankelijk van wat later is.
Airbnb Payments beschouwt niet-geïnde achterstallige bedragen als in gebreke als driehonderdvijfenzestig (365) dagen zijn verstreken: (a) voor geautoriseerde kosten op je betaalmethode voor een transactie van Gasten, nadat Airbnb Payments voor het eerst probeerde om het bedrag op je Betaalmethode in rekening te brengen of nadat de bijbehorende diensten zijn geleverd, afhankelijk van wat later is; en (b) voor inhoudingen op de toekomstige uitbetalingen van een Host, nadat de aanpassing is doorgevoerd op het Airbnb-account van de Host of nadat de bijbehorende diensten zijn geleverd, afhankelijk van wat later is.
Je stemt er hierbij uitdrukkelijk mee in dat alle communicatie met betrekking tot verschuldigde bedragen per elektronische post of per telefoon zal plaatsvinden, zoals door jou voorzien bij Airbnb en/of Airbnb Payments. Die communicatie kan door Airbnb, Airbnb Payments of door iemand namens hen gebeuren, met inbegrip van maar niet beperkt tot een extern incassobureau.
Airbnb Payments neemt de nodige stappen om fouten in de verwerking van betalingen die opgemerkt worden te corrigeren. Daarvoor kan het bedrag onder andere gecrediteerd of gedebiteerd (zoals van toepassing) worden via de oorspronkelijke Uitbetalingsmethode of Betaalmethode die door jou is gebruikt of geselecteerd, zodat je uiteindelijk het juiste bedrag ontvangt of betaalt. Dit kan gedaan worden door Airbnb Payments of een derde zoals jouw financiële instelling. We kunnen ook stappen ondernemen om geld terug te vorderen dat foutief naar jou is overgemaakt (inclusief maar niet beperkt tot bijvoorbeeld dubbele betalingen als gevolg van een verwerkingsfout). Voor Hosts kan dit bestaan uit de vermindering, verrekening en/of debitering van het bedrag van toekomstige Uitbetalingen die aan jou verschuldigd zijn.
Als je onterecht geld ontvangt, ga je ermee akkoord om dit onmiddellijk terug te storten aan Airbnb Payments.
Alle restituties of tegoeden die krachtens de Voorwaarden, het Beleid bij ingrijpende gebeurtenissen, het Beleid voor omboeken en restitutie, en het Restitutiebeleid voor gasten van ervaringen aan een lid verschuldigd zijn, worden door Airbnb Payments uitgevoerd en overgemaakt in overeenstemming met deze Betalingsvoorwaarden.
Met inachtneming van dit Artikel 5.5.2 zet Airbnb Payments de restitutieprocedure onmiddellijk in gang. Als een Host annuleert, houdt Airbnb Payments het bedrag tot 72 uur vast namens de Host, ofwel tot de Gast terugbetaald is of tot het bedrag gebruikt is voor een boeking bij een andere Host. Airbnb Payments houdt het bedrag nooit vast namens de Gast en verleent de Gast ook geen betalingsdienst. In bepaalde gevallen kan de restitutieprocedure de optie omvatten om tegoed te ontvangen in plaats van een contante terugbetaling. Als je deze mogelijkheid krijgt, staat op het Airbnb-platform hoelang het duurt voordat je de restitutie krijgt. Hoelang het duurt om een contante restitutie te krijgen of om een gereserveerd bedrag op je betaalmethode vrij te geven is afhankelijk van de betaalmethode en de regels van het betreffende betaalsysteem (bijv. Visa, Mastercard enz.). In geval van Overmacht bij de verwerking en afwikkeling van restituties, initieert en verwerkt Airbnb Payments de restitutie zo snel mogelijk.
Als je volgens Artikel 15 van de Voorwaarden verantwoordelijk bent voor de bedragen in het Schaderapport, kan Airbnb met behulp van Airbnb Payments die bedragen innen via de Betaalmethode waarmee je geboekt hebt of via een andere Betaalmethode die op het moment van het Schaderapport (of redelijkerwijs daarna) aan jouw Airbnb-account is gekoppeld, tot een maximumbedrag zoals gedefinieerd in Artikel 15 van de Voorwaarden. Als je een accommodatie boekt, stem je ermee in dat Airbnb met behulp van Airbnb Payments de bedragen uit het Schaderapport kan innen via de Betaalmethode waarmee je hebt geboekt.
Je stemt ermee in dat Airbnb Payments schade bij jou kan verhalen via eventuele verzekeringspolissen die je hebt afgesloten en dat Airbnb Payments ook alle beschikbare rechtsmiddelen tegen je kan inzetten, met inbegrip van, maar niet beperkt tot, een doorverwijzing naar een incassobureau of met het instellen van rechtsmiddelen of rechtsvorderingen tegen jou, ook met betrekking tot een Schaderapport of betalingsverzoeken van Hosts in het kader van de Bescherming voor hosts bij materiële schade.
Als Airbnb Payments bedragen aan jou verschuldigd is en deze bedragen niet aan jou kan betalen ('Verlaten bezit') in overeenstemming met Artikel 7.2, kunnen we, afhankelijk van de toepasselijke wetgeving en de relevante verjaringstermijn, het Verlaten bezit dat anders aan jou verschuldigd was zelf houden en zul je hier geen aanspraak meer op kunnen maken.
Afhankelijk van de toepasselijke wetgeving worden bedragen die Airbnb Payments voor je houdt als Verlaten bezit beschouwd als een van de volgende situaties van toepassing is:
Je bent als enige verantwoordelijk voor de naleving van alle wetten, regels, voorschriften en belastingverplichtingen die van toepassing zijn op jouw gebruik van de Betalingsdiensten. Als gebruiker van onze Betalingsdiensten stem je ermee in dat je het volgende niet mag doen en dat je anderen ook niet helpt dit te doen:
We zijn verplicht om te handelen in overeenstemming met ons interne beleid en de wetten van verschillende rechtsgebieden om witwassen te voorkomen en sancties uit te voeren, waaronder: (i) economische of financiële sancties of handelsembargo's die worden opgelegd, uitgevoerd of gehandhaafd door de Amerikaanse overheid, waaronder die door het Office of Foreign Asset Control of het Amerikaanse ministerie van Buitenlandse Zaken worden uitgevoerd; of (ii) door de Veiligheidsraad van de Verenigde Naties, de Europese Unie of His Majesty's Treasury van het Verenigd Koninkrijk. Je moet voldoen aan alle relevante financiële sancties en alle relevante exportwetgeving die van toepassing zijn op jou en jouw rechtsgebied.
Airbnb Payments is niet aansprakelijk voor enige vertraging of tekortkoming in enige verplichting onder deze Betalingsvoorwaarden als gevolg van abnormale of onvoorzienbare omstandigheden buiten de redelijke controle van Airbnb of Airbnb Payments, waarvan de gevolgen onvermijdelijk zijn ondanks alle inspanningen om het tegendeel te bewerkstelligen, met inbegrip van, maar niet beperkt tot, overmacht, natuurrampen, oorlog, terrorisme, rellen, embargo's, daden van civiele of militaire autoriteiten, brand, overstromingen, ongevallen, pandemieën, epidemieën of ziekten, stakingen of tekorten aan vervoersmogelijkheden, brandstof, energie, arbeid of materialen ('Overmacht').
Als je ervoor kiest om de Betalingsdiensten te gebruiken, dan doe je dit vrijwillig en op eigen risico.
Ongeacht de benoeming van Airbnb Payments als tussenpersoon om betalingen te innen voor beperkte doeleinden bij Hosts op grond van Artikel 4 en met inachtneming van Artikel 11, wijst Airbnb Payments uitdrukkelijk alle aansprakelijkheid af voor enig handelen of nalatigheid door jou, een Lid of een andere derde partij. Airbnb Payments heeft geen plichten of verplichtingen als tussenpersoon voor een Host, behalve voor zover uiteengezet in deze Betalingsvoorwaarden. Eventuele aanvullende wettelijke plichten of verplichtingen zijn, voor zover maximaal toegestaan door de toepasselijke wetgeving, uitdrukkelijk uitgesloten.
Als we ervoor kiezen of verplicht zijn om de identiteit van een Lid te verifiëren, voor zover toegestaan onder de toepasselijke wetgeving, wijzen we alle garanties, expliciet of impliciet, af dat dergelijke controles eerder wangedrag van een Lid zullen ontdekken of zullen garanderen dat een Lid in de toekomst geen wangedrag zal vertonen. Wij zijn niet verantwoordelijk voor eerder wangedrag door een Lid als dergelijk wangedrag bij ons onbekend was.
De voorgaande disclaimers zijn van toepassing toegestaan onder de wet. Mogelijk heb je nog andere wettelijke rechten of garanties die niet rechtmatig kunnen worden uitgesloten. De duur van wettelijk verplichte garanties is echter beperkt tot de maximale termijn (indien aanwezig) die wettelijk is toegestaan.
Met inachtneming van de onderstaande artikelen en voor zover toegestaan door de toepasselijke wetgeving, is de aansprakelijkheid van Airbnb Payment beperkt en ligt het volledige risico dat voortvloeit uit jouw toegang tot en gebruik van de Betalingsdiensten bij jou. Als je een andere persoon toestaat of machtigt om jouw Airbnb-account op welke manier dan ook te gebruiken, ben jij verantwoordelijk voor wat die persoon ermee doet.
Airbnb Payments is niet aansprakelijk voor eventueel verlies wanneer dat te wijten is aan de naleving door Airbnb Payments van wettelijke verplichtingen. Airbnb Payments is ook niet aansprakelijk voor eventueel verlies als gevolg van handelen of nalatigheid van jou of een ander Lid, met inbegrip van maar niet beperkt tot een schending van deze Betalingsvoorwaarden of van de toepasselijke wetgeving, of als jij of een ander Lid frauduleus of nalatig heeft gehandeld.
Niets in deze Betalingsvoorwaarden beperkt de aansprakelijkheid van Airbnb Payments voor: (i) overlijden of persoonlijk letsel als gevolg van enig handelen of onachtzaamheid van Airbnb Payments; (ii) fraude of frauduleuze voorstelling van zaken; (iii) opzettelijk wangedrag of grove nalatigheid; (iv) verlies dat rechtstreeks wordt veroorzaakt door schending van deze Betalingsvoorwaarden door Airbnb Payments; of (v) enige andere aansprakelijkheid die niet kan worden uitgesloten of beperkt onder toepasselijk recht (waaronder bijvoorbeeld een schending van consumentenrechten of van betalingswet- en regelgeving).
Airbnb Payments is in geen geval aansprakelijk voor verlies van omzet, verlies van goodwill, misgelopen kansen of misgelopen winst.
Voor zover Airbnb Payments niet of beperkt aansprakelijk is, geldt dit ook voor de persoonlijke aansprakelijkheid van de wettelijke vertegenwoordigers, medewerkers en andere vertegenwoordigers.
Voor zover toegestaan onder de toepasselijke wetgeving, ga je ermee akkoord om Airbnb Payments, gelieerde ondernemingen en dochterondernemingen, en hun functionarissen, directeuren, medewerkers en vertegenwoordigers, vrij te stellen, te verdedigen (naar keuze van Airbnb Payments) en te vrijwaren van en tegen eventuele vorderingen, aansprakelijkheden, schade, verliezen en kosten, met inbegrip van, maar niet beperkt tot, redelijke juridische en boekhoudkundige kosten, die voortvloeien uit (i) jouw schending van deze Betalingsvoorwaarden; (ii) jouw onjuiste gebruik van de Betalingsdiensten; (iii) jouw falen, of ons falen op jouw instructie, om belastingen nauwkeurig aan te geven, te innen of af te dragen; of (iv) jouw schending van enige wet- en regelgeving of rechten van derden. De vrijwaringsverplichting is alleen van toepassing als en voor zover de vorderingen, aansprakelijkheden, schade, verliezen en kosten zijn veroorzaakt door jouw nalatigheid of schending van een contractuele verplichting.
We kunnen deze Betalingsvoorwaarden op elk moment wijzigen door je ten minste twee (2) maanden van tevoren op de hoogte te stellen van dergelijke wijzigingen. We stellen je op de hoogte van de voorgestelde wijzigingen via e-mail, via het Airbnb-platform, de berichtenfunctie of een andere contactmethode die wij beschikbaar stellen en die door jou is geselecteerd, en door de herziene Betalingsvoorwaarden op het Airbnb-platform te plaatsen. Je kunt de herziene Betalingsvoorwaarden bekijken, opslaan en afdrukken via de link op het Airbnb-platform. Er wordt van uitgegaan dat je de wijzigingen in deze Betalingsvoorwaarden hebt geaccepteerd, tenzij je deze Betalingsvoorwaarden beëindigt of jouw account op Airbnb (zonder sanctie) sluit vóórdat de opzegtermijn van twee (2) maanden verloopt en voordat de wijzigingen van kracht worden. Als je ervoor kiest om deze Betalingsvoorwaarden te beëindigen of je account op Airbnb te sluiten, moet je nog steeds aan al jouw openstaande verplichtingen onder de Voorwaarden voldoen, ook voor aankomende boekingen of Host Services.
Deze overeenkomst tussen jou en Airbnb Payments is van kracht (i) als je een gast bent, vanaf je eerste boeking; of (ii) als je een Host bent, vanaf het moment dat een gast voor het eerst een door jou beschikbaar gestelde accommodatie boekt en je de Betalingsdiensten gebruikt, en blijft van kracht totdat jij of Airbnb deze overeenkomst beëindigt in overeenstemming met Artikel 13.3.
Je kunt deze overeenkomst op elk gewenst moment beëindigen door ons een e-mail te sturen of door jouw account op Airbnb te verwijderen. Onverminderd onze hieronder vermelde rechten, kan Airbnb Payments Luxembourg deze overeenkomst op elk gewenst moment en om welke reden dan ook beëindigen door je twee (2) maanden van tevoren op de hoogte te stellen. Airbnb Payments UK kan deze overeenkomst op elk gewenst moment en om welke reden dan ook beëindigen door je negentig (90) dagen van tevoren op de hoogte te stellen. Airbnb Payments kan deze overeenkomst ook onmiddellijk en zonder kennisgeving beëindigen als (i) je jouw verplichtingen onder deze overeenkomst ernstig hebt geschonden, (ii) je onjuiste, frauduleuze, verouderde of onvolledige informatie hebt verstrekt, (iii) je toepasselijke wet- en regelgeving of rechten van derden hebt geschonden, of (iv) Airbnb Payments te goeder trouw van mening is dat een dergelijke actie redelijkerwijs noodzakelijk is om andere leden, Airbnb, Airbnb Payments of derden te beschermen. Als jij of Airbnb Payments deze overeenkomst beëindigt, wordt jouw account op Airbnb ook beëindigd in overeenstemming met de Voorwaarden.
Airbnb Payments kan jouw gebruik van of toegang tot de Betalingsdiensten beperken of tijdelijk of permanent opschorten (i) om te voldoen aan toepasselijke wetgeving, of aan een bevel of verzoek van een rechtbank, wetshandhavingsinstantie of een andere administratieve instantie of overheidsinstantie, (ii) als je deze Betalingsvoorwaarden, de Voorwaarden, toepasselijke wetten, regelgeving of rechten van derden hebt geschonden, (iii) als je onjuiste, frauduleuze, verouderde of onvolledige informatie hebt verstrekt over een betaalmethode of uitbetalingsmethode, (iv) als je onder deze Betalingsvoorwaarden bedragen verschuldigd bent die achterstallig of in gebreke zijn, of (v) als Airbnb Payments te goeder trouw van mening is dat een dergelijke actie redelijkerwijs noodzakelijk is om de veiligheid van personen of eigendommen van Airbnb, de leden, Airbnb Payments of derden te beschermen, of om fraude of andere illegale activiteiten te voorkomen. We kunnen jouw toegang tot de Betalingsdiensten ook tijdelijk opschorten als een betaling mislukt is door het verlopen van de kaart, onvoldoende saldo of een andere reden totdat we het bedrag bij een geldige betaalmethode in rekening kunnen brengen.
Als Airbnb Payments een van de in Artikel 13.3 en 13.4 beschreven maatregelen neemt, kun je bezwaar maken tegen de beslissing door contact op te nemen met het supportteam.
Als je jouw Airbnb-account als Host annuleert of als Airbnb Payments een van de hierboven beschreven maatregelen neemt, kan Airbnb Payments een volledige restitutie geven aan gasten met bevestigde boekingen en heb je geen recht op compensatie voor openstaande of bevestigde boekingen die zijn geannuleerd. Als je jouw account op Airbnb als Gast opzegt, geeft Airbnb Payments restitutie voor alle bevestigde boekingen op basis van de annuleringsvoorwaarden van de advertentie. Als jouw toegang tot of gebruik van de Betalingsdiensten is opgeschort of beperkt of als deze overeenkomst door ons is beëindigd, mag je geen nieuw account op Airbnb registreren en mag je ook niet proberen om de Betalingsdiensten te openen en te gebruiken via een account van een ander lid van Airbnb.
Artikelen 5 tot en met 20 van deze Betalingsvoorwaarden blijven van kracht na de beëindiging of afloop van deze overeenkomst.
Als je een overeenkomst aangaat met Airbnb Payments UK gelden deze Betalingsvoorwaarden in overeenstemming met Engels recht. Als je optreedt als consument en de dwingende regelgeving inzake consumentenbescherming in het land waar je woont bepalingen bevat die gunstiger zijn voor jou, zijn die bepalingen van toepassing, ongeacht de keuze voor Engels recht. Als consument kun je een gerechtelijke procedure met betrekking tot deze Betalingsvoorwaarden starten bij de bevoegde rechtbank van jouw woonplaats of bij een rechtbank in Engeland. Als Airbnb een van haar rechten tegen jou als consument wil afdwingen, kan dit alleen bij de rechtbanken van het rechtsgebied waarin je woont. Als je optreedt als bedrijf, ga je ermee akkoord dat de rechtbanken in Engeland exclusief bevoegd zijn.
Als je een overeenkomst aangaat met Airbnb Payments Luxembourg gelden deze Betalingsvoorwaarden in overeenstemming met Luxemburgs recht. Als je optreedt als consument en de verplichte regelgeving inzake consumentenbescherming in het land waar je woont bepalingen bevat die gunstiger zijn voor jou, zijn die bepalingen van toepassing, ongeacht de keuze voor Luxemburgs recht. Als consument kun je een gerechtelijke procedure met betrekking tot deze Betalingsvoorwaarden starten bij de bevoegde rechtbank van je woonplaats of een rechtbank in Luxemburg. Als Airbnb een van haar rechten tegen jou als consument wil afdwingen, kan dit alleen bij de rechtbanken van het rechtsgebied waarin je woont. Als je optreedt als bedrijf, ga je ermee akkoord dat de rechtbanken in Luxemburg exclusief bevoegd zijn.
LEES DE VOLGENDE PARAGRAFEN ZORGVULDIG, OMDAT HIERIN WORDT BEPAALD DAT JIJ EN AIRBNB PAYMENTS AFSPREKEN OM ALLE GESCHILLEN ONDERLING OP TE LOSSEN DOOR MIDDEL VAN BINDENDE INDIVIDUELE ARBITRAGE EN EEN VERKLARING VAN AFSTAND VAN GROEPSVORDERING EN JURYRECHTSPRAAK BEVATTEN. Deze Arbitrageovereenkomst vervangt alle voorgaande versies.
Deze Arbitrageovereenkomst is alleen op jou van toepassing als je een overeenkomst aangaat met Airbnb Payment US. Als je geen contract aangaat met Airbnb Payments US, en je toch probeert om een rechtsvordering te starten tegen Airbnb Payments in de Verenigde Staten, is deze Arbitrageovereenkomst van toepassing voor het bepalen van de drempel of dit Artikel 15 op jou van toepassing is, en op alle andere drempelbepalingen, inclusief woonplaats, arbitreerbaarheid, locatie en toepasselijke wetgeving.
Airbnb Payments doet er alles aan om de procedure voor geschillenbeslechting consumentenvriendelijk te houden. Deze Betalingsvoorwaarden voorzien daarom een tweeledige procedure voor personen op wie dit Artikel 15 van toepassing is: (1) een informele onderhandeling rechtstreeks met het klantenserviceteam Airbnb (beschreven in Artikel 15.3), en indien nodig (2) een bindende arbitrage in overeenstemming met de voorwaarden van deze Arbitrageovereenkomst. Jij en Airbnb Payments behouden elk het recht om het geschil te beslechten in een procedure voor geringe vorderingen als alternatief voor arbitrage.
Ten minste 30 dagen vóór de start van een arbitrage stemmen jij en Airbnb Payments er beide mee in om de andere partij een geïndividualiseerde schriftelijke kennisgeving van het geschil te sturen ('Kennisgeving vooraf') en te goeder trouw te proberen een informele oplossing te vinden voor de individuele vordering. Je moet jouw Kennisgeving vooraf naar Airbnb Payments sturen door deze naar de gemachtigde van Airbnb Payments te sturen: CSC Lawyers Incorporating Service, 2710 Gateway Oaks Drive, Suite 150N, Sacramento, Californië 95833. Airbnb Payments stuurt de Kennisgeving vooraf naar het e-mailadres dat aan jouw account op Airbnb is gekoppeld. Een Kennisgeving vooraf moet het volgende bevatten: de datum, jouw naam, jouw postadres, jouw gebruikersnaam van Airbnb, het e-mailadres waarmee je jouw account op Airbnb hebt aangemaakt, jouw handtekening, een korte beschrijving van het geschil en de voorgestelde oplossingen. Pas als de partijen het geschil niet kunnen oplossen binnen de periode van 30 dagen, kan elk van de partijen arbitrage beginnen door een schriftelijk verzoek in te dienen bij de arbiter die is aangewezen in lijn met Artikel 15.6 hieronder. De Kennisgeving vooraf is voor de eiser verplicht voor elke arbitrage. Een kopie van deze Kennisgeving vooraf en het bewijs dat deze is verzonden, moeten zoals vereist door dit Artikel bij elk arbitrageverzoek worden gevoegd.
Jij en Airbnb Payments zijn het er over eens dat elk geschil dat of elke vordering die voortvloeit uit of verband houdt met deze Betalingsvoorwaarden of de toepasselijkheid, schending, beëindiging, geldigheid, handhaving of interpretatie daarvan, of van elk gebruik van de Betalingsdiensten (gezamenlijk 'Geschillen') wordt beslecht door bindende arbitrage op individuele basis (de 'Arbitrageovereenkomst'). Als er een geschil is over de vraag of deze arbitrageovereenkomst afdwingbaar of van toepassing is op ons geschil, komen jij en Airbnb Payments overeen dat de arbiter over deze kwestie beslist. Om twijfel te voorkomen, stemmen jij en Airbnb ermee in dat elke vraag over de arbitreerbaarheid en de vorming, afdwingbaarheid, geldigheid, reikwijdte of interpretatie van Artikel 15 of een deel daarvan, inclusief elk geschil over de naleving van de vereiste Kennisgeving vooraf en de verantwoordelijkheid van een partij om arbitragekosten te betalen, uitsluitend beslist wordt door een arbiter.
Jij en Airbnb Payments komen overeen dat de volgende rechtsmiddelen en rechtsvorderingen uitzonderingen zijn op de Arbitrageovereenkomst en zullen worden behandeld in een gerechtelijke procedure bij een bevoegde rechtbank (zoals gedefinieerd in Artikel 15): (i) elk rechtsmiddel of rechtsvordering waarbij een voorlopige voorziening wordt gevraagd op basis van urgente omstandigheden (bijv. dreigend gevaar of een misdrijf, hacken, cyberaanval), (ii) een verzoek om een gerechtelijk bevel, (iii) een rechtsvordering of rechtsmiddel wegens agressief procederen, of (iv) elke individuele vordering van seksuele aanranding of intimidatie die voortvloeit uit jouw gebruik van het Airbnb-platform of de Host Services. Jij en Airbnb Payments gaan ermee akkoord dat elk verzoek om een gerechtelijk bevel zal worden behandeld na de arbitrage van alle arbitreerbare rechtsvorderingen of rechtsmiddelen van de arbitrage op grond van Artikel 3 van de Federal Arbitration Act.
Deze Arbitrageovereenkomst gaat over grensoverschrijdende handel. De Federal Arbitration Act, en niet de wetgeving van de staat, regelt alle inhoudelijke en procedurele interpretatie en handhaving van deze Arbitrageovereenkomst. De arbitrage wordt geregeld door ADR Services, Inc. ('ADR') (www.adrservices.com) in overeenstemming met regels 1, 6-7, 8-9 en 11-12, 45, 54 en 56 van de Federal Rules of Civil Procedure ('Selected Federal Rules') (https://www.uscourts.gov/rules-policies/current-rules-practice-procedure/federal-rules-civil-procedure) en de dan geldende ADR-arbitrageregels (de 'ADR-regels'), behalve als de Selected Federal Rules of ADR-regels worden gewijzigd door of in strijd zijn met deze Arbitrageovereenkomst. De ADR-regels staan op www.adrservices.com. Als een arbitrageverzoek wordt ingediend bij ADR Services in overeenstemming met deze overeenkomst en de ADR-regels, en ADR Services kan of wil de arbitrage niet uitvoeren, dan wordt de arbitrage geregeld door de American Arbitration Association ('AAA') in overeenstemming met de Selected Federal Rules en de Consumer Arbitration Rules van de AAA (de 'AAA-regels') die dan van kracht zijn, behalve voor zover hier gewijzigd. De AAA-regels staan op www.adr.org. Als de AAA de arbitrage niet kan en wil uitvoeren, selecteren jij en Airbnb Payments in overleg een alternatieve arbitragecommissie. Als we het niet eens kunnen worden, kunnen jij of Airbnb Payments een rechtbank vragen om een arbiter te benoemen op grond van 9 U.S.C. § 5. In dat geval wordt de arbitrage gevoerd volgens de regels van de aangewezen arbitragecommissie, tenzij die regels in strijd zijn met deze Arbitrageovereenkomst.
Om de arbitrage zo kosteneffectief, efficiënt en gemakkelijk mogelijk te maken, wordt elke arbitragezitting waarbij het over een bedrag van minder dan 1.000.000 dollar gaat op afstand uitgevoerd via een videoconferentie, tenzij anders overeengekomen door de partijen of bepaald door de arbiter. Elke arbitragezitting over een bedrag van meer dan 1.000.000 dollar vindt plaats in San Francisco County, tenzij anders overeengekomen door de partijen of bepaald door de arbiter. Als het over een bedrag van 10.000 dollar of minder gaat, stemmen de partijen ermee in om alleen documenten bij de arbiter in te dienen, onder de voorwaarde dat de arbiter alsnog kan beslissen om een hoorzitting te houden op een redelijk en evenredig verzoek van een van de partijen.
Jouw arbitragekosten en jouw deel van de arbitragevergoeding worden bepaald door de ADR-regels en het vergoedingsschema van ADR Services (beschikbaar op www.adrservices.com). Als je een bruto maandinkomen hebt van minder dan 300% van de nationale armoedegrens, heb je recht op kwijtschelding van de arbitragekosten, met uitzondering van de kosten voor de arbiter. Je kunt dit aanvragen door aan de arbiter een beëdigde verklaring te verstrekken met daarop jouw maandinkomen en het aantal personen in jouw huishouden. Als de arbiter je vrijstelt van de kosten en je Airbnb Payments bewijsmateriaal verstrekt waaruit blijkt dat je bruto maandinkomen minder dan 300% van de nationale armoedegrens bedraagt, betaalt Airbnb Payments jouw deel van de kosten voor de arbiter.
Elke partij kan de arbiter verzoeken om sancties op te leggen als die partij bewijst dat de vordering of het verweer van de (advocaat van de) andere partij feitelijk onjuist of juridisch ongegrond is, te kwader trouw of bewust intimiderend is, of anderszins onzinnig is. Voor zover toegestaan onder de toepasselijke wetgeving, legt de arbiter sancties op gelijk aan de redelijke advocatenkosten van de verzoekende partij als wordt vastgesteld dat een vordering of verweer feitelijk onjuist of wettelijk ongegrond is, te kwader trouw of bewust intimiderend is, in strijd is met de Fed. R. Civ. P. 11(b) (waarbij de arbiter als 'de rechtbank' wordt behandeld), of anderszins onzinnig is. Elke partij kan om afwijzing verzoeken van een arbitrage die in strijd is met een bepaling van deze Arbitrageovereenkomst. Elke partij kan in de arbitrage een tegenvordering indienen als de andere partij een procedure over een arbitreerbaar Geschil is gestart zonder te voldoen aan of dat anderszins in strijd is met de vereisten van deze Arbitrageovereenkomst. Als de arbiter vaststelt dat een partij een arbitreerbaar Geschil is gestart zonder te voldoen aan of dat in strijd is met de vereisten van deze Arbitrageovereenkomst, dan kent de arbiter de andere partij een vergoeding van de werkelijke schadevergoeding toe, inclusief maar niet beperkt tot redelijke advocatenkosten.
De arbiter zal een schriftelijke beslissing geven met de essentiële bevindingen en conclusies waarop de uitspraak is gebaseerd. De beslissing van de arbiter kan worden overgenomen door elke bevoegde rechtbank. De arbiter kan elke vordering toekennen die onder de wetgeving of de AAA-regels is toegestaan, maar een declaratoire of voorlopige uitspraak kan alleen op individuele basis worden gedaan en alleen voor zover nodig om een oplossing te bieden voor de individuele vordering van de eiser.
Jij en Airbnb Payments erkennen en stemmen ermee in dat beide partijen afstand doen van het recht op juryrechtspraak met betrekking tot alle arbitreerbare Geschillen.
Jij en Airbnb Payments erkennen en stemmen ermee in dat we, voor zover toegestaan door de wet, beide afstand doen van het recht om als eiser of groepslid deel te nemen aan een vermeende groepsvordering, groepsbrede arbitrage, 'private attorney general'-procedure of enige andere vertegenwoordigende of geconsolideerde procedure. Tenzij we schriftelijk akkoord gaan of zo is bepaald in deze overeenkomst, mag de arbiter slechts vorderingen van één partij consolideren en mag die op geen enkele andere manier enige vorm van een groepsprocedure- of een representatieve procedure voorzitten. In geval van een definitieve gerechtelijke uitspraak waaruit blijkt dat het toepasselijke recht de tenuitvoerlegging van de verklaring van afstand in deze paragraaf uitsluit met betrekking tot een vordering, rechtsmiddel of eis, dan zal uitsluitend die vordering, het rechtsmiddel of die eis worden gescheiden van deze Arbitrageovereenkomst en worden voorgelegd aan een bevoegde rechtbank. Als een vordering, rechtsmiddel of eis wordt gescheiden op grond van deze paragraaf, dan komen jij en wij overeen dat de vorderingen, rechtsmiddelen of eisen die niet onderhevig zijn aan arbitrage, worden opgeschort totdat over alle arbitreerbare vorderingen, rechtsmiddelen of eisen is beslist door de arbiter.
Jij en Airbnb Payments erkennen en stemmen ermee in dat de relatieve voordelen en de efficiëntie van arbitrage verloren gaan wanneer 100 of meer arbitrageclaims binnen 180 dagen worden ingediend (1) waarbij dezelfde of vergelijkbare partijen betrokken zijn; (2) die gebaseerd zijn op dezelfde of vergelijkbare vorderingen die voortvloeien uit dezelfde of nagenoeg identieke transacties, incidenten, vermeende schendingen of gebeurtenissen rondom nagenoeg identieke juridische of feitelijke vraagstukken; en (3) waarbij dezelfde of gecoördineerde juridische bijstand van de partijen betrokken is ('Groepsvordering'). Daarom stemmen jij en Airbnb Payments ermee in om af te zien van het recht om een Geschil als een Groepsvordering te laten behandelen, beslechten of oplossen (hoewel Artikelen 15 en 15.12 van deze Voorwaarden van toepassing blijven op het Geschil). In geval van een geschil zal de benoemde arbiter voor de eerste zaak die onderdeel is van een reeks vorderingen van één van beide partijen beslissen of die vorderingen deel uitmaken van een Groepsvordering. Als er nog geen arbiter is, wordt er een aangesteld die uitsluitend door een van beide partijen geïdentificeerde vorderingen deel uitmaken van een Groepsvordering. Niets in deze bepaling weerhoudt jou of Airbnb Payments ervan om deel te nemen aan een groepsschikking.
Als er om welke reden dan ook, niettegenstaande Artikel 15.13, arbitrage van een Groepsvordering plaatsvindt, voegen de partijen de arbitrage-vorderingen samen in een groep van niet meer dan 200 vorderingen. Deze groepen worden gevormd op alfabetische volgorde van de eisers (op achternaam of bedrijfsnaam, indien van toepassing). De eerste 200 vermelde eisers zijn bijvoorbeeld de eerste groep, de volgende 200 vermelde eisers zijn de tweede groep, enzovoort. De partijen geven elke groep een volgnummer. De groepen worden los van elkaar behandeld in opeenvolgende volgorde. Tijdens de arbitrage van een groep, schort de arbiter de rest van de groepen op, tenzij anders is overeengekomen door de partijen of bepaald door de arbiter. Elke groep wordt binnen 240 dagen na de voorbereidende hoorzitting voor die groep afgehandeld. Ondanks voorgaande, als de vordering van een rechthebbeiserende geen onderdeel is geweest van een voorbereidende hoorzitting in de twee jaar na de laatst ingediende vordering in de Groepsvordering, kan die eiser ervoor kiezen om de vorderingen voor de rechtbank te brengen, met inachtneming van Artikelen 14 en 15.12 van deze Voorwaarden.
Ten minste tien dagen voor de arbitragehoorzitting kunnen jij of Airbnb Payments de andere partij een schriftelijk vonnisvoorstel sturen om een vonnis onder specifieke voorwaarden mogelijk te maken. als het voorstel wordt geaccepteerd, wordt dit met bewijs van aanvaarding voorgelegd aan de arbiter, die op basis daarvan een uitspraak doet. Als het voorstel niet wordt geaccepteerd vóór de arbitragezitting of binnen 30 dagen nadat het voorstel is gedaan, afhankelijk van wat zich het eerst voordoet, wordt dit als ingetrokken beschouwd en kan het niet als bewijs worden gebruikt in de arbitrage, behalve met betrekking tot de kosten (inclusief alle vergoedingen die aan de arbiter zijn betaald). Als een voorstel niet door de andere partij wordt geaccepteerd en de uitspraak voor hen nadeliger uitpakt, moet deze andere partij de eigen kosten en die van de tegenpartij betalen (inclusief alle kosten die aan de arbiter zijn betaald) vanaf het moment van het voorstel.
Met uitzondering van de bepalingen in artikel 15.12, zal, indien enig deel van deze Arbitrageovereenkomst als onwettig of niet-afdwingbaar wordt beschouwd, die bepaling worden gescheiden en blijft de rest van de arbitrageovereenkomst volledig van kracht.
Als Airbnb Payments Artikel 15 wijzigt na de datum waarop je deze Betalingsvoorwaarden voor het laatst hebt geaccepteerd (of daaropvolgende wijzigingen in deze Betalingsvoorwaarden hebt geaccepteerd), kun je de wijziging weigeren door ons een schriftelijke kennisgeving te sturen binnen dertig (30) dagen na de datum waarop de wijziging van kracht is gegaan. Jouw kennisgeving moet jouw naam, jouw postadres, de datum van de kennisgeving, jouw Airbnb-gebruikersnaam, het e-mailadres waarmee je jouw Airbnb-account hebt aangemaakt, jouw handtekening en een duidelijk geformuleerde verklaring bevatten dat je je wilt afmelden voor het gewijzigde Artikel 15. Je moet jouw kennisgeving naar dit adres sturen: 888 Brannan St, San Francisco, CA 94103, Verenigde Staten, t.a.v.: Arbitration Opt-Out, of per e-mail naar arbitration.opt.out@airbnb.com. Als je een nieuwe wijziging afwijst, betekent dit niet dat je je voorafgaande toestemming intrekt voor eerdere overeenkomsten (of latere wijzigingen daaraan) om geschillen tussen jou en Airbnb Payments te laten oplossen door arbitrage. Die eerdere overeenkomsten (of latere wijzigingen daarvan) blijven van kracht en afdwingbaar voor elk geschil tussen jou en Airbnb Payments.
Behalve zoals bepaald in Artikel 15.16, en onder voorbehoud van Artikel 13.7, blijft Artikel 15 van kracht en van toepassing na beëindiging van deze Betalingsvoorwaarden, zelfs als je stopt met het gebruik van de Betalingsdiensten of als je jouw account op Airbnb beëindigt.
Tenzij ze worden aangevuld door aanvullende voorwaarden, beleidsregels, richtlijnen of normen, vormen deze Betalingsvoorwaarden de volledige overeenkomst tussen Airbnb Payments en jou met betrekking tot dit onderwerp. Ze vervangen ook alle eerdere mondelinge of schriftelijke afspraken of overeenkomsten tussen Airbnb Payments en jou met betrekking tot de Betalingsdiensten. Als een bepaling van deze Betalingsvoorwaarden als ongeldig of niet-afdwingbaar wordt beschouwd, wordt die geschrapt en heeft die geen invloed op de geldigheid en afdwingbaarheid van de andere bepalingen.
Als Airbnb Payments een recht of bepaling in deze Betalingsvoorwaarden niet afdwingt, betekent dit niet dat Airbnb afstand doet van dat recht of die bepaling, tenzij dit door ons schriftelijk wordt erkend en overeengekomen. Tenzij uitdrukkelijk vermeld in deze Betalingsvoorwaarden doet de uitoefening van een van de rechten op grond van deze Betalingsvoorwaarden door een van de partijen geen afbreuk aan de andere rechten op grond van deze voorwaarden of de wet.
Je mag deze overeenkomst of jouw rechten en verplichtingen daaronder niet toewijzen, overdragen of delegeren zonder voorafgaande schriftelijke toestemming van Airbnb Payments. Airbnb Payments kan deze overeenkomst en alle rechten en verplichtingen naar eigen goeddunken toewijzen, overdragen of delegeren, met een kennisgeving van twee (2) maanden, onder de voorwaarde dat dit jouw rechten of voordelen onder deze voorwaarden niet vermindert.
Tenzij anders vermeld, worden alle kennisgevingen of andere communicatie die zijn toegestaan of vereist onder deze overeenkomst, schriftelijk gedaan door Airbnb Payments via e-mail of een melding op het Airbnb-platform, en afhankelijk van je meldingsinstellingen en berichtenservice (inclusief sms en WeChat). De datum van ontvangst is de datum waarop Airbnb Payments de kennisgeving verstuurt.
Deze overeenkomst wordt afgesloten in de taal zoals bepaald door de Voorwaarden en alle communicatie tijdens deze contractuele relatie moet in die taal plaatsvinden.
Artikel 17 is van toepassing als je een overeenkomst aangaat met Airbnb Payments UK. Voor zover Artikel 17 afwijkt van andere bepalingen in deze Betalingsvoorwaarden, is Artikel 17 van toepassing.
De Betalingsdiensten omvatten de service voor het innen van betalingen voor Hosts die een overeenkomst aangaan met Airbnb Payments UK. Deze service is een 'betalingsdienst' die valt onder de Payment Services Regulations van 2017 en voor die doeleinden behandelt Airbnb Payments UK hosts als 'gebruikers van betalingsdiensten'.
Door akkoord te gaan met deze Betalingsvoorwaarden heb je als Host ingestemd met de betaling van elke Uitbetaling door Airbnb Payments UK via de door jou gekozen Uitbetalingsmethode. Hosts kunnen een Uitbetalingsmethode tot een (1) dag voor het afgesproken tijdstip voor de Uitbetaling wijzigen, zoals beschreven in Artikel 3.3. Airbnb Payments UK wordt geacht de betalingsopdracht aan de Host te hebben ontvangen van de Host op dezelfde datum waarop Airbnb Payments UK ermee instemt om de Uitbetaling over te maken in overeenstemming met Artikel 3.3.
Airbnb Payments UK zet zich in om ervoor te zorgen dat Hosts in het VK elke uitbetaling ontvangen vóór het einde van de werkdag na de dag waarop Airbnb Payments UK de uitbetaling heeft overgemaakt.
Communicatie. Airbnb Payments informeert de Host via e-mail wanneer de Uitbetaling wordt overgemaakt. We sturen ook een melding naar het geregistreerde e-mailadres van een Host als de Uitbetaling wegens een fout bij ons terugkomt. Het is jouw verantwoordelijkheid als Host om aan ons een actueel, juist en geldig e-mailadres door te geven.
Als je als Host denkt of merkt dat een aan jou verschuldigde Uitbetaling zonder jouw toestemming is of kan worden omgeleid ('Omgeleide uitbetaling') omdat jouw wachtwoord of andere inloggegevens van jouw Airbnb-account ('Inloggegevens') verloren of gestolen zijn of onrechtmatig gebruikt worden, moet je Airbnb Payments UK onmiddellijk op de hoogte stellen (zie Artikel 20 voor meer informatie over hoe je dit doet).
Als je als Host beweert dat je via de door jou gekozen Uitbetalingsmethode een Uitbetaling niet hebt ontvangen (ook wanneer het om een Omgeleide uitbetaling gaat), zal Airbnb Payments UK onmiddellijk proberen de betaling te traceren en je op de hoogte stellen van het resultaat. Dit vindt plaats op jouw verzoek, dat zo snel mogelijk moet worden gedaan als je op de hoogte bent van de ongeautoriseerde of onjuist uitgevoerde Uitbetaling en in elk geval binnen 13 maanden nadat het is gebeurd. Behoudens Artikel 17.2.3 zullen we het bedrag terugbetalen, tenzij we kunnen bewijzen dat (i) de Uitbetaling door jou is ontvangen via de door jou gekozen Uitbetalingsmethode, of (ii) we de Uitbetaling correct hebben uitgevoerd op basis van de door jou verstrekte informatie over de Uitbetalingsmethode, maar de door jou verstrekte informatie onjuist was. Als je ons onjuiste informatie hebt gegeven, zijn we niet aansprakelijk voor de gebrekkige of niet-uitgevoerde Uitbetaling, maar we zullen redelijke inspanningen leveren om het Uitbetalingsbedrag terug te vorderen.
Je moet jouw Inloggegevens gebruiken in overeenstemming met deze Betalingsvoorwaarden en alle redelijke stappen ondernemen om je Inloggegevens veilig te houden. Als Host kun je mogelijk aansprakelijk zijn voor verliezen met betrekking tot een Omgeleide uitbetaling als gevolg van het gebruik van verloren of gestolen Inloggegevens of als die gegevens onrechtmatig worden gebruikt (inclusief het verlies van een mobiele telefoon waarop je de App hebt geïnstalleerd) of als je jouw Inloggegevens niet veilig hebt bewaard, tot een maximum van £ 35. Dit is niet van toepassing als je het verlies, de diefstal of het onrechtmatig gebruik van jouw Inloggegevens vóór de Uitbetaling niet kon opmerken, tenzij je frauduleus hebt gehandeld. Het is ook niet van toepassing als het verlies is veroorzaakt door handelingen of nalatigheden van Airbnb-personeel of een dienstverlener. Je kunt wel aansprakelijk worden gesteld voor alle verliezen met betrekking tot een Omgeleide uitbetaling als we kunnen aantonen dat je frauduleus hebt gehandeld of als je met opzet of grove nalatigheid het Airbnb-platform en/of de Betalingsdiensten niet volgens de Voorwaarden of deze Betalingsvoorwaarden hebt gebruikt (inclusief de verplichting om jouw Inloggegevens veilig te bewaren). Behalve wanneer je frauduleus hebt gehandeld, ben je niet aansprakelijk voor verliezen met betrekking tot een Omgeleide Uitbetaling als die zijn ontstaan na jouw melding van het verlies, de diefstal of het onrechtmatig of ongeautoriseerd gebruik van jouw Inloggegevens, als we niet de juiste middelen geboden hebben voor die melding, of als we niet de benodigde klantauthenticatie vereist hebben.
Klachten over de Betalingsdiensten moeten worden ingediend bij Airbnb Payments UK (zie Artikel 20 voor meer informatie over hoe je dit doet). Als je niet tevreden bent met de uitkomst van een klacht en je als Host gereguleerde Betaaldiensten van Airbnb Payments UK hebt ontvangen, kun je jouw klacht mogelijk ook laten doorverwijzen naar de Financial Ombudsman. Alle klachten bij de Financial Ombudsman Service zijn onderworpen aan de regels van die instantie, ook met betrekking tot de toelatingsvoorwaarden. De Financial Ombudsman Service in het Verenigd Koninkrijk biedt een gratis service om klachten op te lossen. Meer informatie over de Financial Ombudsman Services en contactgegevens vind je op: https://www.financial-ombudsman.org.uk.
Artikel 18 is van toepassing als je een overeenkomst aangaat met Airbnb Payments Luxembourg. Voor zover Artikel 18 afwijkt van andere bepalingen van deze Betalingsvoorwaarden, is Artikel 18 van toepassing.
De Betalingsdiensten omvatten de betalingsdiensten voor Hosts die een overeenkomst aangaan met Airbnb Payments Luxembourg. Deze services zijn 'betalingsdiensten' die vallen onder de gewijzigde Wet van 10 November 2009 inzake betalingsdiensten ('Wet van 2009') en voor die doeleinden behandelt Airbnb Payments Luxembourg Hosts als 'gebruikers van betalingsdiensten' volgens de Wet van 2009.
Door akkoord te gaan met deze Betalingsvoorwaarden heb je als host ingestemd met de betaling van elke Uitbetaling door Airbnb Payments Luxembourg via de door jou gekozen Uitbetalingsmethode. Hosts kunnen een Uitbetalingsmethode tot een (1) dag voor het afgesproken tijdstip voor de Uitbetaling wijzigen, zoals beschreven in Artikel 3.3. Airbnb Payments Luxembourg wordt geacht de betalingsopdracht aan de Host te hebben ontvangen van de Host op dezelfde datum waarop Airbnb Payments Luxembourg ermee instemt om de Uitbetaling ver te maken in overeenstemming met Artikel 3.3.
Tussen jou en Airbnb Payments Luxembourg zijn altijd de wettelijke bepalingen van toepassing met betrekking tot de vorm en procedure om toestemming te geven om een betalingsopdracht in gang te zetten of uit te voeren en om die toestemming in te trekken in overeenstemming met Artikelen 81 en 93 van de Wet van 2009.
Airbnb Payments Luxembourg zet zich in om ervoor te zorgen dat Hosts in de EER elke uitbetaling ontvangen vóór het einde van de werkdag na de dag waarop Airbnb Payments Luxembourg de uitbetaling heeft overgemaakt.
Communicatie. Airbnb Payments informeert de Host via e-mail wanneer de Uitbetaling wordt overgemaakt. We sturen ook een melding naar het geregistreerde e-mailadres van een Host als de Uitbetaling wegens een fout bij ons terugkomt. Het is jouw verantwoordelijkheid als Host om een actueel, juist en geldig e-mailadres aan ons door te geven.
Niettegenstaande de bepalingen van Artikel 1341 van het Luxemburgs Burgerlijk Wetboek, heeft Airbnb Payments, wanneer nuttig of nodig, het recht om beweringen te bewijzen met alle middelen die wettelijk zijn toegestaan in commerciële zaken, zoals getuigenverklaringen, beëdigde verklaringen, elektronische gegevens en andere geschikte documenten.
Als je als Host denkt of merkt dat een aan jou verschuldigde Uitbetaling zonder jouw toestemming is of kan worden omgeleid ('Omgeleide uitbetaling') omdat jouw wachtwoord of andere inloggegevens van jouw Airbnb-account ('Inloggegevens') verloren of gestolen zijn of in geval van een ongeoorloofde, onjuist geïnitieerde of onjuist uitgevoerde betalingstransactie, moet je Airbnb Payments Luxembourg onmiddellijk op de hoogte brengen overeenkomstig Artikel 20. Dit moet je doen zodra je je bewust wordt van de ongeautoriseerde of onjuist uitgevoerde Uitbetaling en in elk geval niet later dan 13 maanden na de afschrijvingsdatum. Bij een ongeautoriseerde betalingstransactie restitueert Airbnb Payments je het bedrag vóór het einde van de werkdag nadat de transactie is opgemerkt of nadat Airbnb Payments ervan op de hoogte is gebracht in overeenstemming met Artikel 20. Airbnb Payments is daartoe niet verplicht als er redelijke gronden zijn om fraude te vermoeden. De verliezen van een ongeautoriseerde Uitbetaling tot 50 euro zijn (verplicht) voor jouw rekening als die Uitbetaling het gevolg is van verlies of diefstal van jouw Inloggegevens of als jouw Inloggegevens onrechtmatig worden gebruikt. De verliezen zijn niet voor jouw rekening als: (a) het verlies, de diefstal of de verduistering van jouw Inloggegevens voorafgaand aan een Uitbetaling niet kon worden gedetecteerd, behalve wanneer je frauduleus hebt gehandeld, of (b) het verlies is veroorzaakt door handelingen of nalatigheid van Airbnb Payments. Je bent aansprakelijk voor alle verliezen met betrekking tot een uitbetaling door Airbnb Payments die niet door jou is geautoriseerd als je frauduleus hebt gehandeld of als je Airbnb Payments niet op tijd op de hoogte hebt gesteld in overeenstemming met dit Artikel en Artikel 20. Na melding aan ons overeenkomstig dit Artikel en Artikel 20, zul je geen financiële gevolgen dragen voor verloren, gestolen of onrechtmatig gebruikte Inloggegevens.
We zijn niet aansprakelijk voor verliezen als gevolg van: (i) Omgeleide uitbetalingen weerbij je frauduleus hebt gehandeld of waarbij je met opzet of grove nalatigheid het Airbnb-platform en/of de Betalingsdiensten niet hebt gebruikt in overeenstemming met de Voorwaarden of deze Betalingsvoorwaarden (inclusief de verplichting om jouw Inloggegevens veilig te bewaren), (ii) als Airbnb Payments je bewijs levert dat de uitbetaling op tijd en volledig is ontvangen door jou of jouw betalingsdienstaanbieder, of (iii) als een uitbetalingstransactie is gedaan in overeenstemming met de door jou verstrekte informatie die onjuist was. In deze gevallen kun je Airbnb Payments vragen om het bedrag met gepaste beschikbare middelen terug te vorderen. Als het niet mogelijk is om het bedrag terug te vorderen, zal Airbnb Payments je op schriftelijk verzoek alle beschikbare informatie geven die voor jou relevant is om juridische stappen voor deze terugbetaling van het bedrag te ondernemen. Airbnb Payments kan voor de restitutie kosten in rekening brengen.
Als je als Host claimt dat je via de door jou gekozen Uitbetalingsmethode een Uitbetaling niet correct hebt ontvangen, zal Airbnb Payments Luxembourg (op verzoek) onmiddellijk proberen de betaling te traceren en je op de hoogte stellen van het resultaat.
Elke klacht met betrekking tot verlies, diefstal, onrechtmatig of ongeautoriseerd gebruik van de Betalingsdiensten, of ongeautoriseerde of onjuiste transacties, moet schriftelijk worden ingediend bij Airbnb Payments Luxembourg op grond van Artikel 20. Als je niet tevreden bent met de uitkomst van een klacht en je als Host gereguleerde Betaaldiensten van Airbnb Payments Luxembourg hebt ontvangen, kun je binnen een jaar nadat je je klacht bij Airbnb Payments Luxembourg hebt ingediend, je verzoek indienen bij de toezichthoudende autoriteit van Airbnb Payments Luxembourg, de CSSF (zoals gedefinieerd in Artikel 20). De CSSF treedt op als instantie voor buitengerechtelijke conflictoplossing. Het verzoek moet schriftelijk, per post of per e-mail worden gestuurd naar de CSSF op het relevante adres op de CSSF-website of online via dezelfde website. Het verzoek moet in het Engels, Frans, Duits of Luxemburgs ingediend worden. Het verzoek moet ook een verklaring bevatten van de redenen ervoor en de volgende documenten moeten erbij zitten:
Voor Gasten die in Frankrijk wonen, zijn, niettegenstaande de afwijkende bepalingen in de Betalingsvoorwaarden en voor alle duidelijkheid, de totale kosten, betalingen in termijnen of periodieke betalingen, inclusief terugkerende betalingen die geïnd worden door Airbnb Payments van die gasten, aanbetalingen ('acomptes') zoals gedefinieerd door de Franse wetgeving.
We besteden een aantal van onze diensten uit en maken daarbij gebruik van verschillende dienstverleners (sommige behoren tot de Airbnb-groep en andere zijn externe dienstverleners). Zij helpen ons om onze diensten op een efficiënte en kwalitatieve manier aan te bieden. Het is noodzakelijk dat wij bepaalde gegevens aan deze dienstverleners overdragen of beschikbaar maken. Je gaat akkoord met de uitbestedeingsregelingen en geeft ons de opdracht om gegevens (zoals hieronder gedefinieerd) over jou en, indien van toepassing, over aan jou gelieerde personen (in verband met jouw account van Airbnb), zoals jouw uiteindelijk belanghebbende(n) en vertegenwoordiger(s), over te dragen of beschikbaar te maken aan een aantal dienstverleners in het kader van uitbestedingsregelingen met betrekking tot onder andere technische aspecten (inclusief IT), bedrijfsvoering, betalingsverwerking, interne controle, klantenonderzoek (inclusief achtergrond- of politiecontroles), fraudepreventie, risicobeoordeling, productontwikkeling, onderhoud en foutopsporing, reclame, verwerking van verzekeringsclaims en support. De over te dragen of beschikbaar te stellen gegevens omvatten (als je een persoon bent): je achternaam, voornaam, adres, geboortedatum en -plaats ennationaliteit. In het geval van een rechtspersoon: jouw bedrijfsnaam, vestigingsplaats, rechtsvorm, registratienummer voor rechtspersonen en de bovengenoemde persoonsgegevens van je uiteindelijk belanghebbende(n) en vertegenwoordiger(s). De over te dragen of beschikbaar te stellen gegevens bevatten ook de contactgegevens van elke (rechts)persoon, zoals telefoonnummers en e-mailadressen, financiële gegevens en gebruiksgegevens met betrekking tot onze diensten (inclusief betaalmethode, uitbetalingsmethode, betalingstransactie). De ontvangers van de gegevens bevinden zich in de Verenigde Staten, het Verenigd Koninkrijk, Ierland, India, Luxemburg, Nederland, Duitsland en Spanje, en ook in andere landen in Europa, Azië-Pacific en Noord- en Zuid-Amerika. Deze gegevensdoorgiften vinden plaats tijdens de hele duur van de zakelijke relatie tussen jou en ons, en voor een wettelijke toegestane extra periode na het einde van de zakelijke relatie. Je accepteert dat de overgedragen gegevens na de doorgifte niet langer door de Luxemburgse geheimhoudingsplicht worden beschermd.
De volgende paragrafen zijn ook van toepassing als je de Betalingsdiensten gebruikt als vertegenwoordiger ('Vertegenwoordiger') die optreedt namens een bedrijf, onderneming of ander type rechtspersoon (in zo'n geval verwijzen 'je', ' jij', 'jou' en 'jouw' naar dat bedrijf, die onderneming of die rechtspersoon en gelden deze Betalingsvoorwaarden ook voor hen).
Je accepteert de Betalingsvoorwaarden en je bent verantwoordelijk voor alle handelingen of nalatigheid van medewerkers of externe vertegenwoordigers die de Betalingsvoorwaarden namens jou gebruiken.
Jij en jouw Vertegenwoordiger bevestigen elk dat je bevoegd bent om de in Artikel 2.1 en 3.2 beschreven informatie te verstrekken en dat jouw Vertegenwoordiger de bevoegdheid heeft om je te binden aan deze Betalingsvoorwaarden. Mogelijk hebben we aanvullende informatie of documenten nodig van jou om vast te stellen dat jouw Vertegenwoordiger bevoegd is.
Je verklaart en garandeert ons dat: (i) je naar behoren georganiseerd bent, bestaat en de wetten naleeft van het land waarin je bedrijf geregistreerd is, en dat je je registreert om de Betalingsdiensten te gebruiken, en dat (ii) je alle vereiste rechten, machtigingen en bevoegdheden hebt om deze Overeenkomst af te sluiten, om aan de verplichtingen ervan te voldoen en om de rechten, licenties en machtigingen in deze Overeenkomst te verlenen.
Als je jouw Betaalmethode gebruikt voor jouw medewerkers of voor andere geautoriseerde derden in verband met Airbnb for Work, zoals toegestaan door je account, machtig je Airbnb Payments om boekingen die medewerkers van jouw bedrijf of andere geautoriseerde derden aanvragen, in rekening te brengen via jouw Betaalmethode.
Je autoriseert Airbnb Payments om elke Uitbetalingsmethode op te slaan die aan jouw Airbnb-account is gekoppeld, om betalingen voor boekingen van hetzelfde account via de Uitbetalingsmethode over te maken en om elk andere handeling uit te voeren zoals die toegestaan is onder de Betalingsvoorwaarden met betrekking tot de Uitbetalingsmethode.
Als je betaalkaartinformatie namens iemand of een derde partij beheert, opslaat of anderszins verwerkt, stem je ermee in om voortdurend te voldoen aan de toepasselijke vereisten voor gegevensbescherming en -beveiliging volgens de huidige Payment Card Industry Data Security Standard met betrekking tot het gebruik, de toegang en de opslag van dergelijke creditcardgegevens. These Payments Terms of Service for users outside of the UK, Europe and Australia (“Payments Terms”) are a binding legal agreement between you and Airbnb Payments that govern the Payment Services (defined below) conducted through or in connection with the Airbnb Platform. When these Payments Terms mention “Airbnb Payments,” “we,” “us,” or “our,” it refers to the Airbnb Payments company you are contracting with for Payment Services.
Airbnb Payments provides payments services to Members publishing, offering and booking Accommodations, Experiences or other Host Services, including services in connection with Airbnb.org and other current and future services provided via the Airbnb Platform. These payment services are provided for the benefit of Hosts and may include (if available) the following (collectively, “Payment Services”):
In order to use the Payment Services, you must be at least 18 years old, must have an Airbnb account in good standing in accordance with the Airbnb Terms of Service (“Terms”), and must keep your payment and personal information accurate and complete.
Payment Services will be provided by the contracting entity based on your country of residence subject to any exceptions described below:

If you change your country of residence, the Airbnb company you contract with and the applicable version of the Payment Terms will be determined by your new country of residence from the date on which your country of residence changes. Please note, however, that the Airbnb Payments company with whom you contract will stay the same for all bookings made prior to your change of residence.
The Terms separately govern your use of the Airbnb Platform. Capitalized terms not defined in these Payments Terms have the meaning ascribed to them in the Terms.
By using the Payments Services, you agree to comply with these Payments Terms. Airbnb Payments may temporarily limit or suspend your access to or use of the Payment Services, or its features, to carry out maintenance measures that ensure the proper functioning of the Payment Services. Airbnb Payments may improve, enhance and modify the Payment Services and introduce new Payment Services from time to time. Airbnb Payments will provide notice to Members of any changes to the Payment Services, unless such changes do not materially increase the Members’ contractual obligations or decrease the Members’ rights under these Payments Terms.
The Payment Services may contain links to third-party websites or resources (“Third-Party Services”). Such Third-Party Services are subject to different terms of service and privacy policies, and Members should review them. Airbnb Payments is not responsible or liable for the use of such Third-Party Services. Links to any Third-Party Services are not an endorsement by Airbnb Payments of those Third-Party Services.
Airbnb Payments may enable features that allow you to authorize other Members or third parties to take certain actions that affect your Airbnb account. You may authorize a third party to use your Airbnb account if the feature is enabled for your Airbnb account. You acknowledge and agree that anyone you authorize to use your Airbnb account may use the Payment Services on your behalf and that you will be responsible for any payments made by such person.
You authorize Airbnb Payments, directly or through third parties, to make any inquiries we consider necessary to verify your identity and information you provide, and if applicable, verifying the identity of the representative(s) and beneficial owner(s). This may include (i) screening you and, if applicable, your representative(s) and beneficial owner(s) against third-party databases or other sources, (ii) requesting reports from service providers, (iii) asking you and, if applicable, your representative(s) and beneficial owner(s) to provide a form of government identification (e.g., driver’s license or passport) to check your name, place and date of birth, your address, nationality and/or other information which we deem necessary under applicable laws; or (iv) requiring you to take steps to confirm ownership of your email address, Payment Method(s) or Payout Method(s). Airbnb Payments reserves the right to terminate, suspend, or limit access to the Payment Services in the event we are unable to obtain or verify any of this information.
Your access to or use of certain Payment Services may be subject to, or require you to accept, additional terms and conditions. If there is a conflict between these Payments Terms and terms and conditions applicable to a specific Payment Service, the latter terms and conditions will take precedence with respect to your use of or access to that Payment Service, unless specified otherwise.
When you add a Payment Method to your Airbnb account, you will be asked to provide billing information such as name, billing address, and financial instrument information either to Airbnb Payments or its third-party payment processor(s). You authorize Airbnb Payments and its payment service providers to collect and store your Payment Method information.
When you add or use a Payment Method, Airbnb Payments may verify the Payment Method by (i) authorizing your Payment Method for one or two nominal amounts via a payment service provider, and asking you to confirm those amounts, or (ii) requiring you to upload a billing statement. We may, and retain the right to, initiate refunds of these amounts from your Payment Method. When you add a Payment Method during checkout, we will automatically save and add that Payment Method to your Airbnb account so it can be used for a future transaction. You may not remove the Payment Method associated with a reservation during the period commencing from the date of your booking and ending fourteen (14) days following your check-out date, nor during any additional period of time needed to resolve any outstanding Damage Report associated with such booking. When you add or use your bank account as a Payment Method (as available in the US), your bank account must be able to accept debits denominated in USD.
You allow Airbnb Payments to charge your Payment Method (including charging more than one Payment Method), either directly or indirectly, for all fees due (including any applicable taxes) in connection with your Airbnb account, including Damage Report amounts in accordance with the Terms and with Section 6. When you pay using your bank account, you authorize Airbnb Payments to debit your bank account according to the payment schedule shown at checkout. You also authorize Airbnb Payments to further debit or credit your bank account to correct any erroneous debit, make necessary adjustments to your payment, or to issue a refund back to your bank account.
If your Payment Method’s account information changes (e.g., account number, routing number, expiration date) as a result of re-issuance or otherwise, we may acquire that information from our financial services partners or your bank and automatically update your Payment Method on file.
Airbnb Payments generally charges the Total Price due after the Host accepts your booking request. However, if you pay with a push Payment Method (such as Sofort), Airbnb Payments will collect the Total Price due at the time of your booking request or after the Host accepts your booking request. Airbnb may offer alternative options for the timing and manner of payment. Any additional fees for using those alternative payment options will be displayed via the Airbnb Platform and included in the Total Price, and you agree to pay such fees by selecting the payment option. Additional terms and conditions may apply for the use of an alternative payment option. If Airbnb Payments is unable to collect the Total Price due, as scheduled, Airbnb Payments will collect the Total Price due at a later point in accordance with Section 5.3. Once the payment for your requested booking is successfully completed, you will receive a confirmation email.
The currencies available to make payments may be limited for regulatory or operational reasons based on factors such as your selected Payment Method, your country of residence, and/or your Airbnb Payments contracting entity(ies). Any such limitations will be communicated via the Airbnb Platform, and you will be prompted to select a different currency or Payment Method if your preferred currency is not available.
Note that if the country in which your Airbnb Payments contracting entity is located is different than the country of your Payment Method provider, or your selected currency is different than your Payment Method's billing currency, your payment may be processed outside of your country of residence. As a result, your Payment Method provider may impose certain fees and the amount listed on your Payment Method statement may be different from the amount shown at checkout. For example, if you make a booking using a U.S. issued card, but select Euro as your currency, your payment may be processed outside the U.S., and banks and credit card companies may impose international transaction fees and foreign exchange fees. In addition, if you select to pay with a currency that is different than your Payment Method's billing currency, your bank or credit card company may convert the payment amount to your billing currency associated with your Payment Method, based on an exchange rate and fee amount determined solely by your bank. Airbnb Payments is not responsible for any such fees and disclaims all liability in this regard. Please contact your Payment Method provider if you have any questions about these fees or any exchange rate imposed by your Payment Method provider.
If a requested booking is declined because it is not accepted by the Host, you cancel the booking request before it is accepted by the Host, or Airbnb cancels the booking, any amounts collected by Airbnb Payments and due to you pursuant to the policies described in Section 5.5, will be refunded to you, and any pre-authorization of your Payment Method will be released (if applicable) in accordance with Section 5.5.2
Airbnb Payments reserves the right to decline or limit payments that we believe (i) may violate Airbnb Payments’ risk management policies or procedures, (ii) may violate these Payments Terms or the Terms, (iii) are unauthorized, fraudulent or illegal; or (iv) expose you, Airbnb, Airbnb Payments, or others to risks unacceptable to Airbnb Payments.
Payment Methods may involve the use of third-party payment service providers. These payment service providers may charge you additional fees when processing payments in connection with the Payment Services, and Airbnb Payments is not responsible for any such fees and disclaims all liability in this regard. Your Payment Method may also be subject to additional terms of use. Please review them before using your Payment Method.
Airbnb Payments is not responsible for any loss suffered by you as a result of incorrect Payment Method information provided by you.
2.11.1.1
Airbnb may make available to Guests the option to pay a portion of the booking’s Total Price at the time of booking and pay the remainder of the Total Price at a later time prior to check-in (“Pay Part Now, Part Later”). Availability of this option may depend on the Listing and/or Payment Method. You will not be charged any additional fees for using Pay Part Now, Part Later.
2.11.1.2
If you choose Pay Part Now, Part Later, the Airbnb Platform will notify you during check out of the amount, currency and schedule of each payment due. Airbnb credits, coupons, or gift cards will be applied first before the amount of each payment is calculated. On the payments due date, Airbnb Payments will automatically charge the original Payment Method you used to make the booking.
2.11.1.3
If you make a modification to a booking made with Pay Part Now, Part Later, Airbnb will notify you of the revised payment schedule, as applicable, and Airbnb Payments will automatically charge the original Payment Method you used to make the booking on the revised payment due dates. If the modification increases your Total Price, you may be required to make an additional partial payment of the new Total Price at the time of the modification.
2.11.1.4
You agree that by selecting a Pay Part Now, Part Later, you may not be able to pay for the booking with a different Payment Method or pursuant to a different payment schedule.
2.11.1.5
If Airbnb Payments is unable to collect your payment, Airbnb Payments will notify you of such declined payment, and require you to complete the payment using an alternative Payment Method within 72 hours of the notice. If you fail to complete the payment, you authorize Airbnb to cancel the booking on your behalf. If the booking is canceled, you will be refunded based on the Host’s cancellation policy.
2.11.2.1
For certain bookings (such as for Accommodation bookings of twenty-eight (28) nights or more), Airbnb Payments may require a Guest to make recurring, incremental payments toward the Total Price owed (“Recurring Payments”). More information on Recurring Payments (including the amount and the frequency of payments) will be made available via the Airbnb Platform if applicable to a booking.
2.11.2.2
If Recurring Payments apply to a confirmed booking, then the Guest authorizes Airbnb Payments to collect the Total Price due.
2.11.2.3
Guests may stop a Recurring Payment by notifying Airbnb Payments orally or in writing at least three (3) business days before the scheduled date of the payment. Airbnb Payments may require you to give written confirmation of a stop-payment order within fourteen (14) days of an oral notification. If you fail to provide written confirmation within those fourteen (14) days, Airbnb Payments is not obligated to honor your request to stop any future Recurring Payments. If you have any questions regarding your Recurring Payments, please contact Airbnb Payments.
Guests may from time to time be offered the possibility to pay for an Accommodation on credit or other installment options, and pay for them over time ('buy now, pay later'). These Payment Methods are provided by Klarna Bank AB (or its affiliate), not Airbnb, and Klarna will become your creditor for the payment, subject to additional terms of use provided at checkout. Depending on the Payment Method, this will also create a separate relationship between you as the borrower and Klarna as the lender. Please review any applicable additional terms before using these Payment Methods.
Airbnb Payments generally collects the Total Price of a booking at the time the Guest’s booking request is accepted by the Host, unless noted otherwise.
In order to receive a Payout you must have a valid Payout Method linked to your Airbnb account. When you add a Payout Method to your Airbnb account, you may be asked to provide additional information such as name, government identification, tax ID, billing address, and financial instrument information either to Airbnb Payments or its third-party payment processor(s). Depending on the Payout Method selected additional information may be required, such as: residential address, name on the account, account type, routing number, account number, email address, payout currency, identification number and account information associated with a particular payment processor. Providing requested information is required for a Payout Method to be valid. The information Airbnb Payments requires for a valid Payout Method may change, and Airbnb Payments may request additional information at any time; failing to provide requested information may result in Airbnb Payments temporarily placing a hold, suspending, or canceling any Payout until the information is provided and, if necessary, validated. You authorize Airbnb Payments to collect and store your Payout Method information in accordance with Airbnb’s Privacy Policy. Airbnb Payments may also share your information with governmental authorities as required by applicable law.
Subject to and conditional upon successful receipt of the payments from Guest, Airbnb Payments will initiate Payouts to your selected Payout Method: (i) for Accommodations, by the end of the business day after the Guest’s scheduled check-in date; (ii) for Experiences, by the end of the business day after the start of the Experience; and (iii) for all other Host Services, at the time specified via the Airbnb Platform. For Accommodation bookings of twenty-eight (28) nights or more, Airbnb Payments will initiate the first payout by the end of the business day after the Guest’s scheduled check-in date, and will initiate future payouts every 30 days after the initial payout, for the duration of the reservation.
Airbnb Payments may offer you a different Payout time or trigger for payment, which may be subject to additional terms and conditions. The time it takes to receive Payouts once released by Airbnb Payments may depend upon the Payout Method you select.
Your Payout for a booking will be the Total Price less applicable fees like Airbnb service fees and applicable taxes, and any amounts you agree to allocate to any co-host, or the owner(s) of an Accommodation, a homeowners’ association, and/or their agent (such as a building operator or property management company). In the event of cancellation of a confirmed booking, Airbnb Payments will remit the amount you are due (if any) as provided in the Terms and applicable cancellation policy.
Airbnb Payments may temporarily place a hold, suspend, or cancel any Payout for purposes of preventing unlawful activity or fraud, risk assessment, security, or completing an investigation; or if we are unable to verify your identity, or to obtain or verify requested information. Furthermore, Airbnb Payments may temporarily place a hold on, suspend, or delay initiating or processing any Payout due to you under the Terms as a result of high volume Booking cancellations or modifications arising from a Force Majeure Event (as defined below).
Airbnb Payments will remit your Payouts in the currency applicable to your selected Payout Method. The currencies available may be limited for regulatory or operational reasons based on factors such as your selected Payout Method, your country of residence, and/or your Airbnb contracting entity(ies). Any such limitations will be communicated via the Airbnb Platform, and you will be prompted to select a different currency or Payout Method. Note that payment service providers may impose transaction, currency conversion or other fees based on the currency or Payout Method you select, and Airbnb Payments is not responsible for any such fees and disclaims all liability in this regard.
For compliance or operational reasons, Airbnb Payments may limit the amount of a Payout. If you are due an amount above that limit, Airbnb Payments may make a series of Payouts (potentially over multiple days) in order to provide your full Payout amount.
Payout Methods may involve the use of third-party payment service providers. These payment service providers may charge you additional fees when processing Payouts in connection with the Payment Services (including deducting charges from the Payout amount), and Airbnb Payments is not responsible for any such fees and disclaims all liability in this regard. Your Payout Method may also be subject to additional terms of use from such third-party payment service providers. Please review them before using your Payout Method.
Airbnb Payments may combine amounts that it collects from Guests and invest them as permitted under applicable laws. Airbnb Payments will retain any interest it earns on those investments.
Airbnb Payments is not responsible for any loss suffered by you as a result of incorrect Payout Method information provided by you.
If you provide Host Services jointly with one or more other Hosts as part of a team, business or other organization (“Host Team”), Airbnb may make available to such Hosts the option to allocate between the members of the Host Team the total Host Payout for a booking. Airbnb Payments will execute such payments at the instruction of one or more members of the Host Team and is not responsible for any losses related to errors or omissions made by the Hosts in providing such payment instructions.
3.11.2.1
Certain Hosts may be eligible to receive a Payout via a virtual credit card (“VCC”). If a Payout is being made via a VCC to a Host, Airbnb Payments will provide you with a VCC number for each reservation and the amount authorized. Each VCC will be able to be charged 24 hours prior to the Guest’s scheduled check-in time (or 24 hours prior to 3:00 pm local time - or 3:00 pm UTC if local time is unknown - if the check-in time is flexible or not specified), and will expire 180 days after the Guest’s scheduled check-in time.
3.11.2.2
As a condition precedent to Airbnb Payments’ obligation to pay you for reservations, you agree to charge each VCC no earlier than one day before check-in for the reservation and no later than 180 days following check-in, and any failure to charge the VCC shall serve as confirmation from you that no amount is due by Airbnb Payments to you (e.g., due to Guest cancellation or other adjustment), and Airbnb Payments may retain any amounts paid by the Guest to Airbnb Payments as additional consideration for Airbnb Payments’ facilitation costs. You acknowledge and agree that Airbnb Payments generally has no knowledge of events occurring during a Reservation (e.g., a Guest’s actual arrival or departure dates, or cancellations or any other adjustments to a Reservation negotiated between you and the Guest), and that consequently Airbnb Payments is entitled to rely upon and accept as accurate and dispositive of the amount due any charge you make to the VCC.
3.11.2.3
If you improperly use or overcharge a VCC, or if, after you have charged a VCC, a Guest cancels a reservation and/or is otherwise due a refund under an applicable cancelation policy, you agree to refund the VCC if requested by Airbnb Payments. You acknowledge that Airbnb Payments is entitled to recover any amounts due to Airbnb Payments by any other means permitted under these Payments Terms and/or by initiating a chargeback to you.
3.11.2.4
You will be solely responsible for collecting any payment directly from Guests for any incidentals or any upgrades requested by Guests once at your property. You agree not to honor any Guest requests that may result in Airbnb Payments refunding any portion of the Total Price without first confirming with Airbnb Payments that such requests are acceptable.
3.11.2.5
Airbnb Payments shall have the right, within one (1) year after the date that the VCC is charged with respect to any Guest reservation, to audit the VCC charge and request documentation from you that supports the amount charged. If Airbnb Payments does not exercise this right within such period, then the VCC charge shall be deemed to be correct. If you are unable to provide sufficient documentation to support a VCC charge, then Airbnb Payments shall have the right to initiate a chargeback to you and/or recover the amount by any other means permitted under these Payments Terms.
If a Guest in Germany chooses to pay for an Accommodation Reservation using a Klarna ‘buy now, pay later’ option (other than a Pay-in-3 option), these additional Host terms apply.
Each Host, including each Host Team member, hereby appoints Airbnb Payments as the Host’s payment collection agent solely for the limited purpose of accepting and processing funds from Guests purchasing Host Services on the Host’s behalf.
Each Host, including each Host Team member, agrees that payment made by a Guest through Airbnb Payments, shall be considered the same as a payment made directly to the Host, and the Host will provide the Host Service booked by the Guest in the agreed-upon manner as if the Host has received the payment directly from the Guest. Each Host agrees that Airbnb Payments may refund the Guest in accordance with the Terms. Each Host understands that Airbnb Payments’ obligation to pay the Host is subject to and conditional upon successful receipt of the associated payments from Guest. Airbnb Payments guarantees payments to Host(s) only for such amounts that have been successfully received by Airbnb Payments from Guests in accordance with these Payments Terms. In accepting appointment as the limited payment collection agent of the Host, Airbnb Payments assumes no liability for any acts or omissions of the Host.
Each Guest acknowledges and agrees that, notwithstanding the fact that Airbnb Payments is not a party to the agreement between you and the Host(s), including each Host Team member, Airbnb Payments acts as each Host’s payment collection agent for the limited purpose of accepting payments from you on behalf of the Host(s). Upon a Guest’s payment of the funds to Airbnb Payments, the Guest’s payment obligation to the Host(s) for the agreed upon amount is extinguished, and Airbnb Payments is responsible for remitting the funds successfully received by Airbnb Payments to the Host(s) in the manner described in these Payments Terms. In the event that Airbnb Payments does not complete the provision of the Payment Services and remit any such amounts, the Host(s) will have recourse only against Airbnb Payments and not the Guest directly for the failure on the provision of the Payment Services.
Airbnb Payments may charge fees for use of certain Payment Services and any applicable fees will be disclosed to you in the Terms or via the Airbnb Platform.
You authorize Airbnb Payments to collect from you amounts due pursuant to these Payment Terms and/or the Terms by either (i) charging or debiting the Payment Method associated with the relevant booking, or any other Payment Method on file that you authorize in your Airbnb account (unless you have previously removed the authorization to charge or debit such Payment Method(s)), or (ii) by withholding the amount from your future Payout. Specifically, you authorize Airbnb Payments to collect from you:
If you owe an amount at any time after a booking, such as with Pay Part Now, Part Later or Recurring Payment charges, Booking Modifications, resolution center payments, or Damage Reports (“Additional Amounts”), you authorize and grant Airbnb Payments a mandate to collect payments for such Additional Amounts by charging your Payment Method associated with the relevant booking without any further action on your part. Airbnb Payments will notify you in writing before any Additional Amounts are charged to such payment method.
If your Payment Method associated with the relevant booking is determined to be expired, invalid or otherwise not able to be charged for any reason (such as insufficient funds), you remain responsible for any uncollected amounts. You authorize Airbnb Payments to charge or debit the Payment Method related to your booking again or use any other Payment Method on file associated with your Airbnb account, if available, to collect such Additional Amounts. Your bank may charge you an overdraft or other fees for each payment failure. Any amount not collected for any reason will be subject to any remedies that may be available, including, but not limited to, referral to a collections agency, or pursuit of available causes of action or claims against you.
If Airbnb has reason to believe that you as a Host participated in fraudulent activity, such as an overpayment scam, booking fraud or other fraud, and Airbnb Payments released the payout for such stay, Airbnb Payments may recoup from you such amount by reducing, deducting or debiting the amount from any future Payouts owed to you.
In addition to any amount due as outlined above, if there are delinquent amounts or chargebacks associated with your Payment Method, you may be charged fees that are incidental to Airbnb Payments collection of these delinquent amounts and chargebacks. Such fees or charges may include collection fees, convenience fees or other third-party charges.
If Airbnb Payments is unable to collect any amounts you owe under the Terms and these Payments Terms, Airbnb Payments may engage in collection efforts to recover such amounts from you.
Airbnb Payments will deem any owed amounts overdue when: (a) for authorized charges, one hundred and twenty (120) days have elapsed after Airbnb Payments first attempts to charge or debit your Payment Method or the associated services have been provided, whichever is later; and (b) for withholdings from a Host’s future Payouts, two hundred and seventy (270) days have elapsed after the adjustment is made to the Host’s Airbnb account or the associated services have been provided, whichever is later.
Airbnb Payments will deem any overdue amounts not collected to be in default when three hundred and sixty five (365) days have elapsed: (a) for authorized charges or debits, after Airbnb Payments first attempts to charge or debit your Payment Method or the associated services have been provided, whichever is later; and (b) for withholdings from a Host’s future Payouts, after the adjustment is made to the Host’s Airbnb account or the associated services have been provided, whichever is later.
You hereby explicitly agree that all communications in relation to amounts owed will be made by electronic mail or by phone, as provided to Airbnb and/or Airbnb Payments by you. Such communications may be made by Airbnb, Airbnb Payments, or by anyone on their behalf, including but not limited to a third-party collection agent.
Airbnb Payments will take the necessary steps to rectify any payment processing errors that we become aware of. These steps may include crediting or debiting (as appropriate) the original Payout Method or Payment Method used or selected by you, so that you end up receiving or paying the correct amount. This may be performed by Airbnb Payments or a third party such as your financial institution. We may also take steps to recover funds sent to you in error (including but not limited to an event of duplicate payments made to you due to a processing error), by reducing, deducting and/or debiting the amount of such funds from any future Payouts owed to you.
To the extent you receive any funds in error, you agree to immediately return such funds to Airbnb Payments.
Any refunds or credits due to a Member pursuant to the Terms, Major Disruptive Events Policy, Rebooking and Refund Policy, and Experiences Guest Refund Policy will be initiated and remitted by Airbnb Payments in accordance with these Payments Terms.
Subject to this Section 5.5.2, Airbnb Payments will initiate the refund process promptly. In case of a cancellation by Host, Airbnb Payments will hold the funds for up to 72 hours until the Guest is either refunded or the Guest directs Airbnb to use the funds to rebook with another Host. In certain instances, the refund process may include the option to receive credit in lieu of a cash refund; if this option is made available to you, the timing of your refund will be communicated via the Airbnb Platform. The time it takes to receive any cash refund or for any pre-authorization of your Payment Method to be released will vary based on the Payment Method and any applicable payment system (e.g., Visa, Mastercard, etc.) rules. In the event of a Force Majeure Event that may affect the processing and settlement of refunds, Airbnb Payments will initiate and process the refund as soon as is practicable.
If you are responsible for Damage Report amounts, pursuant to Section 15 of the Terms, Airbnb via Airbnb Payments may charge the Payment Method used to make the booking or any other payment method on file in your Airbnb account at the time of the Damage Report or reasonably thereafter in order to collect Damage Report amounts, up to a maximum amount as defined in Section 15 of the Terms. To facilitate this charge, when you book a Listing, you are agreeing that Airbnb via Airbnb Payments may charge the Payment Method used to book the Listing in order to collect Damage Report amounts.
You agree that Airbnb Payments may seek to recover from you under any insurance policies you maintain and that Airbnb Payments may also pursue against you any remedies it may have available, including, but not limited to, referral to a collections agency, or pursuit of causes of action or claims against you, including in relation to a Damage Report, or payment requests made by Hosts under the Host Damage Protection.
If Airbnb Payments holds funds due to you (e.g., because we are unable to issue you a Payout or refund) or you do not use a gift card or gift credit for the relevant period of time set forth by your state, country, or other governing body in its unclaimed property laws, we may process the funds due to you in accordance with our legal obligations, including by reporting and escheating (sending) such funds to the appropriate governing body as required by applicable unclaimed property laws.
You are solely responsible for compliance with any and all laws, rules, regulations, and tax obligations that may apply to your use of the Payment Services. In connection with your use of the Payment Services, you may not and you agree that you will not and will not assist or enable others to:
We are required to act in accordance with our internal policies and the laws of various jurisdictions relating to the prevention of money laundering and the implementation of sanctions including: (i) economic or financial sanctions or trade embargoes imposed, administered or enforced from time to time by the U.S. government, including those administered by the Office of Foreign Asset Control or the U.S. Department of State; or (ii) by the United Nations Security Council, the European Union or His Majesty's Treasury of the United Kingdom. You will comply with any relevant financial sanctions and any relevant export control laws applicable to you and to your local jurisdiction.
Airbnb Payments shall not be liable for any delay or failure to fulfill any obligation under these Payments Terms resulting from abnormal or unforeseeable circumstances outside the reasonable control of Airbnb or Airbnb Payments, the consequences of which would have been unavoidable despite all efforts to the contrary, including, but not limited to, acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics or disease, strikes or shortages of transportation facilities, fuel, energy, labor or materials (“Force Majeure Event”).
If you choose to use the Payment Services, you do so voluntarily and at your sole risk. To the maximum extent permitted by law, the Payment Services are provided “as is”, without warranty of any kind, either express or implied.
Notwithstanding Airbnb Payments’ appointment as the limited payment collection agent of Hosts pursuant to Section 4, Airbnb Payments explicitly disclaims all liability for any act or omission of any Member or other third party. Airbnb Payments does not have any duties or obligations as agent for each Host except to the extent expressly set forth in these Payments Terms, and any additional duties or obligations as may be implied by law are, to the maximum extent permitted by applicable law, expressly excluded.
If we choose to conduct identity verification on any Member, to the extent permitted by applicable law, we disclaim warranties of any kind, either express or implied, that such checks will identify prior misconduct by a Member or guarantee that a Member will not engage in misconduct in the future.
The foregoing disclaimers apply to the maximum extent permitted by law. You may have other statutory rights or warranties which cannot lawfully be excluded. However, the duration of any statutorily required warranties shall be limited to the maximum extent (if any) permitted by law.
You acknowledge and agree that, to the maximum extent permitted by law, the entire risk arising out of your access to and use of the Payment Services remains with you. If you permit or authorize another person to use your Airbnb account in any way, you are responsible for the actions taken by that person. Neither Airbnb Payments nor any other party involved in creating, producing, or delivering the Payment Services will be liable for any incidental, special, exemplary, or consequential damages, including lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services, or for any damages for personal or bodily injury or emotional distress arising out of or in connection with (i) these Payments Terms, (ii) from the use of or inability to use the Payment Services, or (iii) from any communications, interactions, or meetings with other Members or other persons with whom you communicate, interact, transact, or meet with as a result of your use of the Payment Services, whether based on warranty, contract, tort (including negligence), product liability, or any other legal theory, and whether or not Airbnb Payments has been informed of the possibility of such damage, even if a limited remedy set forth herein is found to have failed of its essential purpose. Except for our obligations to pay amounts to applicable Hosts pursuant to these Payments Terms or an approved payment request under the Host Damage Protection or Japan Host Insurance, in no event will Airbnb Payments’ aggregate liability arising out of or in connection with these Payments Terms and your use of the Payment Services including, but not limited to, from your use of or inability to use the Payment Services, exceed (i) the amounts you have paid or owe for bookings via the Airbnb Platform as a Guest in the twelve (12) month period prior to the event giving rise to the liability, or if you are a Host, the amounts paid by Airbnb Payments to you in the twelve (12) month period prior to the event giving rise to the liability, or (ii) one hundred U.S. dollars (US$100), if no such payments have been made, as applicable. The limitations of damages set forth above are fundamental elements of the basis of the bargain between Airbnb Payments and you. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you. If you reside outside of the U.S., this does not affect Airbnb Payments’ liability for death or personal injury arising from its negligence, nor for fraudulent misrepresentation, misrepresentation as to a fundamental matter, or any other liability which cannot be excluded or limited under applicable law.
To the maximum extent permitted by applicable law, you agree to release, defend (at Airbnb Payments’ option), indemnify, and hold Airbnb Payments and its affiliates and subsidiaries, and their officers, directors, employees, and agents, harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (i) your breach of these Payments Terms; (ii) your improper use of the Payment Services; (iii) your failure, or our failure at your direction, to accurately report, collect or remit taxes; or (iv) your breach of any laws, regulations, or third-party rights.
Except as otherwise required by applicable law, Airbnb Payments may modify these Payments Terms at any time. If we make material changes to these Payment Terms, we will post the revised Payment Terms on the Airbnb Platform and update the “Last Updated” date at the top of these Payment Terms. If you are affected by the modification, we will also provide you with notice of the modifications at least thirty (30) days before the date they become effective. If you are contracting with Airbnb Payments UK, you will receive at least two (2) months advance notice. If you do not terminate your agreement before the date the revised Payment Terms become effective, your continued use of the Payment Services will constitute acceptance of any changes to the revised Payments Terms.
This agreement between you and Airbnb Payments is effective (i) if you are a Guest, from when you make your first booking, or (ii) if you are a Host, from when a Guest first books a Listing made available by you and you use the Payment Services, and remains in effect until either you or we terminate this agreement in accordance with Section 13.3.
You may terminate this agreement at any time by sending us an email or by deleting your Airbnb account. Terminating this agreement will also serve as notice to cancel your Airbnb account pursuant to the Terms. Without limiting our rights specified below, Airbnb Payments may terminate this agreement for convenience at any time by giving you thirty (30) days' notice via email to your registered email address (or ninety (90) days’ prior notice for Members contracting with Airbnb Payments UK). Airbnb Payments may also terminate this agreement immediately without notice if (i) you have materially breached your obligations under this agreement; (ii) you have provided inaccurate, fraudulent, outdated, or incomplete information; (iii) you have violated applicable laws, regulations, or third-party rights; or (iv) Airbnb Payments believes in good faith that such action is reasonably necessary to protect other Members, Airbnb, Airbnb Payments, or third parties.
Airbnb Payments may limit or temporarily or permanently suspend your use of or access to the Payment Services (i) to comply with applicable law, or the order or request of a court, law enforcement, or other administrative agency or governmental body, (ii) if you have breached these Payments Terms, the Terms, applicable laws, regulations or third-party rights, (iii) if you have provided inaccurate, fraudulent, outdated, or incomplete information regarding a Payment Method or Payout Method, (iv) for any amounts you owe under these Payments Term that are overdue or in default, or (v) if Airbnb Payments believes in good faith that such action is reasonably necessary to protect the personal safety or property of Airbnb, its Members, Airbnb Payments, or third parties, or to prevent fraud or other illegal activity. Further, for unsuccessful payment due to card expiration, insufficient funds, or otherwise, we may temporarily suspend your access to the Payment Services until we can charge a valid Payment Method
If Airbnb Payments takes any of the measures described in Section 13.3 and 13.4 you may appeal such a decision by contacting customer service.
If you cancel your Airbnb account as a Host or Airbnb Payments takes any of the measures described above, Airbnb Payments may provide a full refund to any Guests with confirmed booking(s), and you will not be entitled to any compensation for pending or confirmed bookings that were cancelled. If you cancel your Airbnb account as a Guest, Airbnb Payments will initiate a refund for any confirmed booking(s) based on the Listing’s cancellation policy. If your access to or use of the Payment Services has been suspended or limited or this agreement has been terminated by us, you may not register a new Airbnb account or attempt to access and use the Payment Services through an Airbnb account of another Member.
Sections 5 through 20 of these Payments Terms shall survive any termination or expiration of this agreement.
If you are contracting with Airbnb Payments US, these Payments Terms will be interpreted in accordance with the laws of the State of California and the United States of America, without regard to conflict-of-law provisions. Legal proceedings (other than small claims actions) that are excluded from the Arbitration Agreement in Section 15 must be brought in state or federal court in San Francisco, California, unless we both agree to some other location. You and we both consent to venue and personal jurisdiction in San Francisco, California.
If you are contracting with Airbnb Payments UK, these Payments Terms will be interpreted in accordance with English law. If you are acting as an individual consumer and if mandatory statutory consumer protection regulations in your country of residence contain provisions that are more beneficial for you, such provisions shall apply irrespective of the choice of English law. As an individual consumer, you may bring any judicial proceedings relating to these Payments Terms before the competent court of your place of residence or a competent court in England. If Airbnb wishes to enforce any of its rights against you as a consumer, we may do so only in the courts of the jurisdiction in which you are a resident. If you are acting as a business, you agree to submit to the exclusive jurisdiction of the English courts.
If you are contracting with Airbnb Payments India, these Payments Terms will be interpreted in accordance with the laws of India. Any dispute arising from or in connection with these Payments Terms must be submitted to the International Chamber of Commerce (“ICC”) for arbitration in New Delhi, which shall be the seat and venue of arbitration. Such arbitration shall be conducted in accordance with the arbitration rules of the ICC in effect at the time of applying for arbitration, provided that this section shall not be construed to limit any rights which Airbnb Payments may have to apply to any court of competent jurisdiction for an order requiring you to perform or be prohibited from performing certain acts and other provisional relief permitted under the laws of India or any other laws that may apply to you. In the event one or more of the parties to the dispute are non-resident, the parties agree to exclude (for the avoidance of any doubt) the applicability of the provisions of Part I (save and except Section 9, Section 27, Section 37(1)(a) and Section 37(3) thereof) of the Indian Arbitration and Conciliation Act 1996 to any arbitration under this section. The arbitration proceedings shall be conducted in English. The arbitral award rendered is final and binding upon both parties. Each party shall bear its own costs in relation to the arbitration.
If you are contracting with Airbnb Brazil, these Payments Terms will be interpreted in accordance with the laws of Brazil. If you are acting as a consumer, judicial proceedings that you are able to bring against us arising from or in connection with these Payments Terms may only be brought in a court located in the city of Sao Paulo, State of Sao Paulo, Brazil or in a court with jurisdiction in your place of residence. If you are acting as a business, you agree to submit to the exclusive jurisdiction of a court located in the city of Sao Paulo, State of Sao Paulo, Brazil.
PLEASE READ THE FOLLOWING PARAGRAPHS CAREFULLY BECAUSE THEY PROVIDE THAT YOU AND AIRBNB PAYMENTS AGREE TO RESOLVE ALL DISPUTES BETWEEN US THROUGH BINDING INDIVIDUAL ARBITRATION AND INCLUDE A CLASS ACTION WAIVER AND JURY TRIAL WAIVER. This Arbitration Agreement supersedes all prior versions.
This Arbitration Agreement only applies to you if you are contracting with Airbnb Payment US. If you are not contracting with Airbnb Payments US, and you nevertheless attempt to bring any legal claim against Airbnb Payments in the United States, this Arbitration Agreement will apply for determination of the threshold issue of whether this Section 15 applies to you, and all other threshold determinations, including residency, arbitrability, venue, and applicable law.
Airbnb Payments is committed to participating in a consumer-friendly dispute resolution process. To that end, these Payment Terms provide for a two-part process for individuals to whom this Section 15 applies: (1) an informal negotiation directly with Airbnb’s customer service team (described in Section 15.3), and if necessary (2) a binding arbitration in accordance with the terms of this Arbitration Agreement. You and Airbnb Payments each retain the right to seek resolution of the dispute in small claims court as an alternative to arbitration
At least 30 days prior to initiating an arbitration, you and Airbnb Payments each agree to send the other party an individualized notice of the dispute in writing (“Pre-Dispute Notice”) and attempt in good faith to negotiate an informal resolution of an individual claim. You must send your Pre-Dispute Notice of dispute to Airbnb Payments by mailing it to Airbnb Payments’ agent for service: CSC Lawyers Incorporating Service, 2710 Gateway Oaks Drive, Suite 150N, Sacramento, California 95833. Airbnb Payments will send its Pre-Dispute Notice to the email address associated with your Airbnb account. A Pre-Dispute Notice must include: the date, your name, mailing address, your Airbnb username, the email address you used to set up your Airbnb account, your signature, a brief description of the dispute, and the relief sought. If the parties are unable to resolve the dispute within the 30-day period, only then may either party commence arbitration by filing a written demand for arbitration with the arbitration provider designated pursuant to Section 15.6, below. A claimant’s Pre-Dispute Notice requirement is a prerequisite to any arbitration, and a copy of the Pre-Dispute Notice and evidence that it was sent as required by this Section must be attached to any arbitration demand.
You and Airbnb Payments mutually agree that any dispute, claim or controversy arising out of or relating to these Payments Terms or the applicability, breach, termination, validity, enforcement or interpretation thereof, or any use of the Payment Services (collectively, “Disputes”) will be settled by binding individual arbitration on an individual basis (the “Arbitration Agreement”). If there is a dispute about whether this Arbitration Agreement can be enforced or applies to our Dispute, you and Airbnb Payments agree that the arbitrator will decide that issue. For the avoidance of doubt, you and Airbnb agree that any question regarding arbitrability and the formation, enforceability, validity, scope, or interpretation of all or part of this Section 15, including any dispute over compliance with the Pre-Dispute Notice requirement and a party’s responsibility to pay arbitration fees, shall be resolved by an arbitrator.
You and Airbnb Payments each agree that the following causes of action and/or claims for relief are exceptions to the Arbitration Agreement and will be brought in a judicial proceeding in a court of competent jurisdiction (as defined by Section 15): (i) any claim or cause of action seeking emergency injunctive relief based on exigent circumstances (e.g., imminent danger or commission of a crime, hacking, cyber-attack); (ii) a request for the remedy of public injunctive relief; (iii) any claim or cause of action for vexatious litigation; or (iv) any individual claim of sexual assault or sexual harassment arising from your use of the Airbnb Platform or Host Services. You and Airbnb Payments agree that any request for the remedy of public injunctive relief will proceed after the arbitration of all arbitrable claims, remedies, or causes of action, and will be stayed pending the outcome of the arbitration pursuant to section 3 of the Federal Arbitration Act.
This Arbitration Agreement evidences a transaction in interstate commerce and the Federal Arbitration Act governs all substantive and procedural interpretation and enforcement of this Arbitration Agreement, and not state law. The arbitration will be administered by ADR Services, Inc. (“ADR”) (www.adrservices.com) in accordance with Rules 1, 6–7, 8–9, and 11–12, 45, 54, and 56 of the Federal Rules of Civil Procedure (“Selected Federal Rules") (https://www.uscourts.gov/rules-policies/current-rules-practice-procedure/federal-rules-civil-procedure) and ADR’s Arbitration Rules then in effect (the “ADR Rules”), except as the Selected Federal Rules or ADR Rules are modified by or conflict with this Arbitration Agreement. The ADR Rules are available at www.adrservices.com. If an arbitration demand is submitted to ADR Services in accordance with this agreement and the ADR Rules, and ADR Services cannot or will not administer the arbitration, the arbitration will be administered by the American Arbitration Association (“AAA”) in accordance with the Selected Federal Rules and the AAA’s Consumer Arbitration Rules (the “AAA Rules”) then in effect, except as modified here. The AAA Rules are available at www.adr.org. If the AAA cannot and will not administer the arbitration, you and Airbnb Payments shall confer and select an alternative arbitral forum, and if we are unable to agree, either you or Airbnb Payments may ask a court to appoint an arbitrator pursuant to 9 U.S.C. § 5. In that event, the arbitration will be conducted in accordance with the rules of the appointed arbitral forum, unless those rules are inconsistent with the provisions of this Arbitration Agreement.
In order to make the arbitration most cost-effective, efficient, and convenient to you, any required arbitration hearing in an arbitration wherein the amount in controversy does not exceed $1,000,000 shall be conducted remotely via video conference except as otherwise agreed by the parties or instructed by the arbitrator. Any required arbitration hearing in an arbitration wherein the amount in controversy exceeds $1,000,000 shall be conducted in San Francisco County except as otherwise agreed by the parties or instructed by the arbitrator. If the amount in controversy is $10,000 or less, the parties agree to proceed solely on the submission of documents to the arbitrator, provided that the arbitrator has discretion to decide to hold a hearing in response to the reasonable and proportionate request from a party.
Your arbitration fees and your share of arbitrator compensation shall be governed by the ADR Rules. and the ADR Services fee schedule (available at www.adrservices.com). If you have a gross monthly income of less than 300% of the federal poverty guidelines, you are entitled to a waiver of arbitration fees and costs, exclusive of arbitrator fees. You may request a fee waiver by providing the arbitration provider with a declaration under oath stating your monthly income and the number of persons in your household. If a fee waiver is granted by the arbitration provider and you provide Airbnb Payments with documents necessary to prove that your gross monthly income is less than 300% of the federal poverty guidelines, Airbnb Payments will pay your share of any arbitrator fees.
Either party may make a request that the arbitrator impose sanctions upon proving that the other party or its attorney(s) has asserted a claim or defense that is groundless in fact or law, brought in bad faith or for the purpose of harassment, or is otherwise frivolous., As allowed by applicable law and the AAA Rules the arbitrator shall impose sanctions equal to the requesting party’s reasonable attorneys’ fees and costs upon finding that a claim or defense is groundless in fact or law, brought in bad faith or for the purpose of harassment, asserted in violation of Fed. R. Civ. P. 11(b) (treating the arbitrator as “the court”), or is otherwise frivolous. Either party may seek dismissal of any arbitration filed in violation of any provision of this Arbitration Agreement. Either party may assert in arbitration a counterclaim for the other party’s initiation of proceedings concerning an arbitrable Dispute without complying with or otherwise in violation of the requirements of this Arbitration Agreement. Upon finding that a party has initiated proceedings concerning an arbitrable Dispute without complying with or otherwise in violation of the requirements of this Arbitration Agreement, the arbitrator shall award the other party its actual damages, including but not limited to reasonable attorneys’ fees and costs.
The arbitrator will issue a written decision which shall include the essential findings and conclusions upon which the arbitrator based the award. Judgment on the arbitration award may be entered in any court with proper jurisdiction. The arbitrator may award any relief allowed by law or the AAA Rules, but declaratory or injunctive relief may be awarded only on an individual basis and only to the extent necessary to provide relief warranted by the claimant’s individual claim.
You and Airbnb Payments acknowledge and agree that both parties are each waiving the right to a trial by jury as to all arbitrable Disputes.
You and Airbnb Payments acknowledge and agree that, to the fullest extent permitted by law, we are each waiving the right to participate as a plaintiff or class member in any purported class action lawsuit, class-wide arbitration, private attorney general action, or any other representative or consolidated proceeding. Unless we agree in writing or as provided in this agreement, the arbitrator may not consolidate more than one party’s claims and may not otherwise preside over any form of any class or representative proceeding. If there is a final judicial determination that applicable law precludes enforcement of the waiver contained in this paragraph as to any claim, cause of action or requested remedy, then that claim, cause of action or requested remedy, and only that claim, cause of action or requested remedy, will be severed from this agreement to arbitrate and will be brought in a court of competent jurisdiction. In the event that a claim, cause of action or requested remedy is severed pursuant to this paragraph, then you and we agree that the claims, causes of action or requested remedies that are not subject to arbitration will be stayed until all arbitrable claims, causes of action and requested remedies are resolved by the arbitrator.
You and Airbnb Payments acknowledge and agree that the relative benefits and efficiencies of arbitration may be lost when 100 or more arbitration claims are filed within 180 days which (1) involve the same or similarly situated parties; (2) are based on the same or similar claims which arise from the same or substantially identical transactions, incidents, alleged violations or events requiring the determination of the same or substantially identical questions of law or fact; and (3) involve the same or coordinated counsel for the parties (“Mass Action”). Accordingly, you and Airbnb Payments agree to waive the right to have any Dispute administered, arbitrated, or resolved as part of a Mass Action (though Sections 15 and 15.12 of these Terms will continue to apply to the Dispute). In case of a dispute, the appointed arbitrator for the first matter instituted within a set of claims identified by either party shall decide whether those claims are part of a Mass Action. If no arbitrator has yet been appointed, an arbitrator shall be appointed solely to determine whether claims identified by either party are part of a Mass Action. Nothing in this provision prevents you or Airbnb Payments from participating in a mass settlement of claims.
If for any reason, notwithstanding Section 15.13, an arbitration proceeds as part of a Mass Action, the parties shall group the arbitration demands into batches of no more than 200. The batches shall be determined by listing the claimants’ alphabetically (by last name or business name, as applicable)—for example, the first 200 claimants listed will be the first batch, the next 200 claimants listed will be the second batch, and so forth. The parties shall randomly assign each batch a sequential number and arbitrate the batches one at a time, in sequential order. While one batch is being arbitrated, the arbitration provider shall hold the remainder in abeyance unless otherwise agreed by the parties or instructed by the arbitration provider. Each batch shall be resolved within 240 days of the pre-hearing conference for that batch. Notwithstanding the forgoing, if any claimant’s demand has not been the subject of a pre-hearing conference within 2 years of the latest-filed demand in the Mass Action, such claimant may elect to pursue the claims asserted in the claimant’s demand in court subject to Sections 14 and 15.12 of these Terms.
At least 10 days before the date set for the arbitration hearing, you or Airbnb Payments may serve a written offer of judgment on the other party to allow judgment on specified terms. If the offer is accepted, the offer with proof of acceptance shall be submitted to the arbitration provider, who shall issue an award accordingly. If the offer is not accepted prior to the arbitration hearing or within 30 days after it is made, whichever occurs first, it shall be deemed withdrawn and cannot be given as evidence in the arbitration, other than with respect to costs (including all fees paid to the arbitration provider). If an offer made by one party is not accepted by the other party, and the other party fails to obtain a more favorable award, the other party shall not recover their post-offer costs and shall pay the offering party’s costs (including all fees paid to the arbitration provider) from the time of the offer.
Except as provided in Section 15.12, in the event that any portion of this Arbitration Agreement is deemed illegal or unenforceable, such provision shall be severed and the remainder of the Arbitration Agreement will be given full force and effect.
If Airbnb Payments amends this Section 15 after the date you last accepted these Payments Terms (or accepted any subsequent changes to these Payments Terms), you may reject the change by sending us written notice no later than thirty (30) days of the date the change is effective. Your notice must include your name, mailing address, the date of the notice, your Airbnb username, the email address you used to set up your Airbnb account, your signature, and an unequivocal statement that you want to opt out of the amended Section 15. You must either mail your notice to this address: 888 Brannan St, San Francisco, CA 94103, Attn: Arbitration Opt-Out, or email the opt-out notice to arbitration.opt.out@airbnb.com. Rejecting a new change, however, does not revoke or alter your prior consent to any earlier agreements to arbitrate any Dispute between you and Airbnb Payments (or your prior consent to any subsequent changes thereto), which will remain in effect and enforceable as to any Dispute between you and Airbnb Payments.
Except as provided in Section 15.16 and subject to Section 13.7, this Section 15 will survive any termination of these Payments Terms and will continue to apply even if you stop using the Payment Services or terminate your Airbnb account.
Except as they may be supplemented by additional terms and conditions, policies, guidelines, or standards, these Payments Terms constitute the entire agreement between Airbnb Payments and you regarding the subject matter hereof, and supersede any and all prior oral or written understandings or agreements between Airbnb Payments and you regarding the Payment Services. If any provision of these Payments Terms is held to be invalid or unenforceable, such provision will be struck and will not affect the validity and enforceability of the remaining provisions.
Airbnb Payments’ failure to enforce any right or provision in these Payments Terms will not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing. Except as expressly set forth in these Payments Terms, the exercise by either party of any of its remedies under these Payments Terms will be without prejudice to its other remedies under these Payments Terms or otherwise permitted under law.
You may not assign, transfer, or delegate this agreement or your rights and obligations hereunder without Airbnb Payments’ prior written consent. Airbnb Payments may without restriction assign, transfer, or delegate this agreement and any rights and obligations, at its sole discretion, with thirty (30) days’ prior notice (or two (2) months’ prior notice for Members contracting with Airbnb Payments UK).
Unless specified otherwise, any notices or other communications permitted or required under this agreement, will be in writing and given by Airbnb Payments via email or Airbnb Platform notification, and depending on your notification setting, messaging service (including SMS and WeChat). The date of receipt will be deemed the date on which Airbnb Payments transmits the notice.
The following paragraphs will apply if you are contracting with Airbnb Payments UK. To the extent that there is any conflict between this Section 17 and any other provisions of these Payment Terms, the provisions of this Section 17 shall apply.
The Payment Services include the payment collection service provided to Hosts contracting with Airbnb Payments UK. The payment collection service constitutes a “payment service” regulated under the Payment Services Regulations and for these purposes Airbnb Payments UK treats Hosts as the “payment service user.”
By agreeing to these Payments Terms you as a Host have consented to Airbnb Payments UK’s payment of each Payout to your chosen Payout Method. Hosts may change a Payout Method up to one (1) day before the time agreed for the Payout as set out in Section 3.3. Airbnb Payments UK will be deemed to have received the Host's payment order to the Host on the same date Airbnb Payments UK agrees to initiate the Payout in accordance with Section 3.3
Airbnb Payments UK will endeavor to ensure that Hosts based in the UK will receive each Payout by the end of the business day following Airbnb Payments UK’s initiation of the Payout.
Communication. Airbnb Payments will provide the Host notice via email when we initiate each Payout. We will also provide notice to a Host’s registered email address if the Payout is returned to us because of an error. It is your responsibility as a Host to ensure that you provide us with a current, accurate, and valid email address.
If you as a Host believe or become aware that a Payout properly due to you has been or may be diverted without your authorization (“Diverted Payout”) because your password or other credentials to log into your Airbnb account (“Credentials”) have been lost or stolen or misappropriated, you should notify Airbnb Payments UK (see Section 20 for details on how) without undue delay on becoming aware of the loss, theft, or misappropriation of your Credentials or of the unauthorized use of your Credentials or access to your Airbnb account.
If you as Host claim not to have received a Payout properly due to you via your chosen Payout Method (including where there has been a Diverted Payout), Airbnb Payments UK will (if requested by you without undue delay, on becoming aware of the unauthorised or incorrectly executed Payout and in any event within 13 months of it happening) make immediate efforts to trace the payment and will notify you of the outcome. Subject to Section 17.2.3, unless we can prove that (i) the Payout was received by you via your chosen Payout Method, or (ii) we made the Payout correctly using the Payout Method information you provided but the information you provided was incorrect, we will refund the amount. Where you have given us incorrect information we will not be liable for the defective or non-execution of the Payout, however, we will make reasonable efforts to recover the Payout funds.
You must use your Credentials in accordance with these Payment Terms and take all reasonable steps to keep your Credentials safe. As a Host you may be liable for losses relating to any Diverted Payout arising from the use of lost, stolen, or misappropriated Credentials including the loss of a mobile phone on which you have installed the Application or where you have failed to keep your Credentials safe, up to a maximum of £35. This will not apply if the loss, theft or misappropriation of your Credentials was not detectable by you prior to the Payout, unless you acted fraudulently or the loss was caused by acts or omissions of Airbnb personnel or a service provider. You may, however, be liable for all losses relating to a Diverted Payout if we can show that you acted fraudulently or where, with intent or gross negligence, you failed to use the Airbnb Platform and/or Payment Services in accordance with the Terms or these Payment Terms (including the obligation to keep your Credentials safe). Except where you have acted fraudulently, you will not be liable for any losses incurred in respect of a Diverted Payout arising after notification by you of the loss, theft, or misappropriation of your Credentials or of the unauthorized use of your Credentials, where we have failed at any time to provide appropriate means for such notification, or where we do not require strong customer authentication, where required.
Any complaints about the Payment Services should be made to Airbnb Payments UK (see Section 20 for details on how). If you are not happy with the outcome of a complaint and you as a Host have received regulated Payment Services from Airbnb Payments, UK, you may also be able to refer your complaint to the Financial Ombudsman. All complaints to the Financial Ombudsman Service are subject to the rules of the Financial Ombudsman Service, including in relation to eligibility requirements. The UK Financial Ombudsman Service offers a free complaints resolution service to individuals, micro-enterprises, small charities, and trustees of small trusts. You may obtain further information regarding the Financial Ombudsman Services and contact details at: http://www.financial-ombudsman.
If Mexico is your country of residence, (i) upon successful receipt of payment from the Guest following a Host's acceptance of the Guest’s booking request, Airbnb Payments generally holds such funds due to the Host in temporary custody until it is released to the Host in accordance with Section 3.3.1, and (ii) the payment to the Host will be effective only upon the start of the Host's Services and in accordance with Section 3.3.1. Airbnb may be required to withhold taxes per applicable local laws, and such taxes will be due upon Airbnb Payment’s release of the Host Payout.
The Host acknowledges that Airbnb Payments is acting as a payments collection agent solely for the limited purpose of accepting and processing funds from Guests purchasing Host Services and paying any applicable taxes due in Mexico, including VAT, on the Host’s behalf.
The following paragraph will apply if you are contracting with Airbnb Brazil:
Section 2, “Guest Terms”, shall be amended by adding the following subsection: “You acknowledge that if your country of residence is Brazil and you are paying by credit card, you may pay for your booking in multiple installments as long as your credit card supports installments and is issued in Brazil. The number of installments may vary, but will be presented to you before you complete your booking transaction. You acknowledge that the Total Price may be increased when you choose to pay for your booking in installments as a result of expenses related to the use of credit card and/or other forms of installment plans (“Installment Fee”). You agree that you are solely responsible for the payment of the Installment Fee, and Airbnb Brazil is only responsible for collecting and transferring those amounts to the applicable third-party payment service provider. You authorize the applicable third-party payment service provider to automatically charge the original Payment Method you used to make the booking.. Your use of the installment feature may be subject to additional terms and conditions imposed by the applicable third-party payment service provider. If your booking is canceled for any reason, the Installment Fee will be refunded to the Payment Method you used to make the booking. If you make a modification to a booking payable in installments, and the Booking Modification lowers your Total Price, you will not be refunded any portion of the Installment Fee. Refunds will be initiated and remitted by Airbnb Payments in accordance with these Payments Terms.”
Depending on the country of residence of guests and hosts, payments due to hosts and applicable fees like Airbnb service fees may require the execution of foreign exchange agreements or other related measures, as per applicable legislation.
If you are a resident in Brazil and make a booking with a Host residing outside of Brazil using local currency, by using the Payment Services you acknowledge and agree that Airbnb Brazil acts as a payment collection agent of the Host residing outside of Brazil. Airbnb Brazil is also the entity with whom you are contracting for the use of the Airbnb Platform, as set forth in the Terms.
You authorize Airbnb Brazil, directly or through third parties, to make any inquiries we consider necessary to verify your identity. This may include (i) screening you against third-party databases or other sources, (ii) requesting reports from service providers, (iii) asking you to provide a form of government identification (e.g., driver’s license or passport), tax ID, your date of birth, your address, and other information; or (iv) requiring you to take steps to confirm ownership of your email address, Payment Method(s) or Payout Method(s). Airbnb Brazil reserves the right to terminate, suspend, or limit access to the Payment Services in the event we are unable to obtain or verify any of this information.
When processing payments from a Member, Airbnb Brazil (and/or third parties contracted by you or by Airbnb Brazil on your behalf) may retain and/or report to the competent authorities (when applicable) information relating to the Member and/or the respective transaction to comply with applicable legislation and certain regulatory controls, and prevention of money laundering activities.
For transactions above $10,000, Guests hereby appoint Airbnb Brazil as their attorney-in-fact to enter into foreign exchange transactions with institutions to remit or receive any funds from Guests’ purchases of Host Services. Guests also authorize Airbnb Brazil to delegate, in whole or in part, the powers granted herein.
For Guests and Hosts contracting with Airbnb Brazil, all references in this Payments Terms to Airbnb, Airbnb Payments or Airbnb Platform shall be deemed to refer to Airbnb Brazil.
The following paragraphs also apply if you are using the Payment Services as a representative (“Representative”) acting on behalf a business, company or other legal entity (in such event, for purposes of the Payments Terms, “you” and “your” will refer and apply to that business, company or other legal entity).
You accept the Payment Terms and you will be responsible for any act or omission of employees or third-party agents using the Payment Service on your behalf.
You and your Representative individually affirm that you are authorized to provide the information described in Section 2.1 and Section 3.2 and your Representative has the authority to bind you to these Payments Terms. We may require you to provide additional information or documentation demonstrating your Representative’s authority.
You represent and warrant to us that: (i) you are duly organized, validly existing and in good standing under the laws of the country in which your business is registered and that you are registering for receiving the Payment Services; and (ii) you have all requisite right, power, and authority to enter into this agreement, perform your obligations, and grant the rights, licenses, and authorizations in this agreement.
If you are using your Payment Method for the benefit of your employees or other authorized third-party in connection with Airbnb for Work, as permitted by your account, you authorize Airbnb Payments to charge your Payment Method for bookings requested by employees at your company or other permitted third-party.
For any Payout Method linked to your Airbnb account, you authorize Airbnb Payments to store the Payout Method, remit payments using the Payout Method for bookings associated with your Airbnb account and take any other action as permitted in the Payments Terms in respect of the Payout Method.
If you handle, store or otherwise process payment card information on behalf of anyone or any third-party, you agree to comply on an ongoing basis with applicable data privacy and security requirements under the current Payment Card Industry Data Security Standard with regards to the use, access, and storage of such credit card information. If your country of residence or establishment is within Australia, these Payments Terms for Australian Users (“Payments Terms”) are subject to the Australian Consumer Law. Our services come with guarantees that cannot be excluded under the Australian Consumer Law and other Australian laws. These Payments Terms (including clauses 10.1, 10.2, 11 and 12) apply to the maximum extent permitted by Australian law, including the Australian Consumer Law.
If you attempt to bring any legal claim against Airbnb Payments in the United States, the arbitration agreement and class actions waiver in Section 15 apply to you. Please read them carefully.
The Airbnb Terms of Service (“Terms”) govern your use of the Airbnb Platform. Capitalized terms not defined in these Payments Terms have the meaning ascribed to them in the Terms.

These Payments Terms and the documents, policies and standards referred within them, form a binding legal agreement between you and Airbnb Payments that govern the Payment Services (defined below) conducted through or in connection with the Airbnb Platform.

However, it is important to note that there are other supplemental policies and terms linked from our Additional Legal Terms page, which apply to your use of the Airbnb Platform, and are incorporated by reference, and also form part of the binding legal agreement between you and Airbnb.
Our terms and policies are organized based on the topic(s) to which they relate so as to make it easy for you to find the terms or policy relevant to your query or event.
When these Payments Terms mention “Airbnb Payments,” “we,” “us,” or “our,” it refers to:
Airbnb Payments UK Ltd. (“Airbnb Payments UK”), except when you book a Host Service, in which case you are contracting with Airbnb Payments Australia Pty Ltd (“Airbnb Payments Australia”).
Airbnb Payments provides payments services to Members publishing, offering and booking Accommodations, Experiences or other Host Services, including services in connection with Airbnb.org and other current and future services provided via the Airbnb Platform. These payment services are provided for the benefit of Hosts and may include (if available) the following (collectively, “Payment Services”):
Airbnb Payments provides regulated Payment Services only to Hosts as the Host’s limited payment collection agent by accepting and processing funds from Guests purchasing Host Services on the Host’s behalf.
In order to use the Payment Services, you must be at least 18 years old, must have an Airbnb account in good standing in accordance with the Terms, and must keep your payment and personal information accurate and complete and provide us with identity and other information as requested by us.
If you change your country of residence, the Airbnb company you contract with and the applicable version of the Payments Terms will be determined by your new country of residence from the date on which your country of residence changes. By continuing to use the Payment Services after your change of country of residence, you agree to such change of contracting party and terms. Please note, however, that the Airbnb Payments company with whom you contract will stay the same for all bookings made prior to your change of residence.
By using the Payments Services, you agree to comply with these Payments Terms. Airbnb Payments may temporarily limit or suspend your access to or use of the Payment Services, or its features, to carry out maintenance measures that ensure the proper functioning of the Payment Services.
The Payment Services may contain links to third-party websites or resources (“Third-Party Services”). Such Third-Party Services are subject to different terms of service and privacy policies, and Members should review them. Airbnb Payments is not responsible or liable for the use of such Third-Party Services. Links to any Third-Party Services are not an endorsement by Airbnb Payments of those Third-Party Services.
Airbnb Payments may enable features that allow you to authorize other Members or third parties to take certain actions that affect your Airbnb account. You may authorize a third party to use your Airbnb account if the feature is enabled for your Airbnb account. You acknowledge and agree that anyone you authorize to use your Airbnb account may use the Payment Services on your behalf and that you will be responsible for any payments made by such person.
You authorize Airbnb Payments, directly or through third parties, to make any inquiries we consider necessary to verify your identity and information you provide, and if applicable, verifying the identity of the representative(s) and beneficial owner(s). This may include (i) screening you and, if applicable, your representative(s) and beneficial owner(s) against third-party databases or other sources, (ii) requesting reports from service providers, (iii) asking you and, if applicable, your representative(s) and beneficial owner(s) to provide a form of government identification (e.g., driver’s license or passport) to check your name, place and date of birth, your address, nationality and/or other information which we deem necessary under applicable laws. If you are providing information for identification and verification about your representative(s) and/or beneficial owner(s) on their behalf, by providing such information, you are confirming that you have the authority and requisite rights to provide their information (including consent, where applicable) to Airbnb Payments for Airbnb Payments to carry out the purposes set out in this Section 1.4; or (iv) requiring you to take steps to confirm ownership of your email address, Payment Method(s) or Payout Method(s). Airbnb Payments reserves the right to terminate, suspend, or limit access to the Payment Services in the event we are unable to obtain or verify any of this information.
Your access to or use of certain Payment Services may be subject to you first having to agree to or to accept (expressly or by conduct) additional terms and conditions, including those of third party providers of Payment Services. If there is a conflict between these Payments Terms and terms and conditions applicable to a specific Payment Service, the terms and conditions applicable to the specific Payment Service will take precedence with respect to your use of or access to that Payment Service, unless specified otherwise in the terms and conditions applicable to the specific Payment Service.
When you add a Payment Method to your Airbnb account, you will be asked to provide billing information such as name, billing address, and financial instrument information either to Airbnb Payments or its third-party payment processor(s). You authorize Airbnb Payments and its payment processor(s) to collect and store your Payment Method information in accordance with Airbnb’s privacy policy.
When you add or use a Payment Method, Airbnb Payments may verify the Payment Method by (i) authorizing your Payment Method for one or two nominal amounts via a payment service provider, and asking you to confirm those amounts, or (ii) requiring you to upload a billing statement. We may, and retain the right to, initiate refunds of these amounts from your Payment Method. When you add a Payment Method during checkout, we will automatically save and add that Payment Method to your Airbnb account so it can be used for a future transaction. You may not remove the Payment Method associated with a reservation, during the period commencing from the date of your booking and ending fourteen (14) days following your check-out date, nor during any additional period of time needed to resolve any outstanding Damage Report associated with such booking.
You allow Airbnb Payments to charge your Payment Method (including charging more than one Payment Method), either directly or indirectly, for all fees and other amounts due (including any applicable taxes) in connection with your Airbnb account, including Damage Report amounts in accordance with the Terms and with Sections 5 and 6.
If your Payment Method’s account information changes (e.g., account number, routing number, expiration date or CVV or CVC number) as a result of re-issuance or otherwise, we may acquire that information from our financial services partners or your bank and automatically update your Payment Method on file.
Airbnb Payments generally charges the Total Price due after the Host accepts your booking request. However, if you pay with a push Payment Method (such as Sofort), Airbnb Payments will collect the Total Price due at the time of your booking request or after the Host accepts your booking request. Airbnb may offer alternative options for the timing and manner of payment. Any additional fees for using those alternative payment options will be displayed via the Airbnb Platform and included in the Total Price, and you agree to pay such fees by selecting the payment option. Additional terms and conditions may apply for the use of an alternative payment option. If Airbnb Payments is unable to collect the Total Price due, as scheduled, Airbnb Payments will collect the Total Price due at a later point in accordance with Section 5.3. Once the payment for your requested booking is successfully completed, you will receive a confirmation email.
You are able to select your currency in your settings. The currencies available to make payments may be limited for regulatory or operational reasons based on factors such as your selected Payment Method, your country of residence and/or your Airbnb Payments contracting entity(ies). Any such limitations will be communicated via the Airbnb Platform, and you will be prompted to select a different currency or Payment Method if your preferred currency is not available.
Note that if the country in which your Airbnb Payments contracting entity is located is different from the country of your Payment Method provider or the preferred currency in your settings is different than your Payment Method's billing currency, your payment may be processed outside of your country of residence. As a result, your Payment Method provider may impose certain fees and the amount listed on your Payment Method statement may be different from the amount shown at checkout. For example, if you make a booking using an Australian issued card, but the preferred currency in your settings is set to US dollars, your payment may be processed outside Australia, and banks and credit card companies may impose international transaction fees and foreign exchange fees. In addition, if the preferred currency in your settings is different from your Payment Method's billing currency, your bank or credit card company may convert the payment amount to your billing currency associated with your Payment Method, based on an exchange rate and fee amount determined solely by your bank. Airbnb Payments is not responsible for any such fees and disclaims all liability in this regard. Please contact your Payment Method provider if you have any questions about these fees or any exchange rate imposed by your Payment Method provider.
If a requested booking is declined because it is not accepted by the Host, you cancel the booking request before it is accepted by the Host, or Airbnb cancels the booking, any amounts collected by Airbnb Payments and due to you pursuant to the policies described in Section 5.5 will be refunded to you, and any pre-authorization of your Payment Method will be released (if applicable) in accordance with Section 5.5.2.
Airbnb Payments reserves the right to decline or limit payments that we reasonably believe (i) may violate Airbnb Payments’ risk management policies or procedures, (ii) may violate these Payments Terms or the Terms, (iii) are unauthorized, fraudulent or illegal; or (iv) expose you, Airbnb, Airbnb Payments, or others to risks reasonably unacceptable to Airbnb Payments.
Payment Methods may involve the use of third-party payment service providers. These payment service providers may charge you additional fees when processing payments in connection with the Payment Services, and Airbnb Payments is not responsible for any such fees and disclaims all liability in this regard. Your Payment Method may also be subject to additional terms of use. Please review them before using your Payment Method.
Airbnb Payments is not responsible for any loss suffered by you as a result of incorrect Payment Method information provided by you. Airbnb Payments does not provide any regulated Payment Services to you.
2.11.1.1
Airbnb may make available to Guests the option to pay a portion of the booking’s Total Price at the time of booking and pay the remainder of the Total Price at a later time prior to check-in (“Pay Part Now, Part Later”). Availability of this option may depend on the Listing and/or Payment Method. You will not be charged any additional fees for using Pay Part Now, Part Later.
2.11.1.2
If you choose Pay Part Now, Part Later, the Airbnb Platform will notify you during checkout of the amount, currency and schedule of each payment due. Airbnb credits, coupons, or gift cards will be applied first before the amount of each payment is calculated. On the payments due date, Airbnb Payments will automatically charge the original Payment Method you used to make the booking.
2.11.1.3
If you make a modification to a booking made with Pay Part Now, Part Later, Airbnb Payments will notify you of the revised payment schedule, as applicable, and Airbnb Payments will automatically charge the original Payment Method you used to make the booking on the revised payment due dates. If the modification increases your Total Price, you may be required to make an additional partial payment of the new Total Price at the time of the modification.
2.11.1.4
You agree that by selecting Pay Part Now, Part Later, you may not be able to pay for the booking with a different Payment Method or pursuant to a different payment schedule.
2.11.1.5
If Airbnb Payments is unable to collect your payment, Airbnb Payments will notify you of such declined payment, and require you to complete the payment using an alternative Payment Method within 72 hours of the notice. If you fail to complete the payment, you authorize Airbnb to cancel the booking on your behalf. If the booking is canceled, you will be refunded based on the Host’s cancellation policy.
2.11.2.1
For certain bookings (such as for Accommodation bookings of twenty-eight (28) nights or more), Airbnb Payments may require a Guest to make recurring, incremental payments toward the Total Price owed (“Recurring Payments”). More information on Recurring Payments (including the amount and the frequency of payments) will be made available via the Airbnb Platform if applicable to a booking.
2.11.2.2
If Recurring Payments apply to a confirmed booking, then the Guest authorizes Airbnb Payments to collect the Total Price due.
2.11.2.3
Guests may stop a Recurring Payment by notifying Airbnb Payments orally or in writing at least three (3) business days before the scheduled date of the payment. Airbnb Payments may require you to give written confirmation of a stop-payment order within fourteen (14) days of an oral notification. If you fail to provide written confirmation within those fourteen (14) days, Airbnb Payments is not obligated to honor your request to stop any future Recurring Payments. If you have any questions regarding your Recurring Payments, please contact Airbnb Payments.
Guests may from time to time be offered the possibility to pay for an Accommodation on credit or other installment options, and pay for them over time ('buy now, pay later'). These Payment Methods are provided by Klarna Australia Pty Ltd (or its affiliate), not Airbnb, and Klarna will become your creditor for the payment, subject to additional terms of use provided at checkout. Depending on the Payment Method, this may also create a separate relationship between you as the borrower and Klarna as the lender. Please review any applicable additional terms before using these Payment Methods.
Airbnb Payments generally collects the Total Price of a booking at the time the Guest’s booking request is accepted by the Host, unless noted otherwise.
In order to receive a Payout you must have a valid Payout Method linked to your Airbnb account. When you add a Payout Method to your Airbnb account, you may be asked to provide additional information, which may include name, government identification, tax ID, billing address, and financial instrument information either to Airbnb Payments or its third-party payment processor(s). Depending on the Payout Method selected additional information may be required, such as: residential address, name on the account, account type, routing number, account number, email address, payout currency, identification number and account information associated with a particular payment processor. Providing requested information is required for a Payout Method to be valid. The information Airbnb Payments requires for a valid Payout Method may change, and Airbnb Payments may request additional information at any time; failing to provide requested information may result in Airbnb Payments temporarily placing a hold, suspending, or canceling any Payout until the information is provided and, if necessary, validated.
You authorize Airbnb Payments to collect and store your Payout Method information in accordance with Airbnb’s Privacy Policy. Airbnb Payments may also share your information with governmental authorities as required by applicable law.
Subject to and conditional upon successful receipt of the associated payments from Guests, Airbnb Payments will initiate Payouts to your selected Payout Method: (i) for Accommodations, by the end of the business day after the Guest’s scheduled check-in date; (ii) for Experiences, by the end of the business day after the start of the Experience; and (iii) for all other Host Services, at the time specified via the Airbnb Platform. For Accommodation bookings of twenty-eight (28) nights or more, Airbnb Payments will initiate the first payout by the end of the business day after the Guest’s scheduled check-in date, and will initiate future payouts monthly after the initial payout, for the duration of the reservation.
Airbnb Payments may offer you a different Payout time or trigger for payment via the Airbnb Platform. The time it takes to receive Payouts once released by Airbnb Payments may depend upon the Payout Method you select.
Your Payout for a booking will be the Total Price less applicable fees like Airbnb service fees and applicable taxes and any amounts you agree to allocate to any co-host, or the owner(s) of an Accommodation, a homeowners’ association, and/or their agent (such as a building operator or property management company). In the event of cancellation of a confirmed booking, Airbnb Payments will remit the amount you are due (if any) as provided in the Terms and applicable cancellation policy.
Airbnb Payments may temporarily place a hold, suspend, or cancel any Payout for the purposes of preventing unlawful activity or fraud, risk assessment, security, or completing an investigation; or if we are unable to verify your identity or where applicable the identity of your representative(s) or beneficial owner(s), or to obtain or verify requested information. Furthermore, Airbnb Payments may temporarily place a hold on, suspend, or delay initiating or processing any Payout due to you under the Terms as a result of high volume booking cancellations or modifications arising from a Force Majeure Event (as defined below).
Airbnb Payments will remit your Payouts in the currency applicable to your selected Payment Method. The currencies available may be limited for regulatory or operational reasons based on factors such as your selected Payout Method, your country of residence, and/or your Airbnb contracting entity(ies). Any such limitations will be communicated via the Airbnb Platform, and you will be prompted to select a different currency or Payout Method. Note that payment service providers may impose transaction, currency conversion or other fees based on the currency or Payout Method you select, and Airbnb Payments is not responsible for any such fees and disclaims all liability in this regard.
For compliance or operational reasons, Airbnb Payments may limit the amount of a Payout. If you are due an amount above that limit, Airbnb Payments may make a series of Payouts (potentially over multiple days) in order to provide your full Payout amount.
Payout Methods may involve the use of third-party payment service providers. These payment service providers may charge you additional fees when processing Payouts in connection with the Payment Services (including deducting charges from the Payout amount), and Airbnb Payments is not responsible for any such fees and disclaims all liability in this regard. Your Payout Method may also be subject to additional terms of use from such third-party payment service providers. Please review them before using your Payout Method.
Airbnb Payments may combine amounts that it collects from Guests and invest them as permitted under applicable laws. Airbnb Payments will retain any interest it earns on those investments.
Subject to Section 17, Airbnb Payments is not responsible for any loss suffered by you as a result of incorrect Payout Method information provided by you.
If you provide Host Services jointly with one or more other Hosts as part of a team, business or other organization (“Host Team”), Airbnb may make available to such Hosts the option to allocate between the members of the Host Team the total Host Payout for a booking. Airbnb Payments will execute such payments at the instruction of one or more members of the Host Team, and Hosts are responsible for the accuracy of their instructions.
If a Guest in Germany chooses to pay for an Accommodation Reservation using a Klarna "buy now, pay later" option (other than a Pay-in-3 option), these additional Host terms apply.
Each Host, including each Host Team member, hereby appoints Airbnb Payments as the Host’s payment collection agent solely for the limited purpose of accepting and processing funds from Guests purchasing Host Services on the Host’s behalf.
Each Host, including each Host Team member, agrees that payment made by a Guest through Airbnb Payments, shall be considered the same as a payment made directly to the Host, and the Host will provide the Host Service booked by the Guest in the agreed-upon manner as if the Host has received the payment directly from the Guest. Each Host agrees that Airbnb Payments may refund the Guest in accordance with the Terms. Each Host understands that Airbnb Payments’ obligation to pay the Host is subject to and conditional upon successful receipt of the associated payments from Guests. Airbnb Payments guarantees payments to Host(s) only for such amounts that have been successfully received by Airbnb Payments from Guests in accordance with these Payments Terms. In accepting appointment as the limited payment collection agent of the Host, Airbnb Payments assumes no liability for any acts or omissions of the Host, except for acts or omissions the Host is directed to engage in by Airbnb Payments.
Each Guest acknowledges and agrees that, notwithstanding the fact that Airbnb Payments is not a party to the agreement between you and the Host(s), including each Host Team member, Airbnb Payments acts as each Host’s payment collection agent for the limited purpose of accepting payments from you on behalf of the Host(s). Upon a Guest’s payment of the funds to Airbnb Payments, the Guest’s payment obligation to the Host(s) for the agreed upon amount is extinguished, and Airbnb Payments is responsible for remitting the funds successfully received by Airbnb Payments to the Host(s) in the manner described in these Payments Terms. In the event that Airbnb Payments does not remit any such amounts, the Host(s) will have recourse only against Airbnb Payments and not the Guest directly.
At no point in time is Airbnb Payments holding funds on behalf of the Guest or providing the Guest a payment service.
Airbnb Payments may charge fees for use of certain Payment Services and any applicable fees will be disclosed to you in the Terms or via the Airbnb Platform prior to being charged.
You authorize Airbnb Payments to collect from you amounts due pursuant to these Payments Terms and/or the Terms by either (i) charging the Payment Method associated with the relevant booking, or any other Payment Method on file that you authorize in your Airbnb account (unless you have previously removed the authorization to charge such Payment Method(s)), or (ii) by withholding the amount from your future Payout. Specifically, you authorize Airbnb Payments to collect from you:
If you owe an amount at any time after a booking, such as with Pay Part Now, Part Later or Recurring Payment charges, Booking Modifications, Resolution Center payments or Damage Reports (“Additional Amounts”), you authorize and grant Airbnb Payments a mandate to collect payments for such Additional Amounts by charging your Payment Method associated with the relevant booking without any further action on your part. Airbnb Payments will notify you in writing before any Additional Amounts are charged to such payment method.
If your Payment Method associated with the relevant booking is expired, invalid or otherwise not able to be charged for any reason (such as insufficient funds), you remain responsible for any uncollected amounts and Airbnb Payments may charge the Payment Method related to your booking again or use any other Payment Method on file associated with your Airbnb account, if available, to collect such Additional Amounts. Any amount not collected for any reason will be subject to any remedies that may be available, including, but not limited to, referral to a collections agency, or pursuit of available causes of action or claims against you.
If Airbnb has reason to believe that you as a Host participated in fraudulent activity, such as an overpayment scam, booking fraud or other fraud, and Airbnb Payments released the payout for such stay, Airbnb Payments may recoup from you such amount by reducing, setting off or debiting the amount from any future Payouts owed to you.
In addition to any amount due as outlined above, if there are amounts which you owe us but are unpaid or chargebacks associated with your Payment Method, you may be charged fees or costs for reasonable steps taken by Airbnb and/or Airbnb Payments to collect, recover or process these amounts and chargebacks (“Collection Fees”). The Collection Fees will be limited to: (a) reasonable costs directly incurred by Airbnb Payments and/or Airbnb (such as costs associated with the time our personnel spend collecting, recovering or processing the relevant amounts); and (b) collection fees, convenience fees or other fees or costs that are charged to Airbnb Payments and/or Airbnb by third parties.
If Airbnb Payments is unable to collect any amounts you owe, as a Guest or as a Host, under the Terms and these Payments Terms, Airbnb Payments may engage in collection efforts to recover such amounts from you.
Airbnb Payments will deem any owed amounts overdue when: (a) for authorized charges, one hundred and twenty (120) days have elapsed after Airbnb Payments first attempts to charge your Payment Method or the associated services have been provided, whichever is later; and (b) for withholdings from a Host’s future Payouts, two hundred and seventy (270) days have elapsed after the adjustment is made to the Host’s Airbnb account or the associated services have been provided, whichever is later.
Airbnb Payments will deem any overdue amounts not collected to be in default when three hundred and sixty five (365) days have elapsed: (a) for authorized charges to your Payment Method with respect to a Guest transaction, after Airbnb Payments first attempts to charge your Payment Method or the associated services have been provided, whichever is later; and (b) for withholdings from a Host’s future Payouts, after the adjustment is made to the Host’s Airbnb account or the associated services have been provided, whichever is later.
You hereby explicitly agree that all communications in relation to amounts owed will be made by electronic mail or by phone, as provided to Airbnb and/or Airbnb Payments by you. Such communications may be made by Airbnb, Airbnb Payments, or by anyone on their behalf, including but not limited to a third-party collection agent.
Airbnb Payments will take the necessary steps to rectify any payment processing errors that we become aware of. These steps may include crediting or debiting (as appropriate) the original Payout Method or Payment Method used or selected by you, so that you end up receiving or paying the correct amount. This may be performed by Airbnb Payments or a third party such as your financial institution. We may also take steps to recover funds sent to you in error (including but not limited to an event of duplicate payments made to you due to a processing error). For Hosts, this may include, by reducing, setting off and/or debiting the amount of such funds from any future Payouts owed to you.
To the extent you receive any funds in error, you agree to promptly return such funds to Airbnb Payments after you become aware that you have received such funds in error.
Any refunds or credits due to a Member pursuant to the Terms, Major Disruptive Events Policy, Rebooking and Refund Policy, and Experiences Guest Refund Policy, will be initiated and remitted by Airbnb Payments in accordance with these Payments Terms.
Subject to this Section 5.5.2, Airbnb Payments will initiate the refund process promptly. In the case of a cancellation by a Host, Airbnb Payments will hold the funds for up to 72 hours until the Guest is either refunded or the funds are used to rebook with another Host. In certain instances, the refund process may include the option to receive credit in lieu of a cash refund; if this option is made available to you, the timing of your refund will be communicated via the Airbnb Platform. The time it takes to receive any cash refund or for any pre-authorization of your Payment Method to be released will vary based on the Payment Method and any applicable payment system (e.g., Visa, Mastercard, etc.) rules. In the event of a Force Majeure Event that may affect the processing and settlement of refunds, Airbnb Payments will initiate and process the refund as soon as is practicable.
If you are responsible for Damage Report amounts, pursuant to Section 14 of the Terms, Airbnb via Airbnb Payments may, on reasonable notice to you, charge the Payment Method used to make the booking or any other Payment Method associated with your Airbnb account at the time of the Damage Report or within a reasonable period thereafter in order to collect the Damage Report amounts, up to a maximum amount as defined in Section 14 of the Terms. To facilitate this charge, when you book a Listing, you are agreeing that Airbnb via Airbnb Payments may charge the Payment Method used to book the Listing in order to collect Damage Report amounts.
To the maximum extent permitted by law, you agree that Airbnb Payments may seek to recover from you under any insurance policies you maintain and that Airbnb Payments may also pursue against you any remedies it may have available, including, but not limited to, referral to a collections agency, or pursuit of causes of action or claims against you, including in relation to a Damage Report, or payment requests made by Hosts under the Host Damage Protection.
If Airbnb Payments holds funds due to you (e.g., because we are unable to issue you a Payout or refund) or you do not use a gift card or gift credit for the relevant period of time set forth by your state, country, or other governing body in its unclaimed property laws, we may process the funds due to you in accordance with our legal obligations, including by reporting and escheating (sending) such funds to the appropriate governing body as required by applicable unclaimed property laws.
You are solely responsible for compliance with any and all laws, rules, regulations, and tax obligations that may apply to your use of the Payment Services. In connection with your use of the Payment Services, you may not and you agree that you will not and will not assist or enable others to:
We are required to act in accordance with our internal policies and the laws of various jurisdictions relating to the prevention of money laundering and the implementation of sanctions including: (i) economic or financial sanctions or trade embargoes imposed, administered or enforced from time to time by the U.S. government, including those administered by the Office of Foreign Asset Control or the U.S. Department of State; or (ii) by the United Nations Security Council, the European Union or His Majesty’s Treasury of the United Kingdom. You will comply with any relevant financial sanctions and any relevant export control laws applicable to you and to your local jurisdiction.
As between Airbnb and a Member, neither shall be liable to the other for any delay or failure to perform resulting from causes outside their reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, epidemics or disease, strikes or shortages of transportation facilities, fuel, energy, labor or materials (“Force Majeure Event”). For the avoidance of doubt, this clause does not: (i) apply to a Reservation, which is subject to the Host’s cancellation policy and the Major Disruptive Events Policy; or (ii) operate to extend deadlines applicable to a Resolution Centre Request, a Host Damage Protection claim, an Aircover for guests claim, a Travel Issue under the Rebooking and Refund Policy or an Experiences Issue under the Experiences Guest Refund Policy, or other requests, claims or reporting under similar policies that are incorporated by reference into these Terms.
If you choose to use the Payment Services, you do so voluntarily and at your sole risk.
Notwithstanding Airbnb Payments’ appointment as the limited payment collection agent of Hosts pursuant to Section 4 and subject to Section 11, Airbnb Payments explicitly disclaims all liability for any act or omission by you, any Member or other third party. Airbnb Payments does not have any duties or obligations as agent for each Host except to the extent expressly set forth in these Payments Terms, and any additional duties or obligations as may be implied by law are, to the maximum extent permitted by applicable law, expressly excluded.
If we choose or are required to conduct identity verification on any Member, to the extent permitted by applicable law, we disclaim warranties of any kind, either express or implied, that such checks will identify prior misconduct by a Member or guarantee that a Member will not engage in misconduct in the future. We are not responsible for prior misconduct by a Member where such misconduct was unknown by us.
The foregoing disclaimers apply to the maximum extent permitted by law. You may have other statutory rights or warranties which cannot lawfully be excluded. However, the duration of any statutorily required warranties shall be limited to the maximum extent (if any) permitted by law.
You acknowledge and agree that, to the maximum extent permitted by law, the risk arising out of your access to and use of the Payment Services remains with you. If you permit or authorize another person to use your Airbnb account in any way, you are responsible for the actions taken by that person. To the maximum extent permitted by law, no party, including Airbnb’s affiliates and personnel, or any other party involved in or delivering the Payment Services will be liable for any incidental, special, exemplary, or consequential damages. Incidental, special, exemplary or consequential damages, include, to the maximum extent permitted by law, lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services. Neither is Airbnb Payments liable nor any other party liable, to the extent permitted by law, for any damages for personal or bodily injury or emotional distress arising out of or in connection with (i) these Payments Terms, (ii) from the use of or inability to use the Payment Services, or (iii) from any communications, interactions, or meetings with other Members or other persons with whom you communicate, interact, transact, or meet with as a result of your use of the Payment Services, whether based on warranty, contract, tort (including negligence), product liability, or any other legal theory, and whether or not Airbnb Payments has been informed of the possibility of such damage, even if a limited remedy set forth herein is found to have failed of its essential purpose.
Except for: (i) Airbnb’s obligation to pay amounts to applicable Hosts pursuant to these Payments Terms; (ii) Airbnb’s obligation to make payments under the Airbnb Host Damage Protection, which contains its own limitation of liability; and/or (iii) Airbnb Payments’ wilful breach of these Terms, to the maximum extent permitted by law, in no event shall Airbnb Payments’ aggregate liability arising out of or in connection with these Payments Terms and your use of the Payment Services including, but not limited to, from your use of or inability to use the Payment Services, exceed (A) to Guests, three (3) times the amount you paid for the relevant Reservation(s) giving rise to the liability, or (B) to Hosts, three (3) times the amount paid to you for the relevant Reservation(s) giving rise to the liability. The limitations of damages set forth above are fundamental elements of the basis of the bargain between Airbnb Payments and you.
Except in the case of a Member’s wilful breach of these Terms, to the maximum extent permitted by law, in no event shall a Member’s liability to Airbnb or any other party involved in creating, producing, or delivering the Airbnb Platform or any Content for any claim or dispute arising out of or in connection with these Payments Terms, interaction with any Member, or your use of or inability to use the Airbnb Platform, any Content, or any Host Service exceed: (A) in the case of Guests, three (3) times the amount you paid for the relevant Reservation(s) giving rise to the liability, or (B) in the case of Hosts, three (3) times the amount paid to you for the relevant Reservation(s) giving rise to the liability.
To the maximum extent permitted by applicable law, you agree to release, defend (at Airbnb Payments’ option), indemnify, and hold Airbnb (including Airbnb Payments, other affiliates and subsidiaries, and their officers, directors, employees, and agents) harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of (i) your breach of these Payments Terms (including any supplemental or additional terms that apply to a product or feature) or our Additional Legal Terms, Policies, or Standards; (ii) your improper use of the Payment Services; (iii) your failure, or our failure at your direction, to accurately report, collect or remit Taxes; or (iv) your breach of any laws, regulations, or third-party rights, such as intellectual property or privacy rights. The indemnification obligation only applies if and to the extent that the claims, liabilities, damages, losses, and expenses have been adequately caused by your negligence or breach of a contractual obligation.
Airbnb Payments may modify these Payments Terms at any time. If we make material changes to these Payments Terms, we will post the revised Payments Terms on the Airbnb Platform and update the “Last Updated” date at the top of these Payments Terms. If you are affected by the modification, we will also provide you with notice of the modifications at least two (2) months before the date they become effective. If you do not terminate your agreement before the date the revised Payments Terms become effective, your continued use of the Payment Services will constitute acceptance of any changes to the revised Payments Terms.
This agreement between you and Airbnb Payments is effective (i) if you are a Guest, from when you make your first booking; or (ii) if you are a Host, from when a Guest first books a Listing made available by you and you use the Payment Services and remains in effect until either you or we terminate this agreement in accordance with Section 13.3.
You may terminate this agreement at any time by sending us an email or by deleting your Airbnb account. Without limiting our rights specified below, Airbnb Payments may terminate this agreement for convenience at any time by giving you thirty (30) days' notice via email to your registered email address (or ninety (90) days' prior notice for Members contracting with Airbnb Payments UK). Airbnb Payments may also terminate this agreement immediately without notice if (i) you have materially breached your obligations under this agreement; (ii) you have provided inaccurate, fraudulent, outdated, or incomplete information; (iii) you have violated applicable laws, regulations, or third-party rights; or (iv) Airbnb Payments believes in good faith that such action is reasonably necessary to protect other Members, Airbnb, Airbnb Payments, or third parties. In case of non-material breaches or where otherwise reasonable, you will be given reasonable notice of any actions that Airbnb proposes to take and an opportunity to remedy the non-material breach (if it is capable of remedy) unless such notification would (i) prevent or impede the detection or prevention of fraud or other illegal activities, (ii) harm the legitimate interests of other Members or third parties, or (iii) contravene applicable laws. Terminating this agreement will also serve as notice to cancel your Airbnb account pursuant to the Terms.
Airbnb Payments may limit or temporarily or permanently suspend your use of or access to the Payment Services (i) to comply with applicable law, or the order or request of a court, law enforcement, or other administrative agency or governmental body, (ii) if you have materially breached these Payments Terms, the Terms, applicable laws, regulations or third-party rights, (iii) if you have provided inaccurate, fraudulent, outdated, or incomplete information regarding a Payment Method or Payout Method, (iv) for any amounts you owe under these Payments Term that are overdue or in default, or (v) if Airbnb Payments believes in good faith that such action is reasonably necessary to protect the personal safety or property of Airbnb, its Members, Airbnb Payments, or third parties, or to prevent fraud or other illegal activity. Further, for unsuccessful payment due to card expiration, insufficient funds, or otherwise, we may temporarily suspend your access to the Payment Services until we can charge a valid Payment Method.
If Airbnb Payments takes any of the measures described in Section 13.3 you may appeal such a decision by contacting customer service.
If you cancel your Airbnb account as a Host or Airbnb Payments takes any of the measures described above, Airbnb Payments may provide a full refund to any Guests with confirmed booking(s), and you will not be entitled to any compensation for pending or confirmed bookings that were cancelled. If you cancel your Airbnb account as a Guest, Airbnb Payments will initiate a refund for any confirmed booking(s) based on the Listing’s cancellation policy. If your access to or use of the Payment Services has been suspended or limited or this agreement has been terminated by us, you may not register a new Airbnb account or attempt to access and use the Payment Services through an Airbnb account of another Member.
Sections 1.2, 2.2, 2.3, 2.4, 2.5, 2.6, 2.7, 2.8, 2.9, 2.10, 2.11, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17 and 19, survive expiry or termination, together with any other terms that, by reasonable implication or to give them efficacy are, or are intended, to be performed in whole or in part after the expiry or termination of this agreement.
If you are contracting with Airbnb Payments UK, these Payments Terms will be interpreted in accordance with English law. If you are acting as a consumer and if mandatory statutory consumer protection regulations in your country of residence contain provisions that are more beneficial for you, such provisions shall apply irrespective of the choice of English law. As a consumer, you may only bring proceedings relating to these Payments Terms before the competent court of your place of residence or a court in England. If Airbnb wishes to enforce any of its rights against you as a consumer, we may do so only in the courts of the jurisdiction in which you are a resident. If you are acting as a business, you agree to submit to the exclusive jurisdiction of the English courts.
If you are contracting with Airbnb Payments Australia, these Payments Terms will be governed by the laws of the State of New South Wales, Australia. The parties agree to submit to the non-exclusive jurisdiction of the courts of that State and courts of appeal of that State in respect of any proceedings arising out of or in connection with this agreement.
PLEASE READ THE FOLLOWING PARAGRAPHS CAREFULLY BECAUSE THEY PROVIDE THAT YOU AND AIRBNB PAYMENTS AGREE TO RESOLVE ALL DISPUTES BETWEEN US THROUGH BINDING INDIVIDUAL ARBITRATION AND INCLUDE A CLASS ACTION WAIVER AND JURY TRIAL WAIVER. This Arbitration Agreement supersedes all prior versions.
This Arbitration Agreement only applies to you if you are contracting with Airbnb Payment US. If you are not contracting with Airbnb Payments US, and you nevertheless attempt to bring any legal claim against Airbnb Payments in the United States, this Arbitration Agreement will apply for determination of the threshold issue of whether this Section 15 applies to you, and all other threshold determinations, including residency, arbitrability, venue, and applicable law.
Airbnb Payments is committed to participating in a consumer-friendly dispute resolution process. To that end, these Payments Terms provide for a two-part process for individuals to whom this Section 15 applies: (1) an informal negotiation directly with Airbnb’s customer service team (described in Section 15.3), and if necessary (2) a binding arbitration in accordance with the terms of this Arbitration Agreement. You and Airbnb Payments each retain the right to seek resolution of the dispute in small claims court as an alternative to arbitration.
At least 30 days prior to initiating an arbitration, you and Airbnb Payments each agree to send the other party an individualized notice of the dispute in writing (“Pre-Dispute Notice”) and attempt in good faith to negotiate an informal resolution of an individual claim. You must send your Pre-Dispute Notice to Airbnb Payments by mailing it to Airbnb Payments’ agent for service: CSC Lawyers Incorporating Service, 2710 Gateway Oaks Drive, Suite 150N, Sacramento, California 95833. Airbnb Payments will send its Pre-Dispute Notice to the email address associated with your Airbnb account. A notice of dispute must include: the date, your name, mailing address, your Airbnb username, the email address you used to set up your Airbnb account, your signature, a brief description of the dispute, and the relief sought. If the parties are unable to resolve the dispute within the 30-day period, only then may either party commence arbitration by filing a written demand for arbitration with the arbitration provider designated pursuant to Section 15.6, below. A claimant’s Pre-Dispute Notice requirement is a prerequisite to any arbitration, and a copy of the Pre-Dispute Notice and evidence that it was sent as required by this Section must be attached to any arbitration demand.
You and Airbnb Payments mutually agree that any dispute, claim or controversy arising out of or relating to these Payments Terms or the applicability, breach, termination, validity, enforcement or interpretation thereof, or any use of the Payment Services (collectively, "Disputes") will be settled by binding arbitration on an individual basis (the "Arbitration Agreement"). If there is a dispute about whether this Arbitration Agreement can be enforced or applies to our Dispute, you and Airbnb Payments agree that the arbitrator will decide that issue. For the avoidance of doubt, you and Airbnb agree that any question regarding arbitrability and the formation, enforceability, validity, scope, or interpretation of all or part of this Section 15, including any dispute over compliance with the Pre-Dispute Notice requirement and a party’s responsibility to pay arbitration fees, shall be resolved by an arbitrator.
You and Airbnb Payments each agree that the following causes of action and/or claims for relief are exceptions to the Arbitration Agreement and will be brought in and will be brought in a judicial proceeding in state or federal court in San Francisco, California, unless we both agree to some other location: (i) any claim or cause of action seeking emergency injunctive relief based on exigent circumstances (e.g., imminent danger or commission of a crime, hacking, cyber-attack); (ii) a request for the remedy of public injunctive relief; (iii) any claim or cause of action for vexatious litigation; or (iv) any individual claim of sexual assault or sexual harassment arising from your use of the Airbnb Platform or Host Services. You and Airbnb Payments agree that any request for the remedy of public injunctive relief will proceed after the arbitration of all arbitrable claims, remedies, or causes of action, and will be stayed pending the outcome of the arbitration pursuant to section 3 of the Federal Arbitration Act.
This Arbitration Agreement evidences a transaction in interstate commerce and the Federal Arbitration Act governs all substantive and procedural interpretation and enforcement of this Arbitration Agreement, and not state law. The arbitration will be administered by ADR Services, Inc. (“ADR”) (www.adrservices.com) in accordance with Rules 1, 6–7, 8–9, and 11–12, 45, 54, and 56 of the Federal Rules of Civil Procedure (“Selected Federal Rules") (https://www.uscourts.gov/rules-policies/current-rules-practice-procedure/federal-rules-civil-procedure) and ADR’s Arbitration Rules then in effect (the “ADR Rules”), except as the Selected Federal Rules or ADR Rules are modified by or conflict with this Arbitration Agreement. The ADR Rules are available at www.adrservices.com. If an arbitration demand is submitted to ADR Services in accordance with this agreement and the ADR Rules, and ADR Services cannot or will not administer the arbitration, the arbitration will be administered by the American Arbitration Association (“AAA”) in accordance with the Selected Federal Rules and the AAA’s Consumer Arbitration Rules (the “AAA Rules”) then in effect, except as modified here. The AAA Rules are available at www.adr.org. If the AAA cannot and will not administer the arbitration, you and Airbnb Payments shall confer and select an alternative arbitral forum, and if we are unable to agree, either you or Airbnb Payments may ask a court to appoint an arbitrator pursuant to 9 U.S.C. § 5. In that event, the arbitration will be conducted in accordance with the rules of the appointed arbitral forum, unless those rules are inconsistent with the provisions of this Arbitration Agreement.
In order to make the arbitration most cost-effective, efficient, and convenient to you, any required arbitration hearing in an arbitration wherein the amount in controversy does not exceed US $1,000,000, shall be conducted remotely via video conference except as otherwise agreed by the parties or instructed by the arbitrator. Any required arbitration hearing in an arbitration wherein the amount in controversy exceeds US $1,000,000 shall be conducted in San Francisco County except as otherwise agreed by the parties or instructed by the arbitrator. If the amount in controversy is US $10,000 or less, the parties agree to proceed solely on the submission of documents to the arbitrator, provided that the arbitrator has discretion to decide to hold a hearing in response to the reasonable and proportionate request from a party.
Your arbitration fees and your share of arbitrator compensation shall be governed by the ADR Rules and the ADR Services fee schedule (available at www.adrservices.com). If you have a gross monthly income of less than 300% of the federal poverty guidelines, you are entitled to a waiver of arbitration fees and costs, exclusive of arbitrator fees. You may request a fee waiver by providing the arbitration provider with a declaration under oath stating your monthly income and the number of persons in your household. If a fee waiver is granted by the arbitration provider and you provide Airbnb Payments with documents necessary to prove that your gross monthly income is less than 300% of the federal poverty guidelines, Airbnb Payments will pay your share of any arbitrator fees.
Either party may make a request that the arbitrator impose sanctions upon proving that the other party or its attorney(s) has asserted a claim, or defense that is groundless in fact or law, brought in bad faith or for the purpose of harassment, or is otherwise frivolous. As allowed by applicable law and the AAA Rules the arbitrator shall impose sanctions equal to the requesting party’s reasonable attorneys’ fees and costs upon finding that a claim or defense is groundless in fact or law, brought in bad faith or for the purpose of harassment, asserted in violation of Fed. R. Civ. P. 11(b) (treating the arbitrator as “the court”), or is otherwise frivolous. Either party may seek dismissal of any arbitration filed in violation of any provision of this Arbitration Agreement. Either party may assert in arbitration a counterclaim for the other party’s initiation of proceedings concerning an arbitrable Dispute without complying with or otherwise in violation of the requirements of this Arbitration Agreement. Upon finding that a party has initiated proceedings concerning an arbitrable Dispute without complying with or otherwise in violation of the requirements of this Arbitration Agreement, the arbitrator shall award the other party its actual damages, including but not limited to reasonable attorneys’ fees and costs.
The arbitrator will issue a written decision which shall include the essential findings and conclusions upon which the arbitrator based the award. Judgment on the arbitration award may be entered in any court with proper jurisdiction. The arbitrator may award any relief allowed by law or the AAA Rules, but declaratory or injunctive relief may be awarded only on an individual basis and only to the extent necessary to provide relief warranted by the claimant’s individual claim.
You and Airbnb Payments acknowledge and agree that both parties are each waiving the right to a trial by jury as to all arbitrable Disputes.
You and Airbnb Payments acknowledge and agree that, to the fullest extent permitted by law, we are each waiving the right to participate as a plaintiff or class member in any purported class action lawsuit, class- wide arbitration, private attorney general action, or any other representative or consolidated proceeding. Unless we agree in writing or as provided in this agreement, the arbitrator may not consolidate more than one party’s claims and may not otherwise preside over any form of any class or representative proceeding. If there is a final judicial determination that applicable law precludes enforcement of the waiver contained in this paragraph as to any claim, cause of action or requested remedy, then that claim, cause of action or requested remedy, and only that claim, cause of action or requested remedy, will be severed from this agreement to arbitrate and will be brought in a court of competent jurisdiction. In the event that a claim, cause of action or requested remedy is severed pursuant to this paragraph, then you and we agree that the claims, causes of action or requested remedies that are not subject to arbitration will be stayed until all arbitrable claims, causes of action and requested remedies are resolved by the arbitrator.
You and Airbnb Payments acknowledge and agree that the relative benefits and efficiencies of arbitration may be lost when 100 or more arbitration claims are filed within 180 days which (1) involve the same or similarly situated parties; (2) are based on the same or similar claims which arise from the same or substantially identical transactions, incidents, alleged violations or events requiring the determination of the same or substantially identical questions of law or fact; and (3) involve the same or coordinated counsel for the parties (“Mass Action”). Accordingly, you and Airbnb Payments agree to waive the right to have any Dispute administered, arbitrated, or resolved as part of a Mass Action (though Sections 15 and 15.12 will continue to apply to the Dispute). In case of a dispute, the appointed arbitrator for the first matter instituted within a set of claims identified by either party shall decide whether those claims are part of a Mass Action. If no arbitrator has yet been appointed, an arbitrator shall be appointed solely to determine whether claims identified by either party are part of a Mass Action. Nothing in this provision prevents you or Airbnb Payments from participating in a mass settlement of claims.
If for any reason, notwithstanding Section 15.13, an arbitration proceeds as part of a Mass Action, the parties shall group the arbitration demands into batches of no more than 200. The batches shall be determined by listing the claimants’ alphabetically (by last name or business name, as applicable)—for example, the first 200 claimants listed will be the first batch, the next 200 claimants listed will be the second batch, and so forth. The parties shall randomly assign each batch a sequential number and arbitrate the batches one at a time, in sequential order. While one batch is being arbitrated, the arbitration provider shall hold the remainder in abeyance unless otherwise agreed by the parties or instructed by the arbitration provider. Each batch shall be resolved within 240 days of the pre-hearing conference for that batch. Notwithstanding the forgoing, if any claimant’s demand has not been the subject of a pre-hearing conference within 2 years of the latest-filed demand in the Mass Action, such claimant may elect to pursue the claims asserted in the claimant’s demand in court subject to Sections 14 and 15.12.
At least 10 days before the date set for the arbitration hearing, you or Airbnb Payments may serve a written offer of judgment on the other party to allow judgment on specified terms. If the offer is accepted, the offer with proof of acceptance shall be submitted to the arbitration provider, who shall issue an award accordingly. If the offer is not accepted prior to the arbitration hearing or within 30 days after it is made, whichever occurs first, it shall be deemed withdrawn and cannot be given as evidence in the arbitration, other than with respect to costs (including all fees paid to the arbitration provider). If an offer made by one party is not accepted by the other party, and the other party fails to obtain a more favorable award, the other party shall not recover their post-offer costs and shall pay the offering party’s costs (including all fees paid to the arbitration provider) from the time of the offer.
Except as provided in Section 15.12, in the event that any portion of this Arbitration Agreement is deemed illegal or unenforceable, such provision shall be severed and the remainder of the Arbitration Agreement will be given full force and effect.
If Airbnb Payments amends this Section 15 after the date you last accepted these Payments Terms (or accepted any subsequent changes to these Payments Terms), you may reject the change by sending us written notice no later than thirty (30) days of the date the change is effective. Your notice must include your name, mailing address, the date of the notice, your Airbnb username, the email address you used to set up your Airbnb account, your signature, and an unequivocal statement that you want to opt out of the amended Section 15. You must either mail your notice to this address: 888 Brannan St, San Francisco, CA 94103, Attn: Arbitration Opt-Out, or email the opt-out notice to arbitration.opt.out@airbnb.com. Rejecting a new change, however, does not revoke or alter your prior consent to any earlier agreements to arbitrate any Dispute between you and Airbnb Payments (or your prior consent to any subsequent changes thereto), which will remain in effect and enforceable as to any Dispute between you and Airbnb Payments.
Except as provided in Section 15.12 and subject to Section 13.7, this Section 15 will survive any termination of these Payments Terms and will continue to apply even if you stop using the Payment Services or terminate your Airbnb account.
Except as they may be supplemented by additional terms and conditions, policies, guidelines, or standards, these Payments Terms constitute the entire agreement between Airbnb Payments and you regarding the subject matter hereof, and supersede any and all prior oral or written understandings or agreements between Airbnb Payments and you regarding the Payment Services. This clause does not exclude a party’s liability for prior false, misleading or deceptive statements or misrepresentations, whether oral or written. If any provision of these Payments Terms is held to be invalid or unenforceable, such provision will be struck and will not affect the validity and enforceability of the remaining provisions.
Subject to any limitation expressly stated in these Payments Terms or the Terms, or any document, policy or standard incorporated into them, Airbnb Payments’ or a Member’s failure to enforce any right or provision in these Payments Terms will not constitute a waiver of such right or provision unless acknowledged and agreed between the relevant parties in writing. Except as expressly set forth in these Payments Terms, the exercise by Airbnb Payments or a Member of any of its remedies under these Payments Terms will be without prejudice to its other remedies under these Payments Terms or otherwise permitted under law.
You may not assign, transfer, or delegate this agreement or your rights and obligations hereunder without Airbnb Payments’ prior written consent (not to be unreasonably withheld or delayed). Airbnb Payments may assign, transfer, or delegate this agreement and any rights and obligations, at its sole discretion, with thirty (30) days’ prior notice (or two (2) months’ prior notice (for Members contracting with Airbnb Payments UK) provided that this would not reduce your rights or benefits under these terms.
Unless specified otherwise, any notices or other communications permitted or required under this agreement, will be in writing and given by Airbnb Payments via email or Airbnb Platform notification, and depending on your notification setting, messaging service (including SMS and WeChat). The date of receipt will be deemed the date on which Airbnb Payments transmits the notice.
This Section 17 will apply if you are contracting with Airbnb Payments UK. To the extent that there is any conflict between this Section 17 and any other provision of these Payment Terms, the provisions of this Section 17 shall apply
The Payment Services include the payment collection service provided to Hosts contracting with Airbnb Payments UK. The payment collection service constitutes a “payment service” regulated under the Payment Services Regulations and for these purposes Airbnb Payments UK treats Hosts as the “payment service user.”
By agreeing to these Payments Terms you as a Host have consented to Airbnb Payments UK’s payment of each Payout to your chosen Payout Method. Hosts may change a Payout Method up to one (1) day before the time agreed for the Payout as set out in Section 3.3. Airbnb Payments UK will be deemed to have received the Host's payment order to the Host on the same date Airbnb Payments UK agrees to initiate the Payout in accordance with Section 3.3.
Airbnb Payments UK will endeavor to ensure that Hosts based in the UK will receive each Payout by the end of the business day following Airbnb Payments UK’s initiation of the Payout.
Airbnb Payments will provide the Host notice via email when we initiate each Payout. We will also provide notice to a Host’s registered email address if the Payout is returned to us because of an error. It is your responsibility as a Host to ensure that you provide us with a current, accurate, and valid email address.
If you as a Host believe or become aware that a Payout properly due to you has been or may be diverted without your authorization (“Diverted Payout”) because your password or other credentials to log into your Airbnb account (“Credentials”) have been lost, stolen, or misappropriated, you should notify Airbnb Payments UK without undue delay. As a Host you may be liable for losses relating to any Diverted Payout arising from the use of lost, stolen, or misappropriated Credentials (including the loss of a mobile phone on which you have installed the Application) or where you have failed to keep your Credentials safe, up to a maximum of £35. Provided that you notify us of any Diverted Payout without delay and at the very latest within 13 months of the date of the payment, you may be entitled to a refund of that payment.
If you as Host claim not to have received a Payout properly due to you via your chosen Payout Method (including where there has been a Diverted Payout), Airbnb Payments UK will (if requested by you without undue delay, on becoming aware of the unauthorized or incorrectly executed Payout and in any event within 13 months of it happening) make immediate efforts to trace the payment and will notify you of the outcome. Subject to Section 17.2.3, unless we can prove that (i) the Payout was received by you via your chosen Payout Method, or (ii) we made the Payout correctly using the Payout Method information you provided but the information you provided was incorrect, we will refund the amount. Where you have given us incorrect information, we will not be liable for the defective or non-execution of the Payout, however, we will make reasonable efforts to recover the Payout funds.
You must use your Credentials in accordance with these Payment Terms, and take all reasonable steps to keep your Credentials safe. As a Host you may be liable for losses suffered by Airbnb Payments UK in attempting to trace and recover a Diverted Payout (up to a maximum of £35) arising from the use of lost, stolen, or misappropriated Credentials including where due to the loss of a mobile phone on which you have installed the Application or where you have failed to keep your Credentials safe. You will not be liable for losses suffered by Airbnb Payments UK in attempting to trace and recover a Diverted Payout where the loss, theft or misappropriation of your Credentials was not detectable by you prior to the Diverted Payout (unless you acted fraudulently in connected with the Diverted Payout), or where the loss suffered by Airbnb Payments UK was caused by acts or omissions of Airbnb personnel or a service provider. You may however be liable to Airbnb Payments UK for all losses relating to attempted tracing and recovery of a Diverted Payout if we can produce reasonable evidence that you acted fraudulently or where you failed to use the Airbnb Platform and/or Payment Services in accordance with the Terms or these Payment Terms (including the obligation to keep your Credentials safe). Except where you have acted fraudulently, you will not be liable to Airbnb Payments UK for any losses incurred in respect of the attempted tracing and recovery of a Diverted Payout arising after notification by you of the loss, theft, or misappropriation of your Credentials or of the unauthorized use of your Credentials, where we have failed at any time to provide appropriate means for such notification, or where we do not require strong customer authentication, where required.
Any complaints about the Payment Services should be made to Airbnb Payments UK. If you are not happy with the outcome of a complaint and you as a Host have received regulated Payment Services from Airbnb Payments UK, you may also be able to refer your complaint to the Financial Ombudsman. All complaints to the Financial Ombudsman Service are subject to the rules of the Financial Ombudsman Service, including in relation to eligibility requirements. The UK Financial Ombudsman Service offers a free complaints resolution service. You may obtain further information regarding the Financial Ombudsman Services and contact details at: http://www.financial-ombufsman.org.uk.
The following paragraphs also apply if you are using the Payment Services as a representative (“Representative”) acting on behalf a business, company or other legal entity (in such event, for purposes of the Payments Terms, “you” and “your” will refer and apply to that business, company or other legal entity).
You accept the Payments Terms and you will be responsible for any act or omission of employees or third-party agents using the Payment Service on your behalf.
You and your Representative individually affirm that you are authorized to provide the information described in Section 2.1 and Section 3.2 and your Representative has the authority to bind you to these Payments Terms. We may require you to provide additional information or documentation demonstrating your Representative’s authority.
You represent and warrant to us that: (i) you are duly organized, validly existing and in good standing under the laws of the country in which your business is registered and that you are registering for receiving the Payment Services; and (ii) you have all requisite right, power, and authority to enter into this agreement, perform your obligations, and grant the rights, licenses, and authorizations in this agreement.
If you are using your Payment Method for the benefit of your employees or other authorized third-party in connection with Airbnb for Work, as permitted by your account, you authorize Airbnb Payments to charge your Payment Method for bookings requested by employees at your company or other permitted third-party.
For any Payout Method linked to your Airbnb account, you authorize Airbnb Payments to store the Payout Method, remit payments using the Payout Method for bookings associated with your Airbnb account and take any other action as permitted in the Payments Terms in respect of the Payout Method.
If you handle, store or otherwise process payment card information on behalf of anyone or any third-party, you agree to comply on an ongoing basis with applicable data privacy and security requirements under the current Payment Card Industry Data Security Standard with regards to the use, access, and storage of such credit card information.
